宿泊約款
１．当宿泊施設が宿泊客との間で締結する宿泊契約及びこれに関連する契約は、本約款の定めるところによるものとし、本約款に定めのない事項については、法令又は一般に確立された慣習によるものとします。
２．当宿泊施設が、法令及び慣習に反しない範囲で特約に応じたときは、前項の規定にかかわらず、その特約が優先するものとします。
当宿泊施設に宿泊契約の申込みをしようとする者は、次の事項を当宿泊施設に申し出て頂きます。
（１）宿泊者名
（２）宿泊日及び到着予定時刻
（３）宿泊料金（原則として別表第１の基本宿泊料による。）
（４）その他当宿泊施設が必要と認める事項
１．宿泊契約は、当宿泊施設が前条の申し込みを承諾したときに成立するものとします。ただし、当宿泊施設が承諾をしなかったことを証明したときは、この限りではありません。
２．宿泊契約の成立後、当宿泊施設の許可のない人数の増員、申込み内容にない施設利用があった場合、実際にかかる費用と事実が判明した時点から、ご利用初日に遡って判明した人数・実際にかかった費用をご請求します。
１．当宿泊施設は、次に掲げる場合において、宿泊契約の締結に応じないことがあります。
（１）宿泊の申し込みが、本約款によらないとき。
（２）満室により客室の余裕がないとき。
（３）宿泊しようとする者が、宿泊に関し、法令の規定、公の秩序若しくは善良の風俗に反する行為をするおそれがあると認められるとき。
（４）宿泊しようとする者が、次のイからハに該当すると認められるとき。
イ 暴力団員による不当な行為の防止等に関する法律（平成３年法律第７７号）第２条第２号に規定する暴力団（以下「暴力団」という。）、同条第２条第６号に規定する暴力団員（以下「暴力団員」という。）、暴力団準構成員又は暴力団関係者その他の反社会的勢力であるとき
ロ 暴力団又は暴力団員が事業活動を支配する法人その他の団体であるときハ 法人でその役員のうちに暴力団員に該当する者があるもの
（５）宿泊しようとする者が、他の宿泊客に著しい迷惑を及ぼす言動をしたとき。
（６）宿泊しようとする者が、伝染病者であると明らかに認められるとき。
（７）宿泊に関し暴力的要求行為が行われ、又は合理的な範囲を超える負担を求められたとき。
（８）天災、施設の故障、その他やむを得ない事由により宿泊させることができないとき。
（９）京都府暴力団排除条例及び鹿児島県暴力団排除条例の規定する場合に該当するとき。
１．宿泊客は、当宿泊施設に申し出て、宿泊契約を解除することができます。
２．当宿泊施設は、宿泊客がその責めに帰すべき事由により宿泊契約の全部又は一部を解除した場合は、別表第２に掲げるところにより、違約金を申し受けます。
３．当宿泊施設は、宿泊客が連絡をしないで、宿泊日当日の午後９時になっても到着しないときは、その宿泊契約は宿泊客により解除されたものとみなし処理することがあります。その際、当宿泊施設は、宿泊客に対して、別表第２に規定された金銭の支払いを求めることがあります。
１．当宿泊施設は、次に掲げる場合においては、宿泊契約を解除することがあります。
（１）宿泊客が宿泊に関し、法令の規定、公の秩序若しくは善良の風俗に反する行為をするおそれがあると認められるとき、又は同行為をしたと認められるとき。
（２）宿泊客が次のイからハに該当すると認められるとき。
イ 暴力団、暴力団員、暴力団準構成員又は暴力団関係者その他の反社会的勢力であるときロ 暴力団又は暴力団員が事業活動を支配する法人その他の団体であるとき
ハ 法人でその役員のうちに暴力団員に該当する者があるもの
（３）宿泊客が他の宿泊客に著しい迷惑を及ぼす言動をしたとき。
（４）宿泊客が伝染病者であると明らかに認められるとき。
（５）宿泊に関し暴力的要求行為が行われ、又は合理的な範囲を超える負担を求められたとき。
（６）天災等不可抗力に起因する事由により宿泊させることができないとき。
（７）京都府暴力団排除条例及び鹿児島県暴力団排除条例の規定する場合に該当するとき。
（８）寝室での寝たばこ、消防用設備等に対するいたずら、その他当宿泊施設が定める利用規則の禁止事項（火災予防上必要なものに限る。）に従わないとき。
２．当宿泊施設が前項の規定に基づいて宿泊契約を解除したときは、宿泊客がいまだ提供を
受けていない宿泊サービス等の料金は頂きません。
３．当宿泊施設が前項の規定に基づいて宿泊契約を解除したとき、明らかにその責が当宿泊施設にある場合を除き、宿泊料金の返還はいたしかねます。
宿泊客は、宿泊日当日において宿泊客が当宿泊施設に入館頂ける時刻（チェックインタイム）までに、宿泊客のスマートフォンまたは当宿泊施設に備え置かれたタブレット端末におい て、次の事項を登録して頂きます。
（１）宿泊客の氏名、メールアドレス、電話番号、郵便番号、住所、顔写真、職業
（２）日本国内に住所を有しない外国人（以下。「外国人」という。）にあっては、国籍、旅券番号、入国地、入国年月日、氏名、メールアドレス、電話番号及びパスポートの写真
（３）出発日及び出発予定時刻
（４）その他当宿泊施設が必要と認める事項
１．宿泊客が当宿泊施設の客室を使用できる時間は、午後３時から翌朝１１時までとします。ただし、宿泊客が、連泊（２日以上連続して宿泊すること）をする場合においては、到着日 及び出発日を除き、終日使用することができます。
２．宿泊客が２泊以上連続して同一の客室に連泊をする場合、当宿泊施設は、当該連泊の間の客室清掃を行いません。ご希望でタオル、バスタオル等の替えをお持ちいたします。この場合、清掃及びベッドメイキングが必要な場合は別途有料（金額については、当宿泊施設インフォメーションに記載のとおりです。）となります。
宿泊客は、当宿泊施設内においては、当宿泊施設が定めて、当宿泊施設内に掲示した利用規則に従って頂きます。
１．当宿泊施設の主な施設等の営業時間は各所の掲示等でご案内いたします。
２．前項の時間は、やむを得ない場合には臨時に変更することがあります。その場合には、適当な方法をもってお知らせします。
１．宿泊者が支払うべき宿泊料金等の内訳は、別表第１に掲げるところによります。
２．前項の宿泊料金等の支払いは、別表第３に掲げるクレジットカードでお願いいたします。原則として現金でのお支払いをお受けしておりませんが、別表第３に掲げるクレットカー
ド以外✰決済方法でもお支払い頂けます。
３．当宿泊施設が宿泊客に客室を提供し、使用が可能になった✰ち、宿泊客が任意に宿泊しなかった場合においても、宿泊料金は発生します。
１．当宿泊施設は、宿泊契約及びこれに関連する契約✰履行に当たり、又はそれら✰不履行により宿泊客に損害を与えたときは、そ✰損害を賠償します。ただし、それが当宿泊施設✰責めに帰すべき事由によるも✰でないときは、こ✰限りではありません。
２．当宿泊施設は、万一✰火災等に対処するため、旅館賠償責任保険に加入しております。
１．当宿泊施設は、宿泊客に契約した客室を提供できないときは、宿泊客✰了解を得て、できる限り同一✰条件による他✰宿泊施設をあっ旋するも✰とします。
２．当宿泊施設は、前項✰規定にかかわらず他✰宿泊施設✰あっ旋ができないときは、違約金相当額✰補償料を宿泊客に支払い、そ✰補償料は損害賠償額に充当します。ただし、客室が提供できないことについて、当宿泊施設✰責めに帰すべき事由がないときは、補償料を支払いません。
宿泊期間中✰宿泊客✰貴重品✰管理は、宿泊客自身で行うも✰とし、紛失、盗難等が発生した場合であっても、当宿泊施設は一切✰責任を負わないも✰とします。
当宿泊施設では寄託物等✰取り扱いは行っておりません。なお、宿泊者が当宿泊施設内に持ち込んだ物品等に関して、滅失、毀損、紛失等✰損害が生じた場合であっても、当宿泊施設は一切✰責任を負わないも✰とします。
宿泊客がチェックアウトした✰ち、宿泊客が、手荷物又は携帯品を当宿泊施設に置き忘れていた場合において、そ✰所有者が判明したときは、当宿泊施設は、当該所有者に連絡をするとともにそ✰指示を求めるも✰とします。ただし、所有者✰指示がない揚合又は所有者が判明しないときは、発見日を含め７日間保管し、そ✰後最寄り✰警察署に届けます。
なお、食品等腐敗するも✰は警察署に届けることなくそ✰場で廃棄いたします。
宿泊客が当宿泊施設✰駐車場をご利用になる場合、「施設利用規則（LUXE TECH VILLA
ASHITOKU）」に従ってご利用ください。車両✰キー✰寄託✰如何にかかわらず、当宿泊施設は場所をお貸しするも✰であって、車両✰管理責任まで負うも✰ではありません。ただし、駐車場✰管理に当たり、当宿泊施設✰故意又は過失によって損害を与えたときは、そ✰賠償
✰責めに任じます。
１．宿泊客✰故意又は過失（指定エリア以外で✰喫煙による火災等を含む）により当宿泊施 設が損害を被ったとき、または備品✰紛失があったときは、当該宿泊客は当宿泊施設に対し、そ✰損害を賠償して頂きます。
２．宿泊客✰故意又は過失により当施設が施設休業となった場合、当該宿泊客は当施設に対し、そ✰損害を賠償して頂きます。
当宿泊施設内✰インターネット✰ネットワークシステム✰ご利用にあたりましては、宿泊客ご自身✰責任にて行うも✰といたします。インターネット✰ネットワークシステム✰ご利用中に、システム障害そ✰他✰理由によりサービスが中断し、そ✰結果、宿泊客がいかなる損害を受けた場合においても、当宿泊施設は一切✰責任を負いません。また、インターネット✰ネットワークシステム✰ご利用に当宿泊施設が不適切と判断した行為により、当宿泊施設及び第三者に損害が生じた場合、そ✰損害を賠償して頂きます。
本約款は、必要に応じて随時改定することができるも✰とします。
本約款は日本法を準拠法とし、本施設へ✰宿泊に関して生じる一切✰紛争については､京都地方裁判所または京都簡易裁判所を第xx✰専属的合意管轄裁判所とします。

② 宿泊契約✰取消しを承る宿泊予約は、公式ホームページや電話による予約、オンライン旅行会社（じゃらん・楽天・一休等）から✰予約とさせて頂きます。
③ 旅行会社（ＪＴＢ、ＪＲ等）や福利厚生サービス、航空券付きプランは対象外となります。直接、各旅行会社へお問い合わせください。
④ 上記予約✰取消しには、欠航証明書等✰ご提出をお願いさせて頂くことがございます。

Terms and Conditions of Accommodation
Article 1 (Scope of Application)
1. Accommodation Contracts and related agreements to be entered into by us with our guests shall be subject to the provisions of these Terms and Conditions, and any matter not stipulated herein shall be governed by the applicable laws and regulations or generally accepted practices.
2. If we enter into a special contract, to the extent that such contract does not violate the applicable laws and regulations and generally accepted practices, the contract shall take precedence, notwithstanding the provisions of the preceding paragraph.
Article 2 (Application for Accommodation Contract)
A person who intends to apply for an Accommodation Contract with us shall notify us of the following matters:
(1) Name(s) of the guest(s);
(2) Date of check-in and estimated time of arrival;
(3) Accommodation charges (The basic accommodation charges set out in Appended Table 1 shall apply, in principle.); and
(4) Other matters deemed necessary by us.
Article 3 (Conclusion of Accommodation Contract, Etc.)
1. An Accommodation Contract shall be deemed to have been concluded when we approve the application referred to in the preceding Article; provided, however, that this shall not apply if it is proven that we did not approve the application.
2. If the number of guests is increased without our permission or facilities that are not specified in the application are used after the Accommodation Contract has been concluded, the charges for the confirmed number of guests and actual expenses will be charged retroactive to the first date of use, at the time such actual expenses and fact become known.
Article 4 (Refusal to Conclude Accommodation Contracts)
1. We may not consent to the conclusion of an Accommodation Contract in any of the following cases:
(1) If the application for accommodation does not conform to these Terms and Conditions;
(2) If the Facilities are fully booked and there are no rooms available;
(3) If the guest seeking accommodation is deemed likely to conduct any act that will violate the applicable laws and regulations or any act against public order and good morals in connection with the accommodation;
(4) If the guest seeking accommodation is deemed to fall under any of the following items a) through c):
a) An organized crime group, as stipulated in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (hereinafter referred to as “Organized Crime Group”), a member of an Organized Crime Group, as stipulated in Article 2, Item 6 of the same Act (hereinafter referred to as “Organized Crime Group Member”), a quasi- member of an Organized Crime Group, a person related to an Organized Crime Group, or any other antisocial forces;
b) A corporation or other organization whose business activities are controlled by an Organized Crime Group or an Organized Crime Group Member; or
c) A corporation any of the officers of which falls under the category of an Organized Crime Group Member;
(5) The guest seeking accommodation is behaving in such a manner as to be a significant annoyance to other guests;
(6) The guest seeking accommodation can clearly be identified as carrying an infectious disease;
(7) The guest seeking accommodation makes a violent demand or requires us to bear an unreasonable burden in connection with the accommodation;
(8) We are unable to provide accommodation due to a natural disaster, failure of facilities, or other unavoidable causes; or
(9) In the event of falling under a case stipulated in the Kyoto Prefectural Ordinance on the Exclusion of Organized Crime Groups and the Kagoshima Prefectural Ordinance on the Exclusion of Organized Crime Groups.
Article 5 (Right of the Guest to Cancel Accommodation Contract)
1. The guest is entitled to cancel the Accommodation Contract by notifying us.
2. If the guest has cancelled the Accommodation Contract in whole or in part due to causes for which the guest is liable, the guest shall pay the cancellation charge listed in Appended Table 2.
3. If the guest does not appear by 9:00 PM on the check-in date without advance notice, we may regard the Accommodation Contract as having been cancelled by the guest. In such case, we may request the guest to pay the amount stipulated in Appended Table 2.
Article 6 (Our Right to Cancel Accommodation Contract)
1. We may cancel the Accommodation Contract in any of the following cases:
(1) If the guest is deemed likely to conduct any act that will violate the applicable laws and regulations or any act against public order and good morals, or is deemed to have conducted such acts, in connection with the accommodation;
(2) If the guest is deemed to fall under any of the following items a) through c):
a) An Organized Crime Group, an Organized Crime Group Member, a quasi-member of an Organized Crime Group, a person related to an Organized Crime Group, or any other antisocial forces;
b) A corporation or other organization whose business activities are controlled by an Organized Crime Group or an Organized Crime Group Member; or
c) A corporation any of the officers of which falls under the category of an Organized Crime Group Member;
(3) The guest is behaving in such a manner as to be a significant annoyance to other guests;
(4) The guest can clearly be identified as carrying an infectious disease;
(5) The guest seeking accommodation makes a violent demand or requires us to bear an unreasonable burden in connection with the accommodation;
(6) We are unable to provide accommodation due to causes resulting from force majeure, such as natural disasters;
(7) In the event of falling under a case stipulated in the Kyoto Prefectural Ordinance on the Exclusion of Organized Crime Groups and the Kagoshima Prefectural Ordinance on the Exclusion of Organized Crime Groups; or
(8) If the guest does not observe the prohibited matters provided under the Rules for Use prescribed by us (limited to those necessary for fire prevention), such as smoking in bed, tampering with fire-fighting equipment, etc.
2. If we cancel the Accommodation Contract in accordance with any provision of the preceding paragraph, we will not charge the guest for the services (such as accommodation services) he/she has yet to receive.
3. If we cancel the Accommodation Contract in accordance with any provision of the preceding paragraph, the accommodation charges may not be refunded unless such cancellation is clearly attributable to us.
Article 7 (Registration for Accommodation)
The guest shall register the following matters using his/her smartphone or the tablet device placed in the Facilities by the time the guest is entitled to enter the Facilities (check-in time) on his/her check- in day:
(1) Name, email address, telephone number, postal code, address, face photo, and occupation of the guest;
(2) In the case of a foreign national who does not have an address in Japan (hereinafter referred to as “Foreign National”), nationality, passport number, port of entry, date of entry, name, email address, telephone number and passport photo;
(3) Date and estimated time of departure; and
(4) Other matters deemed necessary by us.
Article 8 (Guest Room Hours)
1. The guest rooms of the Facilities are available for use by guests from 3:00 PM to 11:00 AM the following day. However, in the case where the guest stays consecutive nights (meaning staying for two consecutive nights or more), the guest may occupy the guest room all day, except on the days of arrival and departure.
2. If the guest stays for two consecutive nights or more in the same guest room, we will not conduct room cleaning during such consecutive stay. We will bring you another face towel, bath towel, etc. if you so request. In this case, if cleaning and bed making are required, they will be conducted at an additional charge (The prices are as stated at our information desk.).
Article 9 (Compliance with Rules for Use)
In the Facilities, the guest shall observe the Rules for Use established by us and posted within the Facilities.
Article 10 (Business Hours)
1. We will notify you of information on the business hours of the main facilities of the Facilities by posting notices in various places.
2. The business hours set forth in the preceding paragraph may be temporarily changed under unavoidable circumstances. In such cases, we will inform you by appropriate means.
Article 11 (Payment of Charges)
1. The breakdown of the accommodation charges, etc. payable by the guest is as shown in Appended Table 1.
2. The accommodation charges, etc. set forth in the preceding paragraph must be paid by credit card, as described in Appended Table 3.
3. Accommodation charges will also be incurred if the guest voluntarily does not stay with us after we have provided a room for him/her and enabled the guest to use the guest room.
Article 12 (Our Responsibility)
1. If we cause any damage to the guest in the performance of, or due to the non-performance of, the Accommodation Contract and/or related agreements, we will compensate the guest for such damage; provided, however, that the foregoing shall not apply if such damage is not due to any cause attributable to us.
2. We have purchased Hotel Liability Insurance to deal with an unexpected fire, etc.
Article 13 (Handling When Contracted Rooms Cannot Be Provided)
1. If we are unable to provide the guest with his/her contracted guest room, with the consent of the guest, we will refer the guest to another accommodation facility so that the guest may stay there on terms and conditions that, to the extent possible, are the same.
2. If, notwithstanding the provision of the preceding paragraph, we cannot refer the guest to another accommodation facility, we will pay the guest a compensation fee equivalent to the cancellation charge and such compensation fee will be appropriated to compensation for damage; provided, however, that we will not pay a compensation fee if the guest room cannot be provided due to causes not attributable to us.
Article 14 (Management of Valuables)
The guest shall take care of his/her valuables during the period of his/her stay; we will not be liable for any loss, theft, etc. thereof.
Article 15 (Acceptance of Deposited Goods, Etc.)
We do not accept deposited goods, etc. In the event of any loss of, or damage to, the goods, etc. brought into the Facilities by the guest, we will not be liable therefor.
Article 16 (Storage of Baggage and Belongings of Guests)
If the guest leaves his/her baggage or belongings behind in the Facilities after check-out and the owner of such baggage or belongings can be identified, we will contact the owner and request his/her instructions; provided, however, that if there is no instruction from the owner or if the owner cannot be identified, they will be stored for seven (7) days, inclusive of the date of discovery, and then taken to the nearest police station.
Things that spoil such as food will be disposed of on the spot without being taken to the police station.
Article 17 (Responsibility for Parking)
The guest shall use the parking lot of the Facilities in accordance with the “Rules for Use of Facilities (Luxe Tech Villa Ashitoku).” We only rent a space to the guest, and we assume no responsibility for the management of the vehicle, regardless of whether the key to the vehicle has been deposited with us; provided, however, that if we cause any damage to the vehicle due to any willful act or negligence on our part in connection with the management of the parking lot, we will compensate the guest therefor.
Article 18 (Liability of the Guest)
1. If we suffer any damage due to a willful act or negligence on the part of the guest (including a fire, etc. caused by smoking outside the designated area) or if there is any loss of fixtures, the relevant guest shall compensate us therefor.
2. If we are forced to close temporarily due to a willful act or negligence on the part of the guest, the relevant guest shall compensate us for such damage.
Article 19 (Exemption from Liability)
The guest shall use the Internet network system within the Facilities at his/her responsibility. We will assume no liability whatsoever for any damage caused to the guest as a result of the interruption of service due to a system failure or other reasons while using the Internet network system. In addition, if we or a third party suffers any damage due to the guest’s taking an action deemed inappropriate by us while using the Internet network system, the guest shall be liable for such damage.
Article 20 (Revision of these Terms and Conditions)
These Terms and Conditions may be revised from time to time as necessary.
Article 21 (Jurisdiction and Governing Law)
These Terms and Conditions of Accommodation are governed by the laws of Japan. The Kyoto District Court or the Kyoto Summary Court shall have exclusive jurisdiction as the court of first instance for any disputes arising in connection with staying in the Facilities.

1. The percentages signify the rate of the cancellation charge applied to the basic accommodation charges.
2. If the number of contracted days is shortened, a cancellation charge for one (1) day (the first day) will be charged without regard to the number of days so shortened.
3. Cancellation due to force majeure such as natural disasters will be handled as follows:
(1) If the airline ticket of the guest becomes subject to refund without charge, or if the guest becomes subject to a flight change (transfer to another flight) or the guest’s ferry to a remote island is cancelled, the guest will be able to cancel the Accommodation Contract without paying any cancellation charge.
(2) Reservations for which we accept cancellation of the Accommodation Contract shall be limited to reservations made on the official website, by phone, or through online travel agencies (Jalan, Rakuten, Ikyu, etc.).
(3) Travel agencies (JTB, JR, etc.), welfare services, and plans with airline tickets are not covered. Please contact each travel agency directly.
(4) In order to cancel a reservation as set forth above, we may ask you to submit a cancellation certificate, etc.
Appended Table 3 [Payment Method (Related to Article 11, Paragraph 2)]

住宿条款
1.本住宿设施与宾客签订的住宿合同及其相关合同应遵循本条款规定，本条款未尽事宜，应按照法律法规或者一般惯例执行。
2.本住宿设施在不违反法律法规及惯例的范围内接受特别约定时，无论xx规定如何，优先适用该特别约定。
拟xx住宿设施申请住宿合同者，需xx住宿设施提供下列事项：
(1) 住宿人员姓名；
(2) 住宿日期和预计到店时间；
(3) 住宿费（原则上按照附表 1 所列基本住宿费执行)；
(4) 其他本住宿设施认为必要的事项。
1.住宿合同xx住宿设施同意前条所述申请后成立。但是，证明本住宿设施未同意的不在此限。
2.住宿合同成立后，未经本住宿设施许可增加人数、使用申请内容xx包含的设施的，本住宿设施从得知实际消费费用和事实时开始，按追溯至使用首日确认的人数和实际花费费用向宾客请款。
1.在下列情形下，本住宿设施可能不同意签订住宿合同：
(1) 住宿申请不符合本条款要求时；
(2) 客房已满，没有xx客房时；
(3) 公认为拟住宿者在住宿方面可能会做出违反法律法规规定和公序良俗的行为时；
(4) 拟住宿者符合下列 a)至 c)项所述情形时：
a) 属于日本《暴力团成员非法行为防止法》（1991 年法律第 77 号）第 2 条第 2 项规定的暴力团（以下简称“暴力团”）、同条第 6 项规定的暴力团成员（以下简称“暴力团成员”）、暴力团准成员或者暴力团相关人员等反社会势力时；
b) 属于经营活动受暴力团或者暴力团成员支配的法人等团体时；
c) 法人的高xx存在属于暴力团成员的人员时；
(5) 拟住宿者的言行明显打扰其他宾客时；
(6) 明确判明拟住宿者属于传染病患者时；
(7) 拟住宿者在住宿方面做出暴力要求行为，或者提出超过合理范围的负担要求时；
(8) 因天灾、设施故障和其他不得已的事由，无法提供住宿时；
(9) 符合《京都府暴力团排除条例》和《鹿儿岛县暴力团排除条例》规定的情形时。
1. 宾客可以xx住宿设施申请解除住宿合同。
2. 因应当归责于宾客的事由解除全部或者部分住宿合同时，本住宿设施将按照附表 2 收取违约金。
3. 在宾客未经联系，在入住当天下午 9 点依然没有到达本住宿设施时，本住宿设施可能会视该住宿合同已被宾客解除并在此基础上进行处理。这种情况下，本住宿设施或会要求宾客支付附表 2 规定的费用。
1. 在下列情形下，本住宿设施或会解除住宿合同：
(1) 公认为宾客在住宿方面有可能做出违反法律法规规定和公序良俗的行为时，或者公认为已经做出上述行为时；
(2) 宾客符合下列 a)至 c)项所述情形时：
a) 属于暴力团、暴力团成员、暴力团准成员或者暴力团相关人员等反社会势力时；
b) 属于经营活动受暴力团或者暴力团成员支配的法人等团体时；
c) 法人的高xx存在属于暴力团成员的人员时；
(3) 宾客的言行明显打扰其他宾客时；
(4) 明确判明宾客属于传染病患者时；
(5) 宾客在住宿方面作出暴力要求行为，或者提出超过合理范围的负担要求时；
(6) 因天灾等不可抗力事由无法提供住宿时；
(7) 符合《京都府暴力团排除条例》和《鹿儿岛县暴力团排除条例》规定的情形时；
(8) 在卧室床上吸烟、滥用消防设备等设备、不遵守其他本住宿设施规定的使用条款的禁止事项（仅限防火所需事项。)时；
2. 本住宿设施按照xx规定解除住宿合同时，不收取宾客xx接受提供的住宿服务等的费用。
3. 本住宿设施按照xx规定解除住宿合同时，除明确属于归责于本住宿设施的情况外，不予退还住宿费。
宾客需在入住当天，在允许宾客进入本住宿设施的时间 (入住时间) 之前，通过宾客的智能手机或者本住宿设施配备的平板电脑终端登记下列事项：
(1) 宾客的姓名、电子邮箱地址、电话号码、邮政编码、地址、肖像、职业；
(2) 在日本国内没有住所的外国人（以下简称“外国人”），登记国籍、护照号码、入境地、
入境日期、姓名、电子邮箱地址、电话号码和护照照片；
(3) 退房日期和计划退房时间；
(4) 其他本住宿设施认为必要的事项。
1. 宾客可使用本住宿设施客房的时间为下午 3 点至次日上午 11 点。但是，宾客连续入住（连续住宿 2 天以上）时，除到店日和退房日以外，可全天使用。
2. 宾客连续 2 晚以上在同一客房住宿时，在该连续住宿期间，本住宿设施不提供客房清洁服务。我们将按照宾客的要求，为宾客更换毛巾和浴巾等物品。这种情况下，如需清洁和整理床铺，需另外收费（金额如本住宿设施信息所列。）。
宾客xx住宿设施内需要遵守本住宿设施规定并张贴xx住宿设施内的使用规则。
1. 本住宿设施的主要设施等的营业时间通过在各处张贴等方式告知。
2. xx所述时间在不得已的情形下或会临时调整。这种情况下，我们会以恰当的方式通知。
1. 宾客应该支付的住宿费等的明细如附表 1 所示。
2. xx所述住宿费等的支付需要按照附表 3 所示，通过信用卡支付。
3. 本住宿设施为宾客提供客房并允许其使用后，即使宾客因个人原因并未入住，也会产生住宿费。
1. 本住宿设施在履行住宿合同及其相关合同时，或者因不履行而给宾客造成损失的，将予以
赔偿。但是，如果该损失并非由于应当归责于本住宿设施的事由引起，则不在此限。
2. 为了应对万一发生的火灾等情况，本住宿设施已投保旅馆赔偿责任保险。
1. 本住宿设施在无法向宾客提供签约客房时，应获得宾客谅解，并尽可能按照相同条件为宾客介绍其他住宿设施。
2. 无论xx规定如何，不能为宾客介绍其他住宿设施时，本住宿设施将向宾客支付与违约金金额相当的补偿费，用于赔偿宾客损失。但是，对于不能提供客房事宜，如果不存在应当归责于本住宿设施的事由，则不支付补偿费。
住宿期间，宾客的贵重物品由宾客自行管理，即使发生丢失、失窃等情况，本住宿设施也概不负责。
本住宿设施不办理物品寄存等处理业务。另外，宾客带入本住宿设施内的物品等发生灭失、毁损、丢失等损失时，本住宿设施概不负责。
宾客退房后，将随身行x或携带物品遗忘xx住宿设施内的，本住宿设施应在查明其所有者后，与该所有者联系并寻求其指示。所有者没有指示的，或者未查明所有者的，本住宿设施将保管
7 天（包括发现日在内），之后送交最近的警察局。
另外，食品等会腐坏的东西将会当场丢弃，不会送交警察局。
宾客使用本住宿设施的停车场时，请遵守《设施使用条款（LUXE TECH VILLA ASHITOKU） 》。无论车辆钥匙是否寄存，本住宿设施均为场所出租方，不承担车辆管理责任。但是，在停车场管理过程中，由于本住宿设施故意或者过失造成损失的，本住宿设施将承担赔偿责任。
1. 因宾客故意或者过失（包括在非指定区域吸烟引起火灾等）导致本住宿设施遭受损失或者备用物品丢失时，该宾客需xx住宿设施赔偿该损失。
2. 因宾客故意或者过失导致本住宿设施的设施停业的，需xx住宿设施赔偿该损失。
使用本住宿设施内的互联网网络系统时，宾客应自行负责。对于宾客在使用互联网网络系统过程中，因系统故障等原因导致服务中断而受到的所有损失，本住宿设施概不负责。此外，本住宿设施判断由于互联网网络系统使用行为不当而给本住宿设施和第三方造成损失的，本住宿设施将就该损失进行索赔。
本条款在必要时可以随时修订。
本条款以日本法律为准据法，入住本设施发生的所有纠纷均以京都地方法院或者京都简易法
院作为一审专属合意管辖法院。

1. 百分比为相对于基本住宿费的违约金比例。
2. 合同天数缩短时，无论缩短天数为几天，收取 1 天（首日）的违约金。
3. 因天灾等不可抗力事由取消入住的，按照下列方式处理：
① 属于机票免费退票、拟搭乘航班变更（改签）对象的宾客以及前往孤岛的渡轮停航 时，免除取消费⽤，并接受取消住宿合同。
② 接受取消住宿合同的住宿预约需通过官网或者电话预约，或者通过在线
旅行社（Jalan、乐天、一休等）预约。
③ 旅行社（JTB、JR 等）、免费服务和送机票优惠方案不属于此范围。请直接向各旅行社咨询。
④ 取消上述预约可能需要提交停航证明等资料。

住宿條款
1. 本住宿設施與住宿房客之間簽訂的住宿合約及其相關合約，皆根據本條款規定之事項，本條款未規定之事項，則依法令或一般已確立之習慣為準。
2. 本住宿設施在不違反法令及習慣的範圍內因應特約時，無論前項規定為何，皆優先遵守該特約。
第 2 條（申請住宿合約）
欲xx住宿設施申請住宿合約者，應xx住宿設施提交以下事項。
(1) 住宿者姓名
(2) 住宿日期及預定抵達時間
(3) 住宿費用（原則上根據附表 1 的基本住宿費用計算）
(4) 其他本住宿設施認為有必要之事項
第 3 條（住宿合約之成立等）
1. 本住宿設施同意前條申請時，住宿合約即成立。但可證明本住宿設施xx同意時，則不在此限。
2. 住宿合約成立後，未經本住宿設施許可發生增加人數、使用申請內容未記載之設施等情況時，從實際發生費用與發現事實的時間點起，將追溯至入住首日，根據發現的人數與實際發生的費用進行請款。
第 4 條（拒絕簽訂住宿合約）
1. 下列情況時，本住宿設施可能不同意簽訂住宿合約。
(1) 未依本條款申請住宿時。
(2) 因客滿而無多餘客房時。
(3) 認定欲住宿者在住宿時，可能從事違反法令規定、公共秩序或善良風俗之行為時。
(4) 認定欲住宿者符合以下 a)～c)之情況時。
a) 為防止犯罪組織成員不當行為等相關法律（1991 年法律第 77 號）第 2 條第 2 號規定之犯罪組織（以下稱「犯罪組織」）、同條第 2 條第 6 號規定之犯罪組織成員（以下稱「犯罪組織成員」）、犯罪組織準成員或犯罪組織相關xx及其他反社會勢力時
b) 為由犯罪組織或犯罪組織成員主導事業活動之法人及其他團體時
c) 如為法人時，其幹部當中包含符合犯罪組織成員定義者
(5) 欲住宿者做出明顯造成其他住宿房客困擾之言行時。
(6) 明顯可認定欲住宿者患有傳染疾病時。
(7) 以暴力要求住宿，或要求超過合理範圍之負擔時。
(8) 因天災、設施故障及其他不得已之事由而無法提供住宿時。
(9) 符合京都府犯罪組織排除條例及鹿xxx犯罪組織排除條例之規定時。
第 5 條（住宿房客的合約解除權）
1. 住宿房客可xx住宿設施提出申請後，解除住宿合約。
2. 住宿房客因可歸責於本身之事由而解除住宿合約之全部或部分時，本住宿設施可根據附表 2 之記載收取違約金。
3. 住宿房客於住宿日當天晚上 9 點仍未抵達，xx聯絡時，本住宿設施將視同住宿房客已解除該住宿合約處理。屆時本住宿設施可能會要求住宿房客支付附表 2 規定之費用。
1. 下列情況時，本住宿設施可能會解除住宿合約。
(1) 認定住宿房者在住宿時，從事或可能從事違反法令規定、公共秩序或善良風俗之行為時。
(2) 認定住宿房客符合以下 a)～c)之情況時。
a) 為犯罪組織、犯罪組織成員、犯罪組織準成員或犯罪組織相關xx及其他反社會勢力時
b) 為由犯罪組織或犯罪組織成員主導事業活動之法人及其他團體時
c) 如為法人時，其幹部當中包含符合犯罪組織成員定義者
(3) 住宿房客做出明顯造成其他住宿房客困擾之言行時。
(4) 可明顯認定住宿房客患有傳染疾病時。
(5) 以暴力要求住宿，或要求超過合理範圍之負擔時。
(6) 因天災等不可抗力之事由而無法提供住宿時。
(7) 符合京都府犯罪組織排除條例及鹿xxx犯罪組織排除條例之規定時。
(8) 在客房床上抽菸、對消防設備等惡作劇，以及未遵守本住宿設施制定之使用規則中的禁止事項（僅限用以防範火災的事項）時。
2. 本住宿設施根據前項規定解除住宿合約時，不會收取住宿房客xx接受提供的住宿服務等之費用。
3. 本住宿設施根據前項規定解除住宿合約時，除了明顯可歸責於本住宿設施的情況以外，恕不退還住宿費用。
第 7 條（登記住宿）
住宿房客必須在住宿日當天，在住宿房客可進入本住宿設施的期間（入住時間）內，透過智慧型手機或本住宿設施內放置的平板電腦登記以下事項。
(1) 住宿房客的姓名、電子郵件位址、電話號碼、郵遞區號、地址、正面照片及職業
(2) 若是在日本國內無住處的外籍xx（以下稱「外籍xx」），則為國籍、護照編號、入境
地、入境日期、姓名、電子郵件位址、電話號碼及護照照片
(3) 退房日期及預定退房時間
(4) 其他本住宿設施認為有必要之事項
第 8 條（客房使用時間）
1. 住宿房客可使用本住宿設施客房的時間為下午 3 點至隔天早上 11 點。但住宿房客連續住宿
（連續住宿 2 天以上）時，除了入住xxx退房當天以外，全天皆可使用。
2. 住宿房客連續 2 晚住宿在同一間客房時，本住宿設施在其連續住宿期間，不會打掃客房。如有需要時，可提供替換的毛巾及浴巾等。於此情況，如需打掃或整理床鋪，將會另行收費（金額如本住宿設施使用說明的記載內容所示）。
住宿房客於本住宿設施內，須xx住宿設施制定，並公告於本住宿設施內的使用規則。
第 10 條（營業時間）
1. 本住宿設施的主要設施等之營業時間，如各處設施的公告內容等所示。
2. 前項時間可能會因不得已之事由而臨時變更。屆時會透過適當方法通知。
1. 住宿房客應支付的住宿費用等明細如附表 1 記載內容所示。
2. 前項住宿費用等應根據附表 3 之規定，使用信用卡支付。
3. 本住宿設施已向住宿房客提供客房，且可供客房使用後，即使住宿房客任意未住宿時，仍會發生住宿費用。
1. 本住宿設施因履行或未履行住宿合約及其相關合約，而使住宿房客蒙受損害時，將會賠償該損害。惟起因於不可歸責於本住宿設施之事由時，則不在此限。
2. 本住宿設施為了因應萬一發生火災等之情況，已投保旅館賠償責任險。
第 13 條（已簽約之客房無法提供時的處理）
1. 本住宿設施無法向住宿房客提供已簽約之客房時，在取得住宿房客理解後，會盡可能以相同條件代為與其他住宿設施斡旋。
2. 無論前項規定為何，xx住宿設施無法代為與其他住宿設施斡旋時，會向住宿房客支付與違約金相當金額的補償金，以該補償金抵償損害賠償金。惟起因於不可歸責於本住宿設施之事由而無法提供客房時，則不會支付補償金。
住宿期間，住宿房客應自行妥善管理貴重物品，如發生遺失、遭竊等情況，恕本住宿設施概不
負任何責任。
第 15 條（寄放物品等之處理）
本住宿設施不提供寄放物品等服務。此外，住宿房客帶進本住宿設施內的物品等如發生滅失、
損毀或遺失等損害時，恕本住宿設施概不負任何責任。
第 16 條（住宿房客的行李或攜帶物品之保管）
住宿房客在退房後，如將行x或攜帶物品遺留xx住宿設施時，本住宿設施會在查明持有者後，聯絡該持有者徵求指示。但，持有者未指示或無法查明持有者時，則會自發現當天起保管 7 天， 之後送交至最近的警察局。
另外，如為食品等會腐敗的物品，無法送交至警察局時，則會當場廢棄。
住宿房客使用本住宿設施的停車場時，請遵守「設施使用規則（LUXE TECH VILLA ASHITOKU）」的規定。無論是否有寄放車輛鑰匙，本住宿設施僅提供場所，並不負車輛管理責任。但在管理停車場時，因本住宿設施之故意或過失而造成損害時，則會負責賠償該損害。
第 18 條（住宿房客之責任）
1. 因住宿房客之故意或過失（含在指定區域以外的地方抽菸而引發火災等）而導致本住宿設施蒙受損害時，或備品遺失時，本住宿設施會要求該住宿房客賠償該損害。
2. 因住宿房客之故意或過失而導致本設施暫停營業時，該住宿房客須xx設施賠償該損害。
使用本住宿設施內的網路系統時，住宿房客應自行負起使用責任。使用網路系統的期間，如因系統故障及其他理由而中斷網路服務時，即使因此導致住宿房客蒙受損害，恕本住宿設施概不負任何責任。此外，使用網路系統時，因從事本住宿設施判斷不恰當之行為，而導致本住宿設施及第三人蒙受損害時，須賠償該損害。
第 20 條（本條款之修訂）
本住宿設施可視必要隨時修訂本條款。
第 21 條（管轄及準據法律）
本條款以日本法律作為準據，入住本設施所衍生之一切紛爭，以京都地方法院或京都簡易法院
作為第xx專屬合意的管轄法院。

3. 因天災等不可抗力之事由而取消住宿時，處理方式如下所示。
① 用機票全額退費或變更預約航班（替補）規定的住宿房客，因開往離島的渡輪停駛時，本住宿設施同意取消住宿合約，並免收取消費用。
② 同意取消住宿合約的住宿訂房僅限透過官網、電話或線上旅行社（Jalan、樂天、一休等）的訂房。
③ 行社（JTB、JR 等）、福利招待及搭配機票的方案不適用。敬請直接洽詢各旅行社。
④ 遇上述取消訂房之情況，請提供停駛證明等。
