Time of Delivery. Delivery dates are subject to change. Delays or impossibility to deliver due to force majeure do not constitute breach of contract. In such cases of force majeure, including but not limited to strikes, disasters, war or terrorism, criminal acts of third parties, shortages of labour, power or raw materials, official orders and decrees, effects of labour disputes, traffic delays, operational delays or similar delivery impediments, ACAT is entitled to completely or partially withdraw from the contract. The same applies when subcontractors cannot or do not correctly deliver.
Time of Delivery. 3.1 If the Seller expects that he will be unable to deliver the Products at the date agreed for delivery, he must inform the Buyer in due time, in writing, of such occurrence, stating, if possible, the estimated date of delivery. In the event of delay by the Seller, the Client is not entitled to demand a contractual penalty.
Time of Delivery. Delivery terms stated by Hürner Italia shall never be considered as final terms, unless express agreement to the contrary has been made. Claims to compensation for damages resulting from failure to deliver within the specified time are inadmissible. If a delivery date, confirmed by us and not binding, is exceed by more than two month, both contractual partners are entitled only to withdraw from the contract. This right to withdraw does not apply if, within the confirmed period of delivery, readiness for delivery or dispatch is indicated but transport is hindered through no fault of our own. Part deliveries are permissible and may be invoiced separately. If the customer fails to pay until the due date, we shall be entitled to hold back deliveries without being obliged to compensate for any damage that might have arisen.
Time of Delivery. Any delivery dates specified by Seller will be deemed to be estimates only, unless specific commitments are made in writing by Seller. In no event is the time of delivery of the Merchandise of the essence. Seller reserves the right to cancel, in whole or in part, or to suspend or delay, in whole or in part any orders due to (i) the unusually large size of an order (ii) exigencies of Seller’s production or delivery schedule,
Time of Delivery. Due to the nature of the freight forwarding assignment, the Principal acknowledges that the Freight Forwarder cannot guarantee the delivery of goods on a specific time. Any Time indicated into quotations must always be understood as indicative and never peremptory, and in any case always subject to Carriers’ discretionary and technical-organizational choices.
