Examples of Water facilities in a sentence
The Water Facilities are intended to provide adequate water capacity to the District.
Should the City elect to oversize, upsize, or expand any of the Water Facilities constructed by the District beyond the capacity needed for the District and the Out-of-District Property, the City shall be obligated to pay for the costs incurred by the City for such additional capacity above and beyond the amount necessary for the District and the Out-of-District Property.
The City agrees that, from time to time, the City shall, upon reasonable request, issue a letter of assurance to purchasers or prospective purchasers that the District is entitled to the use and benefit of capacity in the City’s water plants (including those which have been constructed and conveyed by the District to the City), provided that this provision shall not be interpreted to alter the District’s obligation to construct all Water Facilities necessary to serve the Tract.
Therefore, the Developers and/or the District shall finance, design, and construct the necessary Water Facilities to serve the District (and, if applicable, the Out-of-District Property, pursuant to the terms of Section 3.09 of this Agreement), which shall be conveyed to the City for ownership and operation when required by Section 3.02 of the Development Agreement.
The Parties acknowledge that the Out-of-District Property is currently located within the corporate limits of Xxxxx Point, Texas and hereby agree that any water supply and distribution services from the Water Facilities to the Out-of-District Property is conditioned upon duly given consent and/or approval by the City of Xxxxx Point, Texas consenting to such service.
