Except as directed by a court of competent jurisdiction or as necessary to comply with applicable New York State or federal law(s) or regulation(s), and with the written consent of the Device User or Customer, where applicable, no data records or other information may be otherwise used, released or sold to any third-party by the Contractor.
Individually identifiable material and information relating to Device User or Customer, security codes or encryption methods, or other confidential information regarding the Authorized User’s business operations or data, shall be held confidential in accordance with these requirements and shall not be disclosed by the Contractor, its officers, agents or employees, subcontractors, without the prior written approval of the Authorized User and, where applicable, the Device User or Customer.
