Trustee Affiliate definition

Trustee Affiliate means an entity that directly, or indirectly through one or more intermediaries, controls, or is controlled by, or is under common control with, the Trustee. Any income or gain realized as a result of any such investment shall be promptly distributed (in no event later than the next Business Day) to the Company after any intended amounts have been paid to the Holders entitled thereto, except after the occurrence and during the continuance of an Event of Default. The Trustee shall have no liability to the Company for any loss resulting from any investment made in accordance with this Section, and shall bear no expense in connection with any investment pursuant to this Section. Any such investment may be sold (without regard to maturity date) by the Trustee whenever necessary to make any distribution required by this Indenture. Nothing herein shall require the Trustee to invest funds held by it pursuant to the last paragraph of Section 1003.
Trustee Affiliate means, with respect to the Trustee, any other Person that, at the time of determination, directly or indirectly through one or more intermediaries Controls, is Controlled by or is under common Control with, the Trustee.
Trustee Affiliate means an affiliated company of the Trustee, within the meaning of the Business Corporations Act (Ontario) (the "OBCA"), and includes, for so long as CIBC Mellon Trust Company is the Trustee, Canadian Imperial Bank of Commerce, CIBC Mellon Global Securities Company and Mellon Bank N.A. and each of their affiliates, within the meaning of the OBCA;

Trustee Affiliate has the meaning ascribed to such term in Section 13.9.

  • Trustee Functions means the functions set out in paragraph 6;

  • Trust Depositor means Harley-Davidson Customer Funding Corp., in its capacity as trust depositor under the Sale and Servicing Agreement.
