Automatic Connections to the Internet. The Software may cause Customer’s Computer, without notice, to automatically connect to the Internet and to communicate with an Adobe website or Adobe domain for purposes such as license validation and providing Customer with additional information, features, or functionality. Unless otherwise specified in Sections 14.2 through 14.7, the following provisions apply to all automatic Internet connections by the Software: 14.1.1 Whenever the Software makes an Internet connection and communicates with an Adobe website, whether automatically or due to explicit user request, the Privacy Policy shall apply. Adobe Privacy Policy allows tracking of website visits and it addresses in detail the topic of tracking and use of cookies, web beacons, and similar devices. 14.1.2 Whenever the Software connects to Adobe over the Internet, certain Customer information is collected and transmitted by the Software to Adobe pursuant to the Adobe Online Privacy Policy available at xxxx://xxx.xxxxx.xxx/go/privacy (“Privacy Policy”). 14.1.3 If Customer accesses an Adobe Online Service (as defined in Section 16.4 below) or activates or registers the Software, then additional information such as Customer’s Adobe ID, user name, and password may be transmitted to and stored by Adobe pursuant to the Privacy Policy and additional terms of use related to such Adobe Online Service (collectively with the Xxxxx.xxx terms of use and any applicable terms, the “Additional Terms of Use”). 14.1.4 As permitted by applicable law or as consented to by Customer, Adobe may (a) send Customer transactional messages to facilitate the Adobe Online Service or the activation or registration of the Software or Adobe Online Service, or (b) deliver in- product marketing to provide information about the Software and other Adobe products and Services using information including but not limited to platform version, version of the Software, license status, and language.

The Software may collect certain non-personally identifiable usage statistics, such as how many times a user launches the Software, how many times a user accesses a particular button or feature in the Software and the average amount of time a user uses the Software. Adobe uses this anonymous information to improve its products and services, to provide more relevant experiences to our customers and to provide internal and external statistical analysis.

The End User agrees and consents that: 8.1.1 When the Software automatically connects to the Internet, an Internet protocol address (“IP Address”) (considered as personally identifiable information in some jurisdictions) associated with the End User’s Internet connection may be sent to a Roadmetrics’ web site, 8.1.2 Whenever the Software makes an Internet connection and communicates with a Roadmetrics web site, whether automatically or due to explicit user request, the Roadmetrics privacy policy of Roadmetrics shall apply. Additionally, unless the End User is provided with separate terms of use at that time, xxx.xxxxxxxxxxx.xx terms of use shall apply.

  • Completion of Concrete Pours and Emergency Work (a) Except as provided in this sub-clause an Employee shall nor work or be required to work in the rain. (b) Employees shall not be required to start a concrete pour in Inclement Weather. (c) Where a concrete pour has been commenced prior to the commencement of a period of Inclement Weather Employees may be required to complete such concrete pour to a practical stage and for such work shall be paid at the rate of double time calculated to the next hour, and in the case of wet weather shall be provided with adequate wet weather gear. (d) If an Employee’s clothes become wet as a result of working in the rain during a concrete pour the Employee shall, unless the Employee has a change of dry working clothes available, be allowed to go home without loss of pay. (e) The provisions of clauses 32.7(c) and 32.7(d) hereof shall also apply in the case of emergency work where the Employees concerned and their delegates agree that the work is of an emergency nature and can start and/or proceed.
