Common use of ASSOCIATION MEMBERSHIP AND CHECKOFF Clause in Contracts

ASSOCIATION MEMBERSHIP AND CHECKOFF. Section 13.1 On the effective date of this agreement, each employee subject to this agreement, and each employee hired after the effective date of this agreement shall, as a condition of employment, become members of the Association within 30 work days of the effective date of this agreement or within 30 work days of the hire date, whichever is applicable. Such employee shall then maintain membership in the Association in good standing during the period of this agreement. Section 13.2 The parties recognize that an employee should have the option of declining to participate as a member in the Association, yet contribute financially to the activities of the Association in representing such employee as a member of the collective bargaining unit. Therefore, as an alternative to, and in lieu of the membership requirements of the previous section of this article, an employee who declines membership in the Association may pay to the Association each month a service charge as a contribution towards the administration of this agreement in an amount equal to the regular monthly dues. This service charge shall be collected by the District in the same manner as monthly dues. 13.2.1 In order to safeguard the right of an employee to object to payment of dues to an Association on religious grounds, such employee may have his/her dues sent to a non-religious charity agreed upon by the employee and the Association providing the employee submits documentary proof to the Association satisfactorily showing that such dues violates the tenants of the church or religious institution to which such employee belongs. Should the Association and employee not agree on the non-religious charity, the matter shall be appealed to the Public Employment Relations Commission for resolution.
