AGE AND STRS ELIGIBILITY FOR BENEFITS a. A bargaining unit member will be eligible to participate in the Plan provided the member begins an STRS service retirement no sooner than the end of the school year and no later than September 1 following the contract year in which the member first reaches 33 years of STRS service credit (or 32 years of STRS service credit for retirement dates from August 1, 2017 through July 1, 2019); or b. Inasmuch as some members start their careers later in life than others, these members may not be able to amass 33 years of STRS service credit (or 32 years of STRS service credit for retirement dates from August 1, 2017 through July 1, 2019). Such members shall be eligible to participate in the Plan provided they begin an STRS service retirement no sooner than the end of the school year and no later than September 1 following the contract year in which one of the following eligibility levels is met, whichever occurs first: (1) The member first reaches 55 years of age with 28 years of service (or 55 years of age with 27 years of STRS service credit for retirement dates from August 1, 2017 through July 1, 2019) prior to 12:01 a.m. on the first full teacher workday of the following contract year or first reaches 28 years of service at or over the age of 55 (or 55 years of age with 27 years of STRS service credit for retirement dates from August 1, 2017 through July 1, 2019). (2) The member first reaches 60 years of age (or turns 61 between June 1 and August 31 of the current contract year) and has at least five years of STRS service credit with at least 5 years of STRS service credit but less than 28 years of STRS service credit (or 27 years of STRS service credit for retirement dates from August 1, 2017 through July 1, 2019). A member’s failure to participate under (1) or (2) will not disqualify them from the Plan provided they retire when they first reach 33 years of STRS service credit (or 32 years of STRS service credit for retirement dates from August 1, 2017 through July 1, 2019).

Inasmuch as some members start their careers later in life than others, these members shall be eligible to participate in the Plan provided they begin a retirement system service retirement no sooner than the end of the school year and no later than July 1 following the contract year in which the member first reaches 25 years of retirement system service credit and 10 years of service in the district. If a member first reaches 10 years of service in the district at a time when s/he has less than 25 years of retirement system service credit or if a member first reaches 25 years of retirement system service credit at a time when s/he has less than 10 years of service in the district, the member will not be eligible to participate in Incentive Plan b. at either of those times but will be eligible only when the member first reaches 25 years of retirement system service credit and has 10 or more years of service in the district or when the member first reaches 10 years of service in the district and has 25 or more years of retirement system service credit. However, Incentive Plan b. shall not be available to a member who first reaches 10 years of service in the district on or after reaching their 31st year of retirement system service credit. c. A member’s failure to participate in the Incentive Plan in b. above will not disqualify them from later participating in the Incentive Plan in a. above. d. The Incentive Plan in a. above expires on July 2, 2026 and will no longer be available to members who retire on or after July 2, 2026.

  • Eligibility for Benefits 1. Sick Leave Bank benefits are available only when the member personally has a severe medical hardship (catastrophic illness or serious accident). 2. Benefits can be received only after all accumulated sick leave and vacation days have been exhausted. 3. Any member receiving Worker's Compensation or disability benefits shall not be eligible to receive benefits from the Sick Leave Bank. 4. A member who is on leave of absence, suspended, or terminated from the Xxxxxxx County Board of Education shall not be eligible for Sick Leave Bank benefits. 5. The form, entitled "Request For Sick Leave Benefits" and physician's statement are required before the SLB Review Committee will consider a request for benefits. The physician's statement shall include a history of the illness, date the illness began, a diagnosis and prognosis, and any other related information. 6. Approval by the Sick Leave Bank Review Committee is required prior to the receiving of benefits. 7. Normal pregnancies, childbirth, childcare, or child adoption shall not be considered as eligible reasons for Sick Leave Bank benefits. 8. A four (4)-member Sick Leave Bank Review Committee, consisting of two (2) members appointed by the President of the Association and two (2) appointed by the Superintendent, shall have the responsibility of receiving requests, verifying the validity of requests and approval or denial of requests. Any approval of a request must have the support of at least three (3) members of the committee Sick Leave Bank Review Committee. The Sick Leave Bank Review Committee shall develop its rules of procedure and shall give wide distribution to said rules upon approval of the President of the Association and the Superintendent.

  • Maintaining Eligibility for Employer Contribution The employer's contribution continues as long as the employee remains on the payroll in an insurance eligible position. Employees who complete their regular school year assignment shall receive coverage through August 31.

  • Benefit Eligibility For purposes of the Benefit Plan entitlement, common-law and same sex relationships will apply as defined.

  • Eligibility for Severance Benefits The Company or its successor shall pay or provide to the Executive the Severance Benefits if the Executive has a Separation from Service and his employment is terminated voluntarily or involuntarily during the term of this Agreement, either: (a) by the Company (1) at any time within 24 months after a Change in Control of the Company, or (2) at any time prior to a Change in Control but after the commencement of any discussions with a third party relating to a possible Change in Control of the Company involving such third party, if such termination is in contemplation of such possible Change in Control and such Change in Control is actually consummated within 12 months after the date of such termination, in either case unless the termination is on account of the Executive’s death or Disability or for Cause, provided that, in the case of a termination on account of the Executive’s Disability or for Cause, the Company shall give Notice of Termination to the Executive with respect thereto; or (b) by the Executive for Good Reason (1) at any time within 24 months after a Change in Control of the Company or (2) at any time after the commencement of any discussions with a third party relating to a possible Change in Control of the Company involving such third party, if such Change in Control is actually consummated within 12 months after the date of such termination, and, in any such case, provided that the Executive shall give Notice of Termination to the Company with respect thereto. For purposes of clarity, with respect to Section 3 above, an Executive who is collecting Disability benefits will not be eligible for benefits under this Agreement. An Executive who is no longer Disabled will be eligible for benefits under this Agreement if, in the period extending from 12 months before the Change in Control to 24 months after the Change in Control, either of the following occur: (1) the Executive attempts to return to his or her position, and no such position is available, or (2) the Executive returns to employment and is subsequently terminated pursuant to Section 3(a) or Section 3(b) above.

  • Probation for Newly Hired Employees (a) The Employer may reject a probationary employee for just cause. A rejection during probation shall not be considered a dismissal for the purpose of Article 11.2

  • Long Term Disability Benefits A benefit level of seventy percent (70%) of monthly earnings shall apply. Benefits would commence after a waiting period of seventeen (17) weeks, when Short Term Disability Benefits terminate. Terms of the Master Policy with the Insurance Company shall apply. In order to go on LTD, the person must: (a) Be off work for seventeen (17) consecutive weeks with the same or unrelated illness or injury. (b) Be off work for a total of seventeen (17) weeks with the same illness or injury providing that the return to work was less than twenty (20) consecutive days.

  • Employee Eligibility For purposes of this section, “eligible employee” shall be defined by the Public Employees’ Medical and Hospital Care Act.
