APPOINTMENTS, PROMOTIONS, TRANSFERS AND VACANCIES. 33.01 In filling a new position or a vacancy, appointments shall be made on the basis of the qualifications and seniority of the applicants. The qualifications for the new position or vacancy shall be consistent with the responsibilities specified in the position profile. Qualifications may include job related skills, training, and knowledge provided these qualifications are specified in the job posting. 33.02 When a new position is created or when a vacancy occurs in any classification covered by this Collective Agreement, such position or vacancy shall be posted on the appropriate form and electronically on the Employer’s intranet for seven (7) calendar days as a general posting throughout the organization, stating the responsibilities and qualifications, location (Department, work site), existing shift schedule and Basic Rate of Pay for the position and to whom applications should be submitted. 33.03 Requests for transfer or applications for vacancies shall be in writing according to the procedures established in the work site by the Employer. Facilities will be provided to accept applications for posted positions at any time within the seven (7) calendar day posting period. (a) When making promotions and transfers and filling vacancies within the Bargaining Unit, the determining factors shall be the most requisite job related skills, training, knowledge, acceptable performance and other relevant attributes and where these factors are considered by the Employer to be equal and satisfactory, seniority will be the deciding factor. (b) Regular Employees in the Bargaining Unit shall be given preference over other applicants. 33.05 When a vacancy is posted and circumstances require the Employer to fill a vacancy before the expiration of the seven (7) calendar day posting period, or prior to the availability of a qualified applicant, the appointment shall be made on a temporary basis only. The Employer shall fill such vacant position on a permanent basis as soon as a qualified applicant becomes available. (a) A copy of all postings shall be forwarded to the designated Officer of the Union, and when the appointment has been made, the designated Officer will be notified of the appointee's name and the Department concerned. (b) The Employer shall post the name of the successful candidate and the competition number on the posting board within seven (7) days of the appointment. The successful candidate will be informed in writing of the details of the competition they are successful in obtaining. (a) Transfers and promotions shall be on a trial basis. The transferred or promoted Employee will be given a trial period of three hundred forty-eight point seven five (348.75) regular hours worked, in which to demonstrate the ability to fill the new position satisfactorily. The trial period may be extended by the number of working hours absent for any reason during the trial period. (b) During the Trial Period, the Employee may either: (i) be returned by the Employer to the Employee’s former position; or (ii) return to her former position provided it is still vacant. In circumstances where returning to her former position is no longer possible, the Employer shall place the Employee in another suitable vacant position within the Employee’s current Centre without loss of seniority and at a rate of pay equivalent to that of her former position. (c) An Employee who is transferred before completing her initial probationary period shall complete the initial probationary period as well as the trial period in Article 11.06(a) above. (d) In the event that an Employee returns to her former position pursuant to Article 33.07(b), the Employer shall have one (1) opportunity to fill the resultant vacancy by selecting from the applicants on the original posting. Should the Employer exercise this right the posting provisions of this Article will be deemed to be satisfied. 33.08 The foregoing provisions shall be waived and inoperative when placement of an Employee in a job within the Bargaining Unit is effected to provide a period of Rehabilitative Work. 33.09 A Regular Employee who applies for and is successful on a Temporary posting shall maintain their status as a Regular Employee. A Casual Employee who applies for and is successful for a Temporary position shall receive all entitlements and benefits applicable to a Temporary Employee. At the completion of the Temporary term, the Regular Employee shall return to their former position. At the completion of the Temporary term, the Casual Employee shall resume the normal terms and conditions of employment applicable to a Casual Employee. (a) When an Employee is assigned by their immediate Supervisor to replace another Employee in a higher paid classification within this Collective Agreement for a full or partial shift of at least two (2) hours or longer, the Employee shall be placed at the pay step in the higher classification that provides for an increase above her current Basic Rate of Pay. (b) When an Employee is required to perform the duties of a lower paid classification, her Basic Rate of Pay will not be changed. (c) When a Regular Employee agrees to substitute on another position outside of this Collective Agreement, the Regular Employee will receive, in addition to the Employee’s Basic Rate of Pay, an amount commensurate with the additional responsibilities.

(a) When making promotions Successful applicants that are transferring from within Covenant Health CUPE Locals shall transfer their accrued seniority and transfers pension entitlements, vacation entitlement date, unused vacation up to a maximum of one (1) years' entitlement plus five (5) days and filling vacancies within the Bargaining Unit, the determining factors accrued sick leave. A Casual Employee who applies for and is successful for a Temporary position shall receive all entitlements vacancy in the same classification, Full-Time Equivalency (FTE), Department/Program, and benefits applicable to a Temporary Employee. At the completion of the Temporary termsite, the Regular Employee shall return Employer may offer the position to their former position. At an applicant from the completion of initial posting in accordance with Clause 33.04, rather than post the Temporary term, the Casual Employee shall resume the normal terms and conditions of employment applicable to a Casual Employeevacancy.

(c) When 33.10 Provided that the Employee's Supervisor has granted approval, a Regular Employee agrees who is the successful applicant for a temporary position within the bargaining unit shall; be deemed to substitute be on another temporary assignment. There shall be no loss of regular status. Benefits shall be based on the Full-time Equivalency of the temporary assignment. The Employee will return to their regular position outside at the end of this Collective Agreementthe temporary assignment. It is understood that such approval will be conditional on the operational requirements, and shall not be unreasonably withheld. Regular Employees shall maintain their right to seniority and continue to accumulate seniority while in the temporary position.

All applications for job postings shall be posted made in writing to the contact person designated on the appropriate form and electronically on the Employer’s intranet for seven (7) calendar days as a general posting throughout the organization, stating the responsibilities and qualifications, location (Department, work site), existing shift schedule and Basic Rate of Pay for the position and to whom applications should be submittedposting.
33.03 Requests for transfer or applications for vacancies 9.02 A copy of all job postings shall be in writing according forwarded to the procedures established Chapter Chairperson.
9.03 At time of hire or transfer, or change of hours in accordance with Article 13 or change of status in accordance with Article 7 or 9, the work site Employee shall receive a letter, confirming the appointment or change. These shall not be altered except by the Employer. Facilities will be provided to accept applications for posted positions at any time within operation of the seven (7) calendar day posting periodprovisions of this Collective Agreement.
(a) When making promotions and transfers and when filling vacancies within the Bargaining Unitvacancies, the determining factors shall be the most requisite job related skills, training, knowledge, acceptable performance ability and other relevant attributes experience, and where these those factors are considered by the Employer to be equal and satisfactoryequal, seniority will shall be the deciding factor.
(b) Regular Employees in For vacancies within the Bargaining Unit shall be given preference over other applicants.
33.05 When a vacancy is posted and circumstances require the Employer to fill a vacancy before the expiration of the seven (7) calendar day posting period, or prior to the availability of a qualified applicant, the appointment shall be made on a temporary basis only. The Employer shall fill such vacant position on a permanent basis as soon as a qualified applicant becomes available.
(a) A copy of all postings shall be forwarded to the designated Officer of the Union, and when the appointment has been made, the designated Officer will be notified of the appointee's name and the Department concerned.
(b) The Employer shall post the name of the successful candidate and the competition number on the posting board within seven (7) days of the appointment. The successful candidate will be informed in writing of the details of the competition they are successful in obtaining.
(a) Transfers and promotions shall be on a trial basis. The transferred or promoted Employee will be given a trial period of three hundred forty-eight point seven five (348.75) regular hours worked, in which to demonstrate the ability to fill the new position satisfactorily. The trial period may be extended by the number of working hours absent for any reason during the trial period.
(b) During the Trial Period, the Employee may either:
(i) be returned by the Employer to the Employee’s former position; or
(ii) return to her former position provided it is still vacant. In circumstances where returning to her former position is no longer possible, bargaining unit the Employer shall place give first priority and consideration for selection to applicants who are members of the Employee in another suitable vacant position within bargaining unit before considering applicants from outside the Employee’s current Centre without loss of seniority and at a rate of pay equivalent to that of her former positionbargaining unit.
(c) An Employee who is transferred before completing her initial probationary period shall complete the initial probationary period as well as the trial period in Article 11.06(a) above.
(d) In the event that an Employee returns to her former position pursuant to Article 33.07(b), the Employer shall have one (1) opportunity to fill the resultant vacancy by selecting from the applicants on the original posting. Should the Employer exercise this right 9.05 When the posting provisions process is completed and the position is awarded, notice of this Article the award will be deemed to be satisfied.
33.08 The foregoing provisions shall be waived and inoperative when placement of an Employee in a job within the Bargaining Unit is effected to provide a period of Rehabilitative Work.
33.09 A Regular Employee who applies posted for and is successful on a Temporary posting shall maintain their status as a Regular Employee. A Casual Employee who applies for and is successful for a Temporary position shall receive all entitlements and benefits applicable to a Temporary Employee. At the completion of the Temporary term, the Regular Employee shall return to their former position. At the completion of the Temporary term, the Casual Employee shall resume the normal terms and conditions of employment applicable to a Casual Employeethree (3) working days.
(a) When an Employee is assigned by their immediate Supervisor to replace another Employee in a higher paid classification within this Collective Agreement the successful applicant for a full or partial shift of at least two (2) hours or longerdifferent job classification, the Employee shall will be placed at paid the next highest grid step and rate of pay step in for the higher classification that provides for an increase above her current Basic Rate of Paynew job classification.
(b) When an Employee is Employees required to perform the duties of work in a lower paid different job classification, her Basic Rate shall receive their current rate of Pay will not be changedpay or the next highest grid step and rate of pay for the different job classification, whichever is greater, for all hours worked in the different job classification.
9.07 The Employer may temporarily fill a vacancy during the posting period. The vacancy will be temporarily filled by qualified candidates only (c) When a Regular Employee agrees to substitute on another position outside or with appropriate training).
9.08 If no applications are received by completion of this Collective Agreementthe posting period, the Regular Employee Employer will receive, in addition to fill the Employee’s Basic Rate of Pay, an amount commensurate vacancy at its discretion. 33.05 When 33.5 Successful applicants that are transferring from CUPE Local 2111 shall transfer their accrued seniority and pension entitlements, vacation entitlement date, unused vacation up to a vacancy is posted maximum of one (1) years’ entitlement plus five (5) days and accrued sick leave. Employees shall be required to serve the probationary period, as per Article 13 of the applicable Collective Agreement.

At the completion of the Temporary termsite, the Regular Employee shall return Employer may offer the position to their former position. At an applicant from the completion of initial posting in accordance with Clause 33.04, rather than post the Temporary term, the Casual Employee shall resume the normal terms and conditions of employment applicable to a Casual Employeevacancy.

34.03 Applications for vacancies, transfers or promotions, shall be made on-line as per the process established by the Employer.
34.04 The following order for consideration of applicants shall apply:
(a) the Regular Employees who are covered by this Collective Agreement in the Centre where the vacancy exists or the new position is being created;
(b) next, the Temporary and/or Casual Employees covered by this Collective Agreement in the Centre where the vacancy exists or the new position is being created;
(c) next, the Regular Employees who are covered by this Collective Agreement in other Centres of the Bargaining Unit shall be given preference over Employer;

33.05 34.05 When a vacancy is posted and circumstances require the Employer to fill a vacancy pending the completion of the hiring process contemplated in this Article, before the expiration of the seven (7) calendar day posting period, or prior to the availability of a qualified applicant, the appointment shall be made on a temporary basis only. The Employer shall fill such vacant position on a permanent basis as soon as a qualified applicant becomes available.
(a) A copy of all postings shall be forwarded to the designated Officer of the Union, and when the appointment has been made, the designated Officer will be notified of the appointee's ’s name and the Department concernedconcerned within ten (10) calendar days of their appointment.

(c) During the Trial Period, trial period the Employee may eitherchoose to return or the Employer may direct the Regular Employee to return to their former position and Basic Rate of Pay without loss of seniority. When an Employee chooses to vacate the position prior to the expiry of the trial period or when the Employer directs the Employee to return to their prior position during the trial period, the Employer shall:
(i) be returned by the Employer to the Employee’s former position; or
(ii) return to her former position provided it is still vacant. In circumstances where returning to her former position is no longer possible, the Employer shall place the Employee in another suitable vacant position within the Employee’s current Centre without loss of seniority and at a rate of pay equivalent to that of her former position.
(c) An Employee who is transferred before completing her initial probationary period shall complete the initial probationary period as well as the trial period in Article 11.06(a) above.
(d) In the event that an Employee returns to her former position pursuant to Article 33.07(b), the Employer shall have one (1) opportunity to fill the resultant vacancy by selecting an applicant from the applicants on original posting without reposting the vacancy pursuant to Clause 34.02. Such selection of a new successful applicant shall be in accordance with this Article; or
(ii) repost the position pursuant to Clause 34.02, if the resultant vacancy is not filled with an applicant from the original posting. Should the Employer exercise this right the posting provisions of this Article will be deemed to be satisfied.
33.08 34.08 The foregoing provisions shall be waived and inoperative when placement of an Employee in a job within the Bargaining Unit bargaining unit is effected to provide a period of Rehabilitative Workrehabilitative work.
33.09 34.09 A Regular Employee who applies for and is successful on a Temporary temporary posting shall maintain their status as a Regular Employee. A Casual Employee who applies for and is successful for a Temporary position shall receive all entitlements and benefits applicable to a Temporary Employee. At the completion of the Temporary temporary term, the Regular Employee shall return to their former position.
34.10 A casual Employee who applies for and is successful on a temporary posting shall receive all entitlements and benefits applicable to a temporary Employee. At the completion of the Temporary their temporary term, the Casual casual Employee shall resume the normal terms and conditions of employment applicable to a Casual casual Employee.
(a) When an Employee is assigned by their immediate Supervisor to replace another Employee in a higher paid classification within this Collective Agreement for a full or partial shift of at least two (2) hours or longer, the Employee shall be placed at the pay step in the higher classification that provides for an increase above her current Basic Rate of Pay.
(b) When an Employee is required to perform the duties of a lower paid classification, her Basic Rate of Pay will not be changed.
(c) When a Regular Employee agrees to substitute on another position outside of this Collective Agreement, the Regular Employee will receive, in addition to the Employee’s Basic Rate of Pay, an amount commensurate with the additional responsibilities.

(a) Successful applicants that are transferring from within CUPE Covenant Health Locals shall transfer their accrued seniority and satisfactorypension entitlements, seniority will vacation entitlement date, unused vacation up to a maximum of one (1) years’ entitlement plus five (5) days and accrued sick leave. Employees shall be required to serve the deciding factorprobationary period, as per Article 13 of the applicable Collective Agreement.
(b) Regular Successful applicants who are transferring from other Covenant Health non-CUPE facilities shall transfer their vacation entitlement date, unused vacation up to a maximum of one (1) year’s entitlement plus five (5) days and accrued sick leave. If, in the opinion of the Employer, the Employee fails to succeed during the trial periodperiod or should the Employee elect not to continue in the new position during that time, they shall be reinstated in their former position at their former rate of pay without loss of seniority, if applicable. If such is not possible, the Employee shall be placed in another suitable position.
(b) During the Trial Period, the Employee may either:
(i) be returned by the Employer to the Employee’s former position; or
(ii) return to her former position provided it is still vacant. In circumstances where returning to her former position is no longer possible, the Employer shall place the Employee in another suitable vacant position within the Employee’s current Centre without loss of seniority and at a rate of pay equivalent to that of her former position.
(c) An Employee who is transferred before completing her initial probationary period shall complete the initial probationary period as well as the trial period in Article 11.06(a) above.
(d) In the event that an Employee returns to her their former position pursuant to Article 33.07(bClause 33.08 (a), the Employer shall have one (1) opportunity to may fill the any resultant vacancy by selecting from the applicants on the original posting. Should the Employer exercise this right In such cases, the posting provisions of this Article will be deemed to be satisfied.
33.08 The foregoing provisions shall be waived and inoperative when placement of an Employee (c) Notwithstanding Clause 33.01, where a vacancy occurs in a job classification within three (3) months of the Bargaining Unit is effected to provide closing date of a period of Rehabilitative Work.
33.09 A Regular Employee who applies for and is successful on a Temporary posting shall maintain their status as a Regular Employee. A Casual Employee who applies for and is successful for a Temporary position shall receive all entitlements vacancy in the same classification, FTE, Department/Program, and benefits applicable to a Temporary Employee. At the completion of the Temporary termsite, the Regular Employee shall return Employer may offer the position to their former position. At an applicant from the completion of initial posting in accordance with Clause 33.04, rather than post the Temporary term, the Casual Employee shall resume the normal terms and conditions of employment applicable to a Casual Employeevacancy.
(a) When an An Employee who is assigned by their immediate Supervisor to replace another Employee in serving a higher paid classification within this Collective Agreement probation period may make application for a full transfer or partial shift promotion into a posted position, which is within their current department. An Employee appointed to a new position during a probationary period, shall serve a new probation period from the effective date of at least two (2) hours the transfer or longer, the Employee shall be placed at the pay step in the higher classification that provides for an increase above her current Basic Rate of Paypromotion.
(b) When an An Employee who is required serving a trial period may make application for a transfer or promotion into any posted position. An Employee appointed to perform a new position during a trial period, shall serve a new trial period from the duties effective date of a lower paid classification, her Basic Rate of Pay will not be changedthe transfer or promotion.
(c) When 33.10 Provided that the Employee’s supervisor has granted approval, a Regular Employee agrees who is the successful applicant for a temporary position within the bargaining unit shall be deemed to substitute be on another position outside temporary assignment. There shall be no loss of this Collective Agreement, regular status. Benefits shall be based on the Regular Full-time Equivalency of the temporary assignment. The Employee will receive, return to their regular position at the end of the temporary assignment. It is understood that such approval will be conditional on the operational requirements and shall not be unreasonably withheld. 33.03 Requests for transfer or applications for vacancies shall be in writing according to the procedures established in the work site by the EmployerSite. APPOINTMENTS, PROMOTIONS, TRANSFERS AND VACANCIES. 33.01 In filling a new position or a vacancy, appointments shall be made on the basis of the qualifications and seniority of the applicants. The qualifications for the new position or vacancy shall be consistent with the responsibilities specified in the position profile. Qualifications may include job related skills, training, and knowledge provided these qualifications are specified in the job posting.
33.02 When a new position is created or when a vacancy occurs in any classification covered by this Collective Agreement, such position or vacancy shall be posted on the appropriate form and electronically on the Employer’s intranet Job Application System for seven (7) calendar days as a general posting throughout the organization, stating the responsibilities and qualifications, location (Department, work site), existing shift schedule and Basic Rate of Pay for the position and to whom applications should be submitted.
33.03 Requests for transfer or applications for vacancies shall be in writing according to the procedures established in the work site by the Employer. Facilities will be provided to accept applications for posted positions at any time within the seven (7) calendar day posting period.
(a) When making promotions and transfers and filling vacancies within the Bargaining Unit, the determining factors shall be the most requisite job related skills, training, knowledge, acceptable performance and other relevant attributes and where these factors are considered by the Employer to be equal and satisfactory, seniority will be the deciding factor.
(b) Regular Employees in the Bargaining Unit shall be given preference over other applicants.
33.05 When a vacancy is posted and circumstances require the Employer to fill a vacancy before the expiration of the seven (7) calendar day posting period, or prior to the availability of a qualified applicant, the appointment shall be made on a temporary basis only. The Employer shall fill such vacant position on a permanent basis as soon as a qualified applicant becomes available.
(a) A copy of all postings shall be forwarded to the designated Officer of the Union, and when the appointment has been made, the designated Officer will be notified of the appointee's name and the Department concerned.
(b) The Employer shall post the name of the successful candidate and the competition number on the posting board within seven (7) days of the appointment. The successful candidate will be informed in writing of the details of the competition they are successful in obtaining.
(a) Transfers and promotions shall be on a trial basis. The transferred or promoted Employee will be given a trial period of three hundred forty-forty- eight point seven five (348.75) regular hours worked, in which to demonstrate the ability to fill the new position satisfactorily. The trial period may be extended by the number of working hours absent for any reason during the trial period.
(b) During the Trial Period, the Employee may either:
(i) be returned by the Employer to the Employee’s former position; or
(ii) return to her former position provided it is still vacant. In circumstances where returning to her former position is no longer possible, the Employer shall place the Employee in another suitable vacant position within the Employee’s current Centre without loss of seniority and at a rate of pay equivalent to that of her former position.
(c) An Employee who is transferred before completing her initial probationary period shall complete the initial probationary period as well as the trial period in Article 11.06(a) above.
(d) In the event that an Employee returns to her former position pursuant to Article 33.07(b), the Employer shall have one (1) opportunity to fill the resultant vacancy by selecting from the applicants on the original posting. Should the Employer exercise this right the posting provisions of this Article will be deemed to be satisfied.
33.08 The foregoing provisions shall be waived and inoperative when placement of an Employee in a job within the Bargaining Unit is effected to provide a period of Rehabilitative Work.
33.09 A Regular Employee who applies for and is successful on a Temporary posting shall maintain their status as a Regular Employee. A Casual Employee who applies for and is successful for a Temporary position shall receive all entitlements and benefits applicable to a Temporary Employee. At the completion of the Temporary term, the Regular Employee shall return to their former position. At the completion of the Temporary term, the Casual Employee shall resume the normal terms and conditions of employment applicable to a Casual Employee.
(a) When an Employee is assigned by their immediate Supervisor to replace another Employee in a higher paid classification within this Collective Agreement for a full or partial shift of at least two (2) hours or longer, the Employee shall be placed at the pay step in the higher classification that provides for an increase above her current Basic Rate of Pay.
(b) When an Employee is required to perform the duties of a lower paid classification, her Basic Rate of Pay will not be changed.
(c) When a Regular Employee agrees to substitute on another position outside of this Collective Agreement, the Regular Employee will receive, in addition to the Employee’s Basic Rate of Pay, an amount commensurate with the additional responsibilities.

33.02 When a new position is created (a) Vacancies for Regular or when a vacancy occurs in any classification covered by this Collective Agreement, such position or vacancy Temporary Positions shall normally be posted on the appropriate form and electronically on the Employer’s intranet for seven (7) calendar days as a general posting throughout through the organization, stating the responsibilities and qualifications, location hospital.
(Department, work siteb) Relief positions of estimated periods of more than 90 calendar days duration shall be posted in accordance with Article 33.02(a), existing shift schedule and Basic Rate as a Temporary Position.
(c) The Employer may limit subsequent postings for a vacancy to two (2) postings.
(d) A copy of Pay all postings shall be forwarded to the designated Officer of the Union, once appointment has been made.
(e) An employee off work for ninety (90) calendar days or more shall give the position and employer fourteen (14) days notice of their intent to whom applications should be submittedreturn to work.
33.03 Requests for transfer or applications for vacancies shall be in writing according to the procedures established in the work site by the EmployerFacility. Facilities will be provided to accept applications for posted positions at any time within the seven (7) calendar day posting period.
33.04 In accordance with the Article 33.01, the following order for consideration of applicants shall apply:
