Agreement to Conditions. I acknowledge and agree to the following conditions:
(a) this City’s Parks staff will work with me to select an appropriate species and location for the Tree. Since not all City properties or tree species are suitable for the Commemorative Tree Program, the City will have the right to make the final decision as to species and location;
(b) the Tree will be either a deciduous tree with a minimum diameter of 60 mm. (2.5 inches) or a conifer tree that is at least 1.8 metre (6 feet) high;
(c) after the final decision has been made as to species and location, the Tree will be planted to the City’s standards and specifications;
(d) no Tree will be planted until the City has received payment in full of My Donation;
(e) if I require a plaque, it will be by separate agreement. However, I understand that not all sites are suitable for plaques;
(f) planting of the Tree will take place in the Spring or Fall planting season, depending upon when My Donation is received and when the final decision as to species and location is made;
(g) I understand that the tree becomes city property once it is installed;
(h) the placement of memorial wreaths, flowers or any other item in the vicinity of the Tree is prohibited;
(i) the City will maintain the Tree in the same manner as other trees in City parks;
(j) if the Tree needs to be replaced for any reason within five (5) years of its planting, the City will replace the Tree once after the two (2) year nursery warranty. Further replacements will be at the discretion of the City;
(k) the City will have the right to relocate the Tree is such relocation becomes necessary due to vandalism or any other circumstance. Where possible, the tree will be relocated within the same City property. Prior to any relocation, the City will attempt to contact me at the most recent address on file with the City. It is my responsibility to notify the City of any change to my address;
(l) if any part of My Donation is not needed to purchase, plant, maintain, replace or relocate the Tree as contemplated by this Agreement, the balance shall be used to provide and maintain other trees in City parks.
Agreement to Conditions. The Exhibitor, for itself and its employees and agents, agrees to abide by the conditions stated herein, it being understood and agreed that the sole control of the exhibit hall rests with CCWC.
Agreement to Conditions. Vendor, for itself and its employees, agrees to abide by these terms and conditions and agrees that the sole and final authority over the event shall belong to LSCS.
Agreement to Conditions. 2.1 A fee of £75,000 is payable on the date of this letter.
2.2 If the Company countersigns this letter in the space indicated to accept the terms of this letter then the Company will be deemed to make the representation and warranty set out in paragraph 1.3(b).
2.3 Each Guarantor confirms by signing this letter in the space indicated that its guarantee under the Facility Agreement is not affected by, and continues in full force and effect notwithstanding, the extension of the facilities to the Extended Final Repayment Date.
Agreement to Conditions. The Exhibitor/Sponsor, for itself and its employees and agents, agrees to abide by the conditions stated herein, it being understood and agreed that sole control of the exhibit hall rests with NACHC.
Agreement to Conditions. Each Vendor, for itself and its employees and agents, agrees to abide by these terms and conditions, and any other terms and conditions the Council may impose from time to time, it being understood and agreed that the sole control of the exhibit area and conference rests with the Council and its designated general service contractor.
Agreement to Conditions. I acknowledge and agree to the following conditions:
(a) this Plaque will accompany a Bench or Tree I have donated under a separate agreement;
(b) each Plaque shall be oval in shape, made of cast bronze metal, with approximate dimensions of 6 inches (15 centimetres) by 4 inches (10 centimetres) and raised lettering, as illustrated in the attached sample sketch and initialled by me;
(c) I will inform City staff of the name I wish to be engraved on each Plaque;
(d) no Plaque will be purchased until the City has received My Payment in full;
(e) in addition to the cost of the Plaque, My Payment includes the costs of engraving, installation, upkeep and maintenance of the Plaque and, if required, one replacement, together with applicable taxes. Further replacements of the Plaque will be at my option and cost;
(f) installation of each Plaque will take place between April 15th and November 15th;
(g) the placement of memorial wreaths, flowers or any other item in the vicinity of any Plaque is prohibited;
(h) the City will maintain each Plaque in the same manner as other plaques in City parks;
(i) the City will have the right to relocate or remove a Plaque if necessary due to vandalism or any other circumstance. Where possible, a Plaque will be relocated with the same City property. Prior to any relocation or removal, the City will attempt to contact me at the most recent address on file with the City. It is my responsibility to notify the City of any change to my address;
(j) if any part of My Payment is not needed to purchase, engrave, install, maintain, replace or relocate Plaques purchased under this Agreement, the balance shall be used to provide and maintain trees and benches in City parks.
