All such reviews shall be made in the presence of the Senior Executive Director for Human Resources or his/her designated representative and an Association representative if the Member so wishes. Privileged information, except such as confidential credentials from universities and other items relating to personal references normally sought at the time of employment, are specifically exempt for information from sources outside such review. Such files may not contain a reprimand for a period of time in excess of two years, provided no additional reprimand occurs during the school system, which is confidential. 3.7 The Board and the Association recognize the responsibilities imposed on the Association and will grant permission and a reasonable amount of time to the designated representatives of the Association may, at to investigate grievances and to transact other Association business during working hours. Section 7: 3.8 The Board agrees that, whenever possible, Members shall have the opportunity to interview and make recommendations concerning all personnel, certified and non- certified, who are being considered for assignment under their supervision.
3.9 The Board agrees to permit, by consent provide for payroll deduction of Member’s dues or service fees upon written authorization of the building principal, Association commencing with the last pay each September and will remit such withholdings to the Association officers (namely: the president, vice president, secretary, treasurer, one (1) Association representative from each building on a monthly basis.
3.10 It is recognized that proper negotiations and members administration of the grievance committee) Master Agreement cause expenses to travel from building the Association. Section 9: 3.11 In the event an employee eligible for membership in the district receives Association chooses not to join or pay the service fee as required in Article 3.10, s/he shall be terminated from his/her position at the end of the current school year. Said employee must pre-pay all Association dues or services fees before assuming any future Association position.
3.12 Any Member beginning work after July 1 or leaving before June 30 shall be charged dues or service fees on a FOIA request for the personnel record(s) of any teacher(s), or any portion thereof, the district shall promptly provide the following to the affected teacher(s)pro rata basis.

ASSOCIATION RIGHTS AND RESPONSIBILITIES. Section 1: 5.01 Pursuant to Act 379 of the Public Acts of 1965, the Board hereby agrees that every teacher will have the right to freely organize, join, and support the Association for the purpose of engaging in collective bargaining or negotiations. 5.02 The Association will have the privilege of using school buildings, when available, and in conformance with Board policies for meetings provided that when special custodial service is required the Board will make a customary charge therefore. The Association will have the privilege of posting notices of official organizational materials of the Association on the designated bulletin board provided in each building.
5.03 The Board agrees to permit furnish to the local Edwardsburg Education Association in response to reasonable written requests from time to time public information concerning the financial resources of the District. The Board further agrees to supply available information which is germane to the issue which may be necessary for the Association to process any grievance or complaint, except in cases involving confidential personnel records.
5.04 Duly authorized representatives of the Association will be permitted to transact official Association business on school property at all reasonable times, provided that it does not interfere with, interrupt, or affect the normal operation of assigned duties. It is the responsibility of the above mentioned Association representatives to report to the building principal before they conference with any teacher. It is understood that no Association views on matter related to Administrative- Teacher or Board-Association relationship will be discussed in the presence of students. If, in the opinion of the principal or the immediate supervisor of the Association member, such Association activity is interfering with classroom activities or assigned duties, such Association activities must be discontinued immediately.
5.05 The Association may use school facilities and equipment, at reasonable times, when such equipment is not otherwise in use, providing:
A. Written request is made and use is arranged for in advance.
B. The use is strictly to serve the legitimate business of the Association, such as records, notices, correspondence, etc.
C. The purpose is for internal business use of the Association and is not for public information.
D. Supplies, in connection with such equipment use, will be furnished or paid for by the Association. Equipment will not be removed from school buildings for property unless permission is granted by the Administrator following a written request by the Association meetings after president/designee. Use of equipment other than that listed herein will be with administrative approval. Where there is delay in calling the complaint to the attention of the teacher to avoid jeopardizing an investigation, the investigation shall be promptly completed and the complaint shall be called to the attention of the teacher during the investigation.

5.2 The Board agrees to permit the local Edwardsburg Education Association the use of the school buildings for Association meetings after school hours subject to availability board and the approval association agree that all employees shall have full freedom of the responsible administrator. The Board reserves the right to charge a fee for such facility use if the school incurs an additional cost. Said use may not violate the Campaign Finance Act.

5.7 The building principals shall permit placement of association material and notices in each teacher's mailbox and on teachers' room bulletin boards.
5.8 The board and the association may meet on a periodic basis for information from sources outside the purpose of discussing various educational matters of interest or concern to both or either party relating to the welfare of the school system.
5.9 The board shall place on the agenda of each regular board Meeting as an item for consideration under "New Business", which is confidentialany matters brought to its consideration by the association so long as those matters are made known to the superintendent's office seventy-two (72) hours, or if circumstances warrant, seven (7) days prior to the regular meeting, in writing.
5.10 Upon written application, payroll deductions will be made for all insurances, tax sheltered annuities (less any insurance premiums contained therein), association dues, savings bonds, and the credit union. Such authorization shall be revocable by the teacher at any time upon written notice. A representative statement of these deductions shall be provided with each salary payment. Those required by law; i.e., withholding taxes, retirement and FICA, will automatically be deducted.

ASSOCIATION RIGHTS AND RESPONSIBILITIES. Section SECTION 4.01 EXCLUSIVITY Throughout this Agreement certain rights and functions are accorded and ascribed to the Association. These rights and functions are afforded to the Association as the legal representative for all employees covered under this Agreement. The Board agrees that it will not directly or indirectly discourage, deprive, or coerce any teacher in the enjoyment of any rights covered by Act 379 of the Public Acts 1965; laws of the State of Michigan and the United States; that it will not discriminate against any teacher with respect to hours, wages, or terms and conditions of employment by reason of his/her membership in the Association, participation in collective professional negotiation; or the institution of any grievance, complaint, or proceeding under this Agreement.
5.02. The Association will have the privilege of using school buildings, when available, and in conformance with Board policies for meetings provided that when special custodial service is required the Board will make a customary charge therefore. The Association will have the privilege of posting notices of official organizational materials of the Association on the designated bulletin board provided in each building.
5.03. The Board agrees to permit furnish to the local Edwardsburg Education Association in response to reasonable written requests from time to time public information concerning the financial resources of the District. The Board further agrees to supply available information which is germane to the issue which may be necessary for the Association to process any grievance or complaint, except in cases involving confidential personnel records.
5.04. Duly authorized representatives of the Association will be permitted to transact official Association business on school property at all reasonable times, provided that it does not interfere with, interrupt, or affect the normal operation of assigned duties. It is the responsibility of the above mentioned Association representatives to report to the building principal before they conference with any teacher. It is understood that no Association views on matter related to Administrative- Teacher or Board-Association relationship will be discussed in the presence of students. If, in the opinion of the principal or the immediate supervisor of the Association member, such Association activity is interfering with classroom activities or assigned duties, such Association activities must be discontinued immediately.
5.05. The Association may use school facilities and equipment, at reasonable times, when such equipment is not otherwise in use, providing:
A. Written request is made and use is arranged for in advance.
B. The use is strictly to serve the legitimate business of the Association, such as records, notices, correspondence, etc.
C. The purpose is for internal business use of the Association and is not for public information.
D. Supplies, in connection with such equipment use, will be furnished or paid for by the Association. Equipment will not be removed from school buildings for property unless permission is granted by the Administrator following a written request by the Association meetings after president/designee. Use of equipment other than that listed herein will be with administrative approval. The Association recognizes that all equipment in a building is ultimately the responsibility of the building administrator.
5.06. The Association may use the inter-school hours subject to availability mail service and the approval of the responsible administrator. The Board reserves the right to charge a fee for such facility use if the school incurs an additional cost. Said use may not violate the Campaign Finance Act.
Section 2: The Board agrees to permit the Association use of intra-school mails and teacher teachers’ mailboxes for the purpose of transmitting and/or distributing official Association materials materials. The Association will have a mailbox in the Board offices to transmit and agrees receive communications from its membership.
5.07. The Association will be granted a total of twenty-eight (28) days per school year without loss of pay for conducting Association business including attendance at Association meetings. Appropriate written notice signed by the Association President of approved Association business days will be given to permit the supervisor (so that a substitute will be secured) and the Department of Human Resources in advance of the use. All requests for the use of bulletin board space in each building for Association days must be approved and countersigned by the purpose President of posting Association noticesthe Association.
