Common use of LIMITATION ON ACTIONS Clause in Contracts

LIMITATION ON ACTIONS. Except with respect to any indemnification obligations in Article 7, above, or as are otherwise set forth in the Individual Contract, any arbitral proceedings in accordance with Article 17 above, arising out of the Individual Contract must be commenced within three years after the cause of action has accrued. The Parties further acknowledge and agree that, for these purposes, a cause of action shall accrue when the breach actually occurs, or, in the case of latent defects, when the injured Party knew or should have known all of the essential elements of the cause of action, or in the case of a breach of warranty, when tender of delivery is made, except that, if a warranty extends to future performance of the goods or any process or system and the discovery of the breach consequently must await the time when such goods or other process or system is ready to perform in accordance with the requirements of the Individual Contract, the cause of action accrues when such time of future performance actually begins. Nothing in or relating to the Individual Contract shall be deemed a waiver, express or implied, of any of the privileges and immunities of the United Nations, including its subsidiary organs. Los consultores serán evaluados Formación Académica : Profesional con Licenciatura en sus aspectos técnicos Ciencias Sociales, Ingenierías, Cooperación Internacional, Ciencias Políticas, Economía o áreas afines, preferiblemente, con estudios especializados. Se requiere de un profesional idóneo con título universitario en Contabilidad, Finanzas, Banca, Administración Pública, Administración de Empresas preferiblemente con grado de maestría. 10 Experiencia General: Experiencia profesional mínima xx xxxx (10) años en las áreas mencionadas. 20 Experiencia Específica:  Profesional con experiencia en lo siguientes temas:  Con experiencia probada de 10 años o más en el manejo y propuesta administración financiera utilizando de Proyectos con financiamiento externo de organismos cooperantes o multilaterales como Banco Mundial, BID, CAF, -AID, JICA etc. Experiencia mínima de cinco (5) años en gestión financiera de proyectos financiados por organismos multilaterales, preferiblemente con el BM.  Experiencia mínima xx xxxx (10) años a nivel en su área que incluye elaboración y seguimiento de presupuestos, pagos a proveedores y consultores, preparación de informes financieros especializados, registros contables. Experiencia en el manejo contable dentro del sector público y/o privado y en relaciones con instituciones financieras internacionales.  Experiencia en establecer controles internos que aseguren la buena ejecución del programa  Experiencia en el manejo y control de Activos Fijos.  Experiencia en Preparación de Informes Semestrales Financieros del Programa.  De preferencia, experiencia en la implementación de la legislación panameña en materia de contabilidad gubernamental, código de trabajo y código fiscal. 40 El consultor presentará una oferta global por el desempeño de las siguientes matrices: CRITERIOS DE EVALUACION PROPUESTA TECNICA PUNTAJE MÁXIMO % CRITERIOS TÉCNICOS REVISIÓN PRELIMINAR: Verificación funciones mencionadas y la entrega de los documentos productos requeridos. La oferta será “todo incluido”, es decir, todos los costos (honorarios profesionales, costos de viaje, estadía, comunicaciones, consumibles, etc.) se deben encontrar incluidos dentro del monto total remitido en la propuesta. El máximo número de puntos se otorgará a la oferta más baja.
