Union Delegate Rights. 51.1 To the extent that the provisions of clause 36A of the Award may confer a more favourable benefit upon a workplace delegate than the explicit terms of this clause, those provisions will operate as terms of this clause. 51.2 Where an Employee has been elected as a Union Delegate, the Employer will recognise the following rights: (a) the right to be treated fairly and to perform their role without any discrimination in their employment; (b) for the Union Delegate to represent an Employee when requested in relation to a grievance, dispute or a discussion with a member of the Union; (c) the right to place information on a notice board in a prominent location in the workplace except that the material must not breach freedom of association, privacy and other applicable laws; (d) the right to paid time to attend industrial tribunals and/or courts where they have been requested to do so by an Employee (which may include themselves) whom they represent in a particular dispute in their workplace; (e) the right to paid time to assist and represent Employees who have requested them to represent them in respect of a dispute arising in their workplace; (f) the right to represent the interests of members in their workplace to the Union, Employer and industrial tribunals/courts; and (g) the right to paid time to attend Union meetings for the purposes of the Union and Project related matters, typically monthly or as reasonably required. 51.3 Union Delegates will be paid the classification rate applicable to their substantive role taking into consideration their skills and/or tickets. 51.4 The Employer will consult and agree with the Union prior to the Employer making a decision to terminate or transfer a Union Delegate/Employee Representative.The Union Delegate/Employee Representative is entitled to one week’s notice in advance of such termination or transfer. Payment in lieu of notice may be made by agreement.

Union Delegate Rights. (a) This clause outlines the rights for Union Delegates when assisting Employees. (b) Such representatives are entitled to the protections of Division 4 of Part 3-1 of the Act in relation to their involvement in lawful industrial activities. Where an Employee has been elected as a Union Delegate, the Employer will recognise the Union Delegate has the right to: (i) be treated fairly and to perform their role as Union Delegate without any discrimination in their employment; (ii) represent an Employee where requested in relation to a grievance, dispute or a discussion with a member of the Union; (iii) paid time to attend job matters affecting Employees (such as disciplinary and other appropriate meetings), industrial tribunals and/or courts where they have been requested to do so by an Employee (which may include themselves) whom they represent in a particular dispute in their workforce; (iv) paid time during normal working hours, to consult and confer with Union Officials; (v) paid time during normal working hours to participate in the necessary operations of the Union, provided: A. sufficient notice is given to the Employer; and B. the Employer agrees. However, agreement will not be unreasonably withheld by the Employer. (vi) be present at site induction meetings for the purpose of being introduced as the Union Delegate; and (vii) place information on a Union noticeboard in a prominent location in the workplace.

Union Delegate Rights. 37.1 The Employer will treat delegates fairly and allow them to perform their roles as a union delegate without any discrimination in their employment. The Employer recognises and respects that union delegates speak on behalf of the relevant union members in the workplace. 37.2 Union delegates will be granted reasonable paid time to: (a) represent members in bargaining; (b) represent the interests of members to the Employer and industrial tribunals; (c) consult with union members and other Employees for whom the delegate is a bargaining representative. 37.3 Union delegates will be provided up to a maximum of three days’ paid time per annum to: (a) attend union education; (b) attend courses conducted by an approved training provider, which are designed to provide skills and competencies that will assist the delegate or workplace representative contribute to the prompt resolution of disputes and or grievances in the workplace. 37.4 Union delegates will be given reasonable access to telephone, fax, internet, email facilities for the purpose of carrying out their role as a union delegate. 37.5 Leave of absence granted pursuant to this clause, will count as service for all purposes of this Agreement. Paid hours allotted to union delegates each year cannot be deferred or used in any subsequent year; these hours are not cumulative. 37.6 Each Employee on leave approved in accordance with this clause, will be paid their ordinary hours. 37.7 All expenses (such as travel, accommodation and meals) associated with or incurred by the Employee attending a training course as provided in this clause will be the responsibility of the Employee or the union. 37.8 An Employee may be required to satisfy the Employer of attendance at the course to qualify for payment of leave. 37.9 An Employee granted leave pursuant to this clause will, on request, inform the Employer of the nature of the course attended. 37.10 In the event of a disagreement arising from the outcome of this clause, the matter may be settled using the dispute settlement procedure of this Agreement. 37.11 Union delegates will be permitted to post authorised union materials on noticeboards provided for that purpose in the workplace. Union Delegate Rights. 9.3.1 The Union delegate must be allowed the facility and the necessary time during working hours to meet with Employees. The Union delegate must be allowed the necessary time during working hours to meet with a representative of management on matters affecting Employees whom the delegate represents. 9.3.2 A Union delegate must not exercise any of the functions in this clause where to do so would result in unreasonable under-staffing or disruption of, or be detrimental to the workplace. 9.3.3 This clause operates only to the extent that its obligations relate to the relationship between the Employer and the Employees covered by this Agreement.
