All Settlement Expenses (including those described in Section 7.1.3) shall be paid from the Settlement Fund prior to the distribution of the Settlement Proceeds.
Within thirty (30) calendar days following the voidance of all outstanding checks from the First Distribution and any Second Distribution, the Settlement Fund, following the payment of all outstanding Settlement Expenses, shall be distributed to the Pension Rights Center, as a cy pres payment, or, with consent of the Parties at the time of the Final Distribution, one or more alternative entities supporting and/or educating 401(k) savers ( “Final Payment”).
