The Settlement Benefits. 6. What does the settlement provide? If approved by the Court, Defendants will establish a Settlement Fund totaling $38,000,000. Settlement Class Member payments, as well as the cost to administer the Settlement, the cost to inform people about the Settlement, any attorneys' fees and costs awarded by the Court, and any incentive award to the Class Representatives approved by the Court will also come out of this fund.
The Settlement Benefits. WHAT YOU GET The Settlement provides that Rexam will pay the aggregate sum of One Million Four Hundred Thousand Dollars ($1,400,000.00) to settle this case. The $1,400,000.00 will be distributed to the Class Representatives, the Class Members, and Class Counsel. You may be eligible to get a payment from the Settlement for the harm you believe you suffered as a result of the alleged race discrimination and alleged racially hostile work environment at Rexam’s Chicago Beverage Can facility or its Elk Grove Village Cap Can facility. The amount of each monetary award will be determined based on a points system. This points system will take into account several factors, including but not limited to your length of employment, dates of employment, whether the alleged harassment or discrimination was personally directed at you, whether you allege to have been actually or constructively discharged, whether you allegedly received more difficult work assignments because of race, whether you allegedly received harsher or more frequent discipline because of race, whether you allegedly complained of discrimination, your managerial status, and the overall strength of your claim. HOW YOU GET A PAYMENT—SUBMITTING A CLAIM AND RELEASE FORM To receive a payment from the Settlement fund you must submit the enclosed Claim and Release Form on or before --(To be inserted by Settlement Administrator based on mailing date – must be 45 days after Settlement Administrator mails the Notice Packet – this is also the “Claim Deadline” – see definition herein) to: Rust Consulting, Inc. 000 Xxxxxxxxx Xxx., Xxxxx 000 Minneapolis, MN 55402 The Claim and Release Form must be actually received by Rust Consulting, Inc. on or before such date in order to be considered timely and for you to be paid. It is your obligation to make sure Rust Consulting, Inc. receives your Claim and Release Form before the due date. All Claim and Release Forms must be signed under penalty of perjury to be considered. If you are determined to be eligible for a Settlement payment, you will receive a check after the Court reviews and approves all of the proposed payments to Class Members. This process may take some time. Please be patient.
