Post-termination monitoring will be required for a minimum of ten years after the earlier of these two dates with cessation subject to DNRE approval. The PZ monitoring xxxxx are not subject to cessation of monitoring under this provision and must continue to be monitored so long as 1,4-dioxane continues to be detected in PZ monitoring xxxxx above 85 ppb, (subject to approval by the Court of the application of a new criteria). PLS may initiate dispute resolution pursuant to Section XVI of the Consent Judgment if the DNRE refues to approve PLS’ termination request.
