02D. If the Bank, following a request by the Borrower, has provided the Borrower, before the submission of the Disbursement Request, with a non-binding fixed interest rate or spread quotation to be applicable to the Tranche, the Borrower may also at its discretion specify in the Disbursement Request such quotation, that is to say:
02D. In addition to the amendments otherwise authorized herein, amendments may be made to this Agreement from time to time by the General Partner with the Consent of the holders of a majority of the Units provided, however, that without the Consent of all Partners, this Agreement may not be amended so as to (i) convert the Interest of a Limited Partner into a general partner's Interest; (ii) modify the limited liability of a Limited Partner; (iii) alter the Interest of a Partner in Net Profits, Net Losses, or Gain or Loss or distributions of Cash Available for Distribution, Sale Proceeds, Refinancing Proceeds or reduce the percentage of Partners which is required to Consent to any action hereunder; (iv) modify the liability of the General Partner as provided in Section 3.08; (v) permit the General Partner to take any action prohibited by Section 5.02; (vi) cause the Partnership to be treated for Federal income tax purposes as an association taxable as a corporation; or (vii) effect any amendment or modification to this Section 11.02B.
02D. Section 5.02(d) is hereby deleted in its entirety and replaced in full as follows:
02D. In no event shall the provisions of this Paragraph 3.02 reduce the Base Rent specified in Paragraph 1.01D.

02D. The Employer will provide the Union with the formula and any changes in the formula to calculate part-time hours into full time seniority date. Each time a part-time employee is awarded a permanent full-time position the Employer will provide the Union with a summary of the hours worked since the date of the last seniority list. If that summary is not challenged within 30 calendar days it shall be deemed correct.

Existing single-family detached and attached dwellings are in the Medium-Density and Medium High-Density Residential developments to the west and north and existing Residential Estate lots (R1) in Ada County consisting of detached dwellings are located within the surrounding area. City water and sewer service is available and can be extended by the developer with development in accord with UDC 11-3A-21.
