Testing Participant definition

Testing Participant means, in respect of each Testing Service, the persons (whether or not they are Parties) who are entitled to undertake such tests, as described in Section H14 (Testing Services), together with any other persons identified as such in Section T (Testing During Transition).

Testing Participant refers to those: (i) Settling Plaintiffs, (ii) Settling Unfiled Claimants, and (iii) Settling Additional Plaintiffs who timely and validly elect to receive the Testing by timely submitting a completed Testing Election Form.

Examples of Testing Participant in a sentence

  • Section X11.8 of the Code specifies that Section H14 of the Code (Testing Services) and the Enduring Testing Approach Document shall apply in respect of testing under a SEC Variation Testing Approach Document as if such testing was a Testing Service under Section H14.34 (Modification Implementation Testing); and each participant in such testing shall be deemed to be a Testing Participant for such purposes.

  • Where the Testing Participant disagrees with the DCC’s determination pursuant to Section H14.41 of the matters set out at Section H14.39(c) (but not otherwise), then the Testing Participant may request that the DCC refers the matter to the Secretary of State.

  • The process set out in Section H14.37 onwards of the Code shall apply for the purposes of Testing Issue resolution during SIT, UTS, SCT, and MT; subject to Clause14.2 and Clause 14.3.   • For the purposes of Migration DUST, the definition of Testing Participant Systemswithin the ETAD shall also include any systems and processes used in whole or in part for the testing equivalent of the file processing by the Responsible Supplier to support Migration as defined in the TMAD.

  • FTR Participant means any Market Participant that provides or is required to provide Collateral in order to participate in PJM’s FTR auctions.

  • Reporting Participant means a Participant who is subject to the reporting requirements of Section 16 of the Exchange Act.

  • Plan Participant means a person who is eligible to receive, and is receiving, a pension benefit from the Plan.

  • Employee Participant means an Employee who holds an outstanding Award under the terms of the Plan.

  • Current Participant means a person who participated in the Plan during the Class Period and had an Active Account on May 11, 2018.

  • Non-U.S. Participant means any Participant that if it were a Lender would qualify as a Non-U.S. Lender.

  • U.S. Participant means any Participant who is a United States citizen or United States resident alien as defined for purposes of Section 7701(b)(1)(A) of the Code or for whom an Award is otherwise subject to taxation under the Code.

  • Covered Executive means any “executive officer” of the Company as defined under Rule 10D-1.

  • Former Participant means a person who has been a Participant, but who has ceased to be a Participant for any reason.

  • First Tier Participant refers to the participant who has entered into a covered transaction with a grantee or subgrantee of Federal funds (such as the prime or general contractor). “Lower Tier Participant” refers any participant who has entered into a covered transaction with a First Tier Participant or other Lower Tier Participants (such as subcontractors and suppliers).
