Variation of this Agreement. This Agreement may be varied during its term by agreement in writing by the parties subject to the ratification process of the Union.
Variation of this Agreement. 9.01 The “Bank” may, from time to time at its sole and absolute discretion and determination vary, change, alter, modify, and/ or amend the terms and conditions of this Agreement, which variation, change, alteration, modification and/or amendment shall immediately become binding on the “Cardholder”. Such variation, alteration, modification, and/or amendment shall be notified to the “Cardholder” by the “Bank” either in writing or by publication thereof or by such means as the “Bank” may determine and a variation, alteration, modification, and/or amendment so notified shall be binding on the “Cardholder”.
9.02 At any time, without notifying the “Cardholder” or obtaining his consent, the “Bank” may assign the whole or any part of its rights or obligations under this Agreement.
9.03 The validity, legality and enforceability of each of the terms and conditions of this Agreement is distinct and severable from one another.
9.04 The “Cardholder” usage of the “Card” from the effective date of any variation, change, alteration, modification and/or amendment in this Agreement shall constitute acceptance of such changes without any reservation whatsoever by the “Cardholder”.
Variation of this Agreement. This Agreement may only be varied by written agreement of the parties.
Variation of this Agreement. 14.1 The Bank may vary the terms of this Agreement at any time in such manner as the Bank may select and such changes may be notified to the Cardmember by the Bank either in writing or by publication thereof or by any other means or manner as the Bank may select and such changes so notified will be binding on the Cardmember, effective from the date specified by the Bank.
14.2 If the Cardmember does not accept any such changes, the Cardmember may, within 7 days after the Bank has given such notice, terminate the use of the Card in accordance with Clause12.
14.3 If the Cardmember retains or uses the Card after the Bank has given notice of any changes in this Agreement, the Cardmember is deemed to have accepted and agreed to such changes without reservation.
Variation of this Agreement. 13.1 Either of the Councils may request a variation to this Agreement by making such a request in writing to the Secretary to the Joint Committee.
13.2 The Secretary to the Joint Committee shall circulate the request to each of the Councils within 10 Business Days of receipt of the request for consideration and approval by the Councils.
13.3 If both of the Councils approve the variation then the Secretary to the Joint Committee shall arrange for the preparation of an appropriate Deed of Variation to this Agreement to be prepared for execution by both Councils and such change shall only take effect upon completion of that Deed and the costs associated with the preparation of such Deed of Variation shall be shared equally between the Councils.
13.4 If one of the Councils does not approve the change then the change to this Agreement shall not occur.
Variation of this Agreement. This agreement may, during its term or any further period it continues in force pursuant to section 53 of the ERA, be varied at any time by agreement in writing signed by the authorised representatives of the parties subject to TEU’s ratification process.
Variation of this Agreement. The Company reserves its right to amend the Terms and Conditions of this Agreement at any time. The Company shall notify the Principal Cardholder about these amendments by written notification, through the monthly statements, or in its website or by any other media channels; the Principal Cardholder shall have the right to accept these amendments and continue to use the Cards, or object them within 30 days and terminate the Agreement under the conditions of clause (6) of this Agreement; continuation of using the Card(s) by the Principal or Supplementary Cardholders after the notification shall be conceded as an acceptance of these amendments.
Variation of this Agreement. This Agreement may not be varied unless the variation is effected in writing executed by all of the Parties to this Agreement.
Variation of this Agreement. The terms of this agreement may be reviewed at any time during its currency and changed by the agreement of all the parties. Any changes agreed to must be recorded in writing and attached as a schedule to this agreement. All such changes will form part of this agreement and will supersede any prior provisions affected by such changed terms and shall be ratified in the same manner as was this agreement.
Variation of this Agreement. Any variation to this agreement shall be mutually agreed between the parties and such variation shall be in writing and signed by the parties.
