All possible If disputes, even by means of guarantee and even in the case of plurality of defendants must be submitted to the exclusive jurisdiction of the Courts of the district of Antwerp, Belgium IF THE CARRIAGE INVOLVES AN ULTIMATE DESTINATION OR STOP IN A COUNTRY OTHER THAN THE COUNTRY OF DEPARTURE, THE WARSAW CONVENTION OR MONTREAL CONVENTION MAY BE APPLICABLE AND IN MOST CASES LIMIT THE LIABILITY OF THE CARRIER IN RESPECT OF LOSS OF, DAMAGE OR DELAY TO CARGO. DEPENDING ON THE APPLICABLE REGIME, AND UNLESS A HIGHER VALUE IS DECLARED, LIABILITY OF THE CARRIER MAY BE LIMITED TO 17 SPECIAL DRAWING RIGHTS PER KILOGRAM OR 250 FRENCH GOLD FRANCS PER KILOGRAM, CONVERTED INTO NATIONAL CURRENCY UNDER APPLICABLE LAW. CARRIER WILL TREAT 250 FRENCH GOLD FRANCS TO BE THE CONVERSION EQUIVALENT OF 17 SPECIAL DRAWING RIGHTS UNLESS A GREATER AMOUNT IS SPECIFIED IN THE CARRIER’S CONDITIONS OF CARRIAGE.
1. In this contract and the Notices appearing hereon: CONDITIONS OF CONTRACT
Jurisdiction. The Courts of Brussels, Belgium are to have jurisdiction to settle any disputes that may arise out of or in connection with the Agency Agreement, the Calculation Agency Agreement and the Bonds and accordingly any legal action or proceedings arising out of or in connection with any Bonds ("Proceedings") may be brought in such courts. The Issuer and the Guarantor irrevocably submit to the jurisdiction of the courts of Brussels, Belgium. This submission is made for the benefit of each of the holders of the Bonds and shall not affect the right of any of them to take Proceedings in any other court of competent jurisdiction nor shall the taking of Proceedings in one or more jurisdictions preclude the taking of Proceedings in any other jurisdiction (whether concurrently or not). Notwithstanding the foregoing, the Courts of Brussels, Belgium have exclusive jurisdiction over matters concerning the validity of decisions of the board of directors of the Issuer and the Guarantor, or the general meeting of the shareholders of the Issuer and the Guarantor, or the general meeting of Bondholders.
