Xxxxxx Leases definition

Xxxxxx Leases means that certain (i) Oil and Gas Lease dated March 6, 1972, from Xxxxxxx X. Xxxxxx and Xxxxxxxx X. Aitken, as Lessors, to GeoResources, Inc., as Lessee, recorded in Book 110m, page 494, real property records, Renville County, North Dakota and (ii) Oil and Gas Lease dated July 17, 1972, from Burlington Northern Inc., as Lessor, to GeoResources, Inc., as Lessee, recorded in Book 112m, page 277, real property records, Renville County, North Dakota.
Xxxxxx Leases is defined in clause (c) of the definition of “Assets.”
Xxxxxx Leases means (i) that certain lease dated May 3, 2005, originally by and between Xxxxx X. Xxxxxx, Xx., as lessor, and Consolidation Coal Company (remote predecessor-in-interest of Coronado IV), as lessee, and (ii) that certain lease dated June 1, 2005, originally by and between X. Xxxxx Xxxxxx, as lessor, and Consolidation Coal Company (remote predecessor-in-interest of Coronado IV), as lessee. “Xxxxxx Leases Partial Assignment” has the meaning set forth in Section 3.2(l). “Hazardous Substance” means, but is not limited to, any solid, liquid, gas, odor, heat, sound, vibration, radiation or other substance or emission that (a) is defined, listed or regulated as hazardous, toxic, a pollutant or a contaminant (or terms of similar regulatory intent and meaning) under applicable Environmental Laws or with respect to which liability or standards of conduct are imposed under any Environmental Laws (including, without limitation, coal and other minerals, coal refuse, run-of-mine coal, acid mine drainage, petroleum or petroleum products ((including crude oil and any fractions thereof)) methane gas, polychlorinated biphenyls, asbestos, pesticides and radioactive substances), or (b) the presence or existence of which shall at any time give rise, under any theory of law or equity, to Environmental Liability. “Indebtedness” means, with respect to any Person, (a) the principal amount, plus any related accrued and unpaid interest, fees and prepayment premiums or penalties, of any Indebtedness or obligation of such Person (i) for borrowed money, (ii) under any credit facility, (iii) evidenced by any note, bond, debenture or other debt security or similar instrument, (iv) under conditional sale

  • Space Leases means any and all leases, subleases, lettings, licenses, concessions, operating agreements, management agreements, and all other agreements affecting the Trust Estate that Trustor has entered into, taken by assignment, taken subject to, or assumed, or has otherwise become bound by, now or in the future, that give any person the right to conduct its business on, or otherwise use, operate or occupy, all or any portion of the Site or Improvements and any leases, agreements or arrangements permitting anyone to enter upon or use any of the Trust Estate to extract or remove natural resources of any kind, together with all amendments, extensions, and renewals of the foregoing entered into in compliance with this Deed of Trust, together with all rental, occupancy, service, maintenance or any other similar agreements pertaining to use or occupation of, or the rendering of services at the Site, the Improvements or any part thereof.

  • Operating Leases means all real or personal property leases under which any Company is bound or obligated as a lessee or sublessee and which, under GAAP, are not required to be capitalized on a balance sheet of such Company; provided that Operating Leases shall not include any such lease under which any Company is also bound as the lessor or sublessor.

  • Real Property Leases means the leases, subleases, licenses or other agreements, including all amendments, extensions, renewals, guaranties or other agreements with respect thereto, under which the Company or any of its Subsidiaries uses or occupies or has the right to use or occupy any real property.
