Third Party Disbursing Agent definition

Third Party Disbursing Agent means an Entity designated by Reorganized Swift to act as a Disbursing Agent pursuant to Section VI.B.

Third Party Disbursing Agent means an entity or entities employed by the Reorganized Debtor in its sole discretion to act as Disbursing Agent. If the Reorganized Debtor elects to make distributions without a Third Party Disbursing Agent, then references under this Plan to the Third Party Disbursing Agent shall be deemed to be references to the Reorganized Debtor.

Third Party Disbursing Agent means an Entity designated by the Liquidation Trustee to act as a Disbursing Agent pursuant to Section V.B.

• All costs and expenses associated with the implementation of this Plan, including the costs and expenses of any Third Party Disbursing Agent or other Person retained by Reorganized RoomStore to assist in the administration of this Plan, shall be the responsibility of and paid by Reorganized RoomStore.

• Reorganized RoomStore or any Third Party Disbursing Agent shall hold the Unsecured Claims Reserve (including any dividends, payments, or other distributions made on account of such securities) pending distribution Pro Rata to the holders of Allowed Unsecured Claims and the Allowed Affiliated Debtor Claim, as applicable.

• Any cash not distributed pursuant to this Section VI.H.4 with respect to Claims in a Class other than Class 6 will be the property of Reorganized Pillowtex, free of any restrictions thereon, and any such cash held by a Third Party Disbursing Agent will be returned to Reorganized Pillowtex.

• These payments will be made on terms agreed to with Reorganized LGII and will not be deducted from distributions to be made pursuant to the Plan to holders of Allowed Claims (including any distributions of Cash Investment Yield) receiving distributions from a Third Party Disbursing Agent.

• The Reorganized Debtor may, at its option, employ an Indenture(s) Trustee to act as the Third Party Disbursing Agent in respect of certain Claims subject to Indentures.

Third Party Disbursing Agent means an Entity engaged by Reorganized American Apparel in its capacity as Disbursing Agent or engaged by the Litigation Trustee to act as a Disbursing Agent pursuant to Section V.
