Ziply Equipment definition

Ziply Equipment means any equipment provided by Ziply Fiber to you, including without limitation wire, cable, cable conduit, splitters, junction boxes, converter boxes (also known as “set top boxes”), decoders, terminals, modems, remote control units, digital video recorders, voice service access units and any other equipment or materials provided to you by Ziply Fiber for use in connection with the Services.

  • Ziply Fiber makes no warranty that the Services will be uninterrupted or error free or that the Ziply Equipment will operate as intended.

  • You agree that Ziply Fiber shall have the right to take anyaction that Ziply Fiber deems appropriate to protect the Services, Ziply Fiber’s network and facilities or the Ziply Equipment.

  • You agree that none of the parties listed in this paragraph shall be responsible for any third-party claims that arise from use of the Services or the Ziply Equipment and you agree to reimburse Ziply Fiber for all costs and expenses related to the defense, settlement or judgment with respect to any such claims.

  • Ziply Fiber will, at its own expense, repair damage to or, at its option, replace Ziply Equipment and otherwise attempt to correct interruptions in the Service that may be due to Ziply Equipment or technical malfunction of the system or network operated by Ziply Fiber.

  • You understand that the Services are being provided only to the location identified on your Work Order and that you are not allowed to transfer all or any portion of the Services, or Ziply Equipment, to any other person, entity or location, including a new residence.

  • X-ray equipment means an x-ray system, subsystem, or component thereof. Types of x-ray equipment are as follows:

  • Stationary x-ray equipment means x-ray equipment which is installed in a fixed location.

  • Capital Equipment means machinery and equipment purchased or leased, and used in this state by the purchaser or lessee primarily for manufacturing, fabricating, mining, or refining tangible personal property to be sold ultimately at retail if the machinery and equipment are essential to the integrated production process of manufacturing, fabricating, mining, or refining. Capital equipment also includes machinery and equipment used primarily to electronically transmit results retrieved by a customer of an online computerized data retrieval system.

  • Standard equipment means the basic configuration of a vehicle which is equipped with all the features that are required under the regulatory acts of the Contracting Party including all features that are fitted without giving rise to any further specifications on configuration or equipment level.

  • Military equipment means weapons, arms, military supplies, and equipment that readily may be used for military purposes, including, but not limited to, radar systems or military-grade transport vehicles; or supplies or services sold or provided directly or indirectly to any force actively participating in armed conflict in Sudan.

  • Portable x-ray equipment means x-ray equipment designed to be hand-carried.

  • Port Cargo Handling Equipment means rubber-tired gantry cranes, straddle carriers, shuttle carriers, and terminal tractors, including yard hostlers and yard tractors that operate within ports.

  • Stationary Play Equipment means equipment such as a climber, slide, swing, merry-go-round, or spring rocker that is meant to stay in one location when a child uses it. Stationary play equipment does not include:

  • Major medical equipment means medical equipment which is used for the provision of medical and other health services and which costs in excess of the capital expenditure minimum, except that such term does not include medical equipment acquired by or on behalf of a clinical laboratory to provide clinical laboratory services if the clinical laboratory is independent of a physician's office and a hospital and it has been determined under Title XVIII of the Social Security Act to meet the requirements of paragraphs (10) and (11) of Section 1861(s) of such Act. In determining whether medical equipment has a value in excess of the capital expenditure minimum, the value of studies, surveys, designs, plans, working drawings, specifications, and other activities essential to the acquisition of such equipment shall be included.

  • Additional Equipment means equipment that is not factory fitted in the Vehicle, including but not limited to navigation equipment (GPS), baby seat, bicycle rack etcetera;

  • Optional equipment means all the features not included in the standard equipment which are fitted to a vehicle under the responsibility of the manufacturer, and that can be ordered by the customer.
