Common use of Appeal of Discharge or Discipline Clause in Contracts

Appeal of Discharge or Discipline. Should the discharged or disciplined Employee or the Xxxxxxx consider the discharge to be improper, a complaint shall be presented in writing through the Xxxxxxx to the Employer within five (5) regularly scheduled working days of the discharge or discipline. The Superintendent will review the discharge or discipline and give its answer within five (5) regularly scheduled working days after receiving the complaint. If the decision is not satisfactory to the Union, the matter shall be referred to the Level Three grievance procedure. Use the Past Record. In imposing any discipline on a current charge, the Employer will not take into account any prior infractions which occurred more than two (2) years previously. After the contract year 1985-86, the employer will not take into account any prior infractions which occurred more than three (3) years previously. This Article only applies to non-probationary employees.
