Agreement to Prevail. (a) Notwithstanding the other provisions of this Section 10, in the event of any conflict between the duties and authority of the Joint Coordinating Committee set out in this Section 10 (or any decision of the Joint Coordinating Committee made pursuant thereto) and any other provision of this Agreement, such other provision of this Agreement shall prevail (and the duties and authority of the Joint Coordinating Committee shall be limited accordingly).
(b) It is also agreed that, unless otherwise agreed by the Parties, the Joint Coordinating Committee shall only make decisions or determinations that are expressly provided for in Section 10 of this Agreement.
Agreement to Prevail. 10.1. In the event of any inconsistency between any provisions of this Agreement and the articles of association of the Company or any other document, contract, arrangement, deed and/or agreement – whether verbal or in writing and whether or not between Founders/shareholders/participants/investors excluding SBC and SBC Global - this Agreement shall prevail.
10.2. This Agreement (including the annexes, exhibits and schedules) contains the entire agreement between the Parties pertaining to the subject matter hereof and fully supersede (1) all prior written or oral agreements and understandings between the Parties pertaining to such subject matter and/or (2) all prior shareholders agreements of the Company.
Agreement to Prevail. To the extent of any discrepancy or inconsistency between the terms and conditions of this Agreement and the Subscription Receipt Certificate, the terms of this Agreement will prevail.
Agreement to Prevail. 10.1. In the event of any inconsistency between any provisions of this Agreement and the articles of association of the Company or any other document, contract, arrangement, deed and/or agreement – whether verbal or in writing and whether or not between Founders/shareholders/participants/investors excluding SBC - this Agreement shall prevail and each Shareholder shall take all such further steps as may be necessary or requisite to ensure that the provisions of this Agreement shall prevail. If necessary, the Shareholders shall resolve to amend the articles of association of the Company in accordance with this Agreement.
10.2. This Agreement (including the annexes, exhibits and schedules) contains the entire agreement between the Parties pertaining to the subject matter hereof and fully supersede (1) all prior written or oral agreements and understandings between the Parties pertaining to such subject matter and/or (2) all prior shareholders agreements of the Company (unless specifically approved in writing by SBC).
Agreement to Prevail. Where there is any inconsistency or conflict between any federal, territorial and local government laws, and the Agreement, the Agreement shall prevail to the extent of the inconsistency or conflict.
Agreement to Prevail. If any provision of the Memorandum or the Articles at any time conflicts with any provision of this Agreement then, to the extent permitted by Indian law, as between the Parties the provisions of this Agreement shall prevail.
Agreement to Prevail. If there shall be any conflict or inconsistencies between the provision of this Agreement and provision of the Articles, the provisions of this Agreement shall prevail. The Shareholders shall take such steps as are necessary to amend the Articles to reflect (in so far as they shall reasonably and mutually determine is necessary) or otherwise bring into effect of the provisions of the Agreement as referred in Clause 3.2 of this Agreement.

In the event of any inconsistency between any provisions of this Agreement and the articles of association of the Company or any other document, contract, arrangement, deed and/or agreement – whether verbal or in writing and whether or not between Founders/shareholders/participants/investors excluding SBC and SBC Global - this Agreement shall prevail.
Agreement to Prevail. In the event of any ambiguity or conflict arising between the terms of this Agreement and those of the Articles, the terms of this Agreement shall prevail.
Agreement to Prevail. Without prejudice to the generality hereinafter referred to under clause no. 24 , and the Founder Group agree that if any provisions of the Charter Documents of at any time conflict with any provisions of this Agreement, the provisions of this Agreement shall prevail, subject to applicable Law, and and the Founder Group shall exercise all powers and rights available to them to procure the amendment of the Charter Documents to the extent necessary to give effect to the provisions of this Agreement provided that such provision of the Agreement or such amendment does not breach any applicable Law.
