Unused Space definition

Unused Space means any space (i) existing in AT&T-21STATE’s Eligible Structures at the time of a Collocation request, (ii) that is not subject to a valid space reservation by AT&T-21STATE or any Third Party, (iii) that is not occupied by AT&T-21STATE’s, its Affiliates’, or Third Party’s equipment, and is not needed for access to, or egress from, work areas (iv) that is not being used by AT&T-21STATE’s or its Affiliates for administrative or other functions and (v) on or in which the placement of any equipment or network facilities (AT&T-21STATE’s or Requesting Collocator’s) would not violate any local or state law, rule or ordinance (e.g., fire, OSHA, or zoning) or technical standards (performance or safety) or would void AT&T-21STATE’s warranty on proximate equipment.
Unused Space is space within SBC-13STATE Premises which is available for collocation (subject to technically feasibility, state and local safety and engineering requirements, third party property rights, and other requirements set forth in this Agreement) unless it is (a) physically occupied by non-obsolete and/or used equipment; (b) assigned to another collocator; (c) used to provide physical access to occupied space;
Unused Space means any space (i) existing in Ameritech’s Premises at the time of a Collocation request, (ii) that is not subject to a valid space reservation (by Ameritech or any third party), (iii) that is not being used by Ameritech for a purpose other than to house its network facilities (e.g.. utilized administrative space (including offices, common areas, conference rooms, reasonable storage and etc.) bathrooms, hallways (ingress and egress), and etc.), and (iv) on or in which the placement of any equipment or network facilities (Ameritech’s or Requesting Carrier’s) would not (x) violate any local or state law, rule or ordinance (e.g., tire, OSHA or zoning) or technical standards (performance or safety) or (y) void Ameritech’s warranty on proximate equipment.

Examples of Unused Space in a sentence

  • If and only if there is no Unused Space for Physical Collocation, Requesting Carrier may submit to Ameritech an NSCR that requests Ameritech to provide Requesting Carrier Adjacent Collocation to the extent technically feasible.

  • Upon request, Ameritech shall provide Requesting Carrier Virtual Collocation in any Unused Space.

  • Upon request, Ameritech shall provide Requesting Carrier Ameritech Physical Collocation Service (“APCS”) in any Unused Space.

Unused Space denotes any space in the Eligible Structure which is not occupied by AMERITECH-ILLINOIS personnel and/or occupied by or reserved for AMERITECH-ILLINOIS network equipment including affiliates and 3rd parties. May also be used to denote space which has become available pursuant to Section 3.7.6. (See also sections 4.1.2.1, 4.1.3.1, 5.12, & 10.1)
Unused Space denotes any space in the Premises which is not occupied by SBC- 13STATE personnel and/or occupied by or reserved for growth of SBC-13STATE network equipment, including the equipment of affiliates and 3rd parties. May also be used to denote space within a specific LEVEL 3’s area that is not occupied by or reserved for LEVEL 3’s equipment. “Virtual Foreign Exchange (FX) Traffic” and “FX-type Traffic” shall refer to those calls delivered to telephone numbers that are rated as local to the other telephone numbers in a given mandatory local calling area, but where the recipient end user’s station assigned that telephone number is physically located outside of that mandatory local calling area. Virtual FX Service also permits an end user physically located in one exchange to be assigned telephone numbers resident in the serving Central (or End) Office in another, foreign,” exchange, thereby creating a local presence in the “foreign” exchange. Virtual FX Service differs from Dedicated FX Service, however, in that Virtual FX end users continue to draw dial tone or are otherwise served from a Central (or End) Office which may provide service across more than one Commission-prescribed mandatory local calling area, whereas Dedicated FX Service end users draw dial tone or are otherwise served from a Central (or End) Office located outside their mandatory calling area.
