Unlawful Subsidy definition

Unlawful Subsidy means Subsidy which is in contravention of or is an infringement of the United Kingdom Competition Requirement;

Examples of Unlawful Subsidy in a sentence

  • If the Agreement Funding gives rise to an SPEI Overpayment or otherwise constitutes Unlawful Subsidy then Homes England shall be entitled to recover from the Grant Recipient the amount of such SPEI Overpayment and/or Unlawful Subsidy together with such interest as it is required by Legislation to recover and the Grant Recipient must pay such amount(s) within ten (10) Business Days of Homes England requesting repayment.

  • Notwithstanding anything in this Agreement: Homes England shall only provide Firm Scheme Grant to the extent that such does not give rise to Unlawful Subsidy; and the Grant Recipient must comply with the requirements of the United Kingdom Competition Requirement (where applicable) in respect of any Firm Scheme Grant paid.

  • If any Firm Scheme Grant is found to constitute Unlawful Subsidy and/or is not capable of being restructured so as to be compliant then the Grant Recipient must repay any sum of Unlawful Subsidy plus such interest as is prescribed by the United Kingdom Competition Requirement within ten (10) Business Days of Homes England issuing it with a written demand for payment.

  • Notwithstanding anything in this Agreement, the GLA shall only provide any Named Project Grant to the extent that such payment does not give rise to Unlawful Subsidy.

  • If the Agreement Funding gives rise to an SPEI Overpayment or otherwise constitutes Unlawful Subsidy then the GLA shall be entitled to recover from the Grant Recipient the amount of such SPEI Overpayment and/or Unlawful Subsidy together with such interest as it is required by Legislation to recover and the Grant Recipient must pay such amount(s) within ten (10) Business Days of the GLA requesting repayment.

  • Be aware that if the provision of Grant or any other relevant public sector subsidy constitutes an Unlawful Subsidy then The Combined Authority is entitled to recover the amount of such Unlawful Subsidy together with such interest as it is required by any Applicable Laws to recover.

  • In recognition of the shared interest of the General Partner, Manager and the Investors in ensuring that no Investments confer an Unlawful Subsidy on an Investee Company: • the Manager will liaise with the Lead Investor in relation to any prospective Investment regarding which there is uncertainty regarding compliance with Subsidy Control Rules; and • the basis on which it is understood that the Fund’s Investments will be made in accordance with the Subsidy Control Rules is set out below.

  • The need to, at request, provide written evidence that there is no Unlawful Subsidy.
