Common use of Agency Head or Designee Clause in Contracts

Agency Head or Designee. If the grievance is not resolved at Step 1, the Union may move it to Step 2 by filing the written grievance with the Agency Head, with a copy to the Human Resources Office, within fifteen (15) days of the Union’s receipt of the Step 1 decision. Upon agreement of the parties, the Agency Head or designee will meet or confer by telephone with a Union xxxxxxx and/or staff representative and the grievant within fifteen (15) days of receipt of the Step 1 decision. Management will provide a written response to the Union within fifteen (15) days after the meeting and if the remedies are denied the response will include an explanation. Step 3: Mediation of Pre-Arbitration Review Meeting: If the grievance is not resolved at Step 2, the Union may either file a request for mediation with Public Employment Relations Commission (PERC) or file a demand for arbitration with a copy of the grievance and all responses attached.
