Subcontractor Dispute definition

Subcontractor Dispute means a dispute between the Developer and a Subcontractor as more particularly described in Section 22.3 of the Agreement.
Subcontractor Dispute has the meaning set forth in Exhibit 20 to this DBA.
Subcontractor Dispute means any dispute by a Subcontractor, including also any pass-through claims by a lower tier Subcontractor, against Maintenance Contractor that is actionable by Maintenance Contractor against TxDOT and arises from the Maintenance Services, materials or other services provided or to be provided under the CMA Documents. If Maintenance Contractor determines to pursue a Dispute against TxDOT that includes a Subcontractor Dispute, the following additional conditions shall apply:

Examples of Subcontractor Dispute in a sentence

  • Failure of DB Contractor to assert a Subcontractor Dispute on behalf of any Subcontractor at the time of submission of a related demand by DB Contractor, as provided hereunder, shall constitute a release and discharge of TxDOT by DB Contractor on account of, and with respect to, such Subcontractor Dispute.

  • DB Contractor shall identify clearly in all submissions pursuant to this Exhibit 13, that portion of the Dispute that involves a Subcontractor Dispute.

  • Dispute resolution and the appeals process shall be followed as outlined in the CFCHS policy: Subcontractor Dispute Resolution.

  • DB Contractor shall identify clearly in all submissions pursuant to this Exhibit 14, that portion of the Dispute that involves a Subcontractor Dispute.

  • Subcontractor Dispute Resolution‌ The CSB shall include contract dispute resolution procedures in its contracts with subcontractors.

  • If Contractor decides to appeal a COFD relating to a Subcontractor Dispute, Subcontractor will provide Contractor all reasonable assistance and documentation in pursuing such an appeal, and Subcontractor shall be responsible for all costs and expenses incurred by Contractor in sponsoring such appeal.

  • To the extent that Contractor is required by the Contract Disputes Act or otherwise to provide a certification as to a Subcontractor Dispute, Subcontractor shall make available to Contractor all required documentation necessary to allow Contractor to execute the required certification.

  • Dispute Resolution procedures are outlined in the CFCHS Procurement Policy and the CFCHS Subcontractor Dispute Resolution Policy.

Related to Subcontractor Dispute

  • Supplier’s Team means the Supplier and, where applicable, any Relevant Person, and all other employees, consultants, agents and sub-contractors which the Supplier engages in any way in relation to the supply of the Services or the Goods; and

  • Contractor Personnel means Contractor’s employees and subcontractors (as well as any employees or subcontractors of those subcontractors) performing the Services.

  • Contractor Project Manager means the employee identified in a Statement of Work as the Contractor project manager.

  • Major Subcontractor means a Subcontractor who enters into a Major Subcontract.

  • Subcontractor means any supplier, distributor, vendor, or firm that furnishes supplies or services to or for a prime contractor or another subcontractor.

  • Subcontractor employee, as used in this clause, means any officer, partner, employee, or agent of a subcontractor.

  • Sub-subcontractor means a Person engaged by a Subcontractor to perform a portion of the Trade Contractor Work. The term “Sub-Subcontractor” also includes any lower tier Persons engaged by Sub-Subcontractor to perform a portion of the Trade Contractor Work.

  • Contractor means the individual or entity, that has entered into this contract with the Commonwealth.

  • Mobile crisis outreach team means a crisis intervention service for minors or families of minors experiencing behavioral health or psychiatric emergencies.

  • Subcontractors means subcontractors or subconsultants at any tier that are under the direct or indirect control or responsibility of the Contractor, and includes all independent contractors, agents, employees, authorized resellers, or anyone else for whom the Contractor may be liable at any tier, including a person or entity that is, or will be, providing or performing an essential aspect of this Contract, including Contractor’s manufacturers, distributors, and suppliers.

  • Contractor/Supplier means the person or company whose tender is accepted by the Purchaser and shall be deemed to include the Contractor’s successors, heirs, executors, administrators, representatives and assigns approved by the Purchaser.

  • Third Party Contractor as used in the Student Data Protection Act and “Operator” as used in COPPA. De-Identified Information (DII): De-Identification refers to the process by which the Contractor removes or obscures any Personally Identifiable Information (“PII”) from Education Records in a way that removes or minimizes the risk of disclosure of the identity of the individual and information about them.

  • Contractor’s Proposal means the proposal submitted by the Contractor with the Tender, as modified and accepted by the Employer and included in the Contract. Such documents may include the Contractor’s preliminary design.

  • Contractor's Personnel means the personnel to be provided by the Contractor to provide services as per the contract.

  • Supplier/Contractor means the individual, firm or company with whom the contract has been concluded for supplying the Goods and Services under the Contract. The Supplier/Contractor shall be deemed to include its successors (approved by the purchaser), representatives, heirs, executors, administrators and permitted;

  • Contractor Parties means a Contractor’s members, directors, officers, shareholders, partners, managers, principal officers, representatives, agents, servants, consultants, employees or any one of them or any other person or entity with whom the Contractor is in privity of oral or written contract (e.g. subcontractor) and the Contractor intends for such other person or entity to perform under the Contract in any capacity. For the purpose of this Contract, vendors of support services, not otherwise known as human service providers or educators, shall not be considered subcontractors, e.g. lawn care, unless such activity is considered part of a training, vocational or educational program.

  • Scope of Work means the description of Services and Deliverables specified in the Contract and as may be amended.

  • Contractor Software means software which is proprietary to the Contractor, including software which is or will be used by the Contractor for the purposes of providing the Services.

  • Principal of a subcontractor means (i) any individual who is a member of the board of directors of, or has an ownership interest of five per cent or more in, a subcontractor, which is a business entity, except for an individual who is a member of the board of directors of a nonprofit organization, (ii) an individual who is employed by a subcontractor, which is a business entity, as president, treasurer or executive vice president, (iii) an individual who is the chief executive officer of a subcontractor, which is not a business entity, or if a subcontractor has no such officer, then the officer who duly possesses comparable powers and duties, (iv) an officer or an employee of any subcontractor who has managerial or discretionary responsibilities with respect to a subcontract with a state contractor, (v) the spouse or a dependent child who is eighteen years of age or older of an individual described in this subparagraph, or (vi) a political committee established or controlled by an individual described in this subparagraph or the business entity or nonprofit organization that is the subcontractor.

  • Service Subcontract means a subcontract primarily for the furnishing of services, to or for a recipient of Assistance, except where services are incidental to the delivery of products, equipment or commodities. A contract for the purchase or lease of goods, products, equipment, supplies or other property is not a “service subcontract” for the purposes of this definition.

  • Contractor System means the information and communications technology system used by the Contractor in performing the Services including the Software, the Contractor Equipment and related cabling (but excluding the Authority System).

  • Contractor Representative means any of the following:

  • Licensed site remediation professional means an individual

  • HUB Subcontracting Plan or “HSP” means written documentation regarding the use of subcontractors, which is required to be submitted with all responses to state agency contracts with an expected value of $100,000.00 or more where subcontracting opportunities have been determined by the state agency to be probable. The HUB subcontracting plan subsequently becomes a provision of the awarded Contract and shall be monitored for compliance by the state agency during the term of the Contract.

  • Subprocessors means a service provider of Autodesk, Inc. or its affiliates.

  • Scope of Works means the sections of the RFQ detailing the technical requirements of the work to be carried out as existing at the Date of Acceptance of the Quotation and any modification of such Works thereafter directed or the use of which has been permitted by the Superintendent for the purposes of the Contract.
