Union Delegate Rights. 29.1 DSI Underground will make available six (6) days per delegate per year (to be pooled) to attend training courses. Notification of training is required in writing at least 28 days before, where feasible, and shall indicate the nature of the training and the course timetable. 29.2 DSI Underground shall recognise appointed union delegates in the enterprise upon notification by the Union. Union delegates shall, with prior agreement with DSI Underground (where reasonably practicable), be allowed reasonable time during work hours to: i. Interview employees and DSI Underground or DSI Underground’s representative on matters affecting employees whom they represent; ii. Place Union information on notice boards in a prominent location in the workplace; iii. Prepare and participate in collective bargaining, the consultation and the dispute settling procedure and attend industrial tribunals (where relevant to the site). In the event of an Employee Representative having to attend a hearing before the Fair Work Commission, up to two (2) employees per Union involved will be realised on normal working wages for no more than a normal shift for that day; and iv. Attend activities related to representation of employees. 29.3 Union delegates shall be provided with the use of an adequate and secure private meeting room with access to reasonable facilities such as telephone, fax, lockable cabinets, e-mail and internet access to conduct legitimate Union business. DSI Underground will provide sufficient notice boards in various locations around the workplace. 29.4 Union delegates shall be entitled to convene up to two (2) paid meetings per annum of members employed at the premises for a period of one (1) hour during normal working hours. Delegates shall consult the company with the view of the timing of such meetings in an attempt to minimise disruption to business. Additional paid meetings will not be unreasonably refused by DSI Underground. 29.5 Delegates will be entitled to one (1) paid delegates meeting per month for a period of one (1) hour. Where the agenda requires paid time in excess of one (1) hour, it shall be by agreement with DSI Underground. DSI Underground will not unreasonably withhold agreement.

Union Delegate Rights. 37.1 The Employer will treat delegates fairly and allow them to perform their roles as a union delegate without any discrimination in their employment. The Employer recognises and respects that union delegates speak on behalf of the relevant union members in the workplace.

37.3 Union delegates will be provided up to a maximum of three days’ paid time per annum to:
(a) attend union education;
(b) attend courses conducted by an approved training provider, which are designed to provide skills and competencies that will assist the delegate per or workplace representative contribute to the prompt resolution of disputes and or grievances in the workplace.
37.4 Union delegates will be given reasonable access to telephone, fax, internet, email facilities for the purpose of carrying out their role as a union delegate.
37.5 Leave of absence granted pursuant to this clause, will count as service for all purposes of this Agreement. Paid hours allotted to union delegates each year cannot be deferred or used in any subsequent year; these hours are not cumulative.
37.6 Each Employee on leave approved in accordance with this clause, will be paid their ordinary hours.
37.7 All expenses (such as travel, accommodation and meals) associated with or incurred by the Employee attending a training course as provided in this clause will be the responsibility of the Employee or the union.
37.8 An Employee may be required to be pooled) satisfy the Employer of attendance at the course to attend training courses. Notification qualify for payment of training is required in writing at least 28 days beforeleave.
37.9 An Employee granted leave pursuant to this clause will, where feasibleon request, and shall indicate inform the Employer of the nature of the training and the course timetableattended.

i. Interview employees (i) represent the interests of members at Discovery Early Learning Centres and DSI Underground or DSI Underground’s representative on matters affecting employees whom they representat times industrial tribunals;
(ii. Place Union information on notice boards in ) consult with union members and other Employees for whom the delegate is a prominent location in the workplacebargaining representative;

29.4 (b) It is recognised that union training leave is unpaid. In addition to union training leave, the Employee may elect to utilise other forms of leave in accordance with other terms of this Agreement.
(c) Any request for leave to attend union training, the Employee must submit their request in writing with 14 days’ notice prior to the commencement of the Union delegates training to Discovery Early Learning Centres. Approval of the leave request shall be entitled on the basis that Discovery Early Learning Centres agrees to convene up release the delegate from their normal roster if the delegate was rostered to two work during the time of leave.
(2d) paid meetings per annum The granting of members employed at any leave pursuant to this clause shall be subject to Discovery Early Learning Centres being able to make adequate staffing arrangements amongst current Employees during the premises for a period of one such leave. Discovery Early Learning Centres shall not use this subclause to avoid an obligation under this clause.
