Indemnified expenses shall include, without limitation, all out-of-pocket expenses, such as attorneys' fees, including the reasonable value of any services rendered by the Town Counsel.
If the School Committee does not provide Town Counsel or other counsel and if the teacher prevails in the proceedings, the School Committee will reimburse the teacher for reasonable counsel fees incurred by him/her as allowed by law.
If the teacher desires to bring civil or criminal proceedings in connection with an alleged assault suffered by him/her while acting within the scope of his/her employment, such teacher may request the School Committee to request Town Counsel to represent him/her in such proceedings.
If criminal or civil proceedings are brought against the teacher alleging that he/she committed an assault while acting within the scope of his/her employment, to the extent permitted by law, the School Committee will request the assistance of Town Counsel to defend him/her in such proceedings, if he/she requests such assistance.
This Contract is only binding upon, and enforceable against, the Town if: (1) the Contract is signed by the Board of Selectmen or its designee; and (2) endorsed with approval by the Town Accountant as to appropriation or availability of funds; and (3) endorsed with approval by the Town Counsel as to form.
