Section 16.4. 37 If any provision of this Agreement or the application of any such provision is held invalid, the 38 remainder of this Agreement shall not be affected thereby. 39
Section 16.4. 526. If any Individual requests an amendment of Protected Information directly from BA or its agents or subcontractors, BA must notify CE in writing within five (5) business days of the request. Any approval or denial of amendment of Protected Information maintained by BA or its agents or subcontractors shall be the responsibility of CE [45 C.F.R. Section 164.504(e)(2)(ii)(F)].
Section 16.4. 7 Retroactive pay, where applicable, shall be paid on the first regular payday following execution of an 8 agreement, if possible, and in any case not later than the second regular payday.
Section 16.4. 14 Neither party shall be compelled to comply to any provision of this Agreement which conflicts with 15 State or Federal statutes or regulations promulgated pursuant thereto.
Section 16.4. 43 Any employee required to travel from one site to another in a private vehicle during working hours 44 shall be reimbursed for such travel on a per-mile basis at the current rate established by District policy.
Section 16.4. 7 Employees required to remain overnight on District business shall be reimbursed for room and board 8 expenditures.
Section 16.4. 2 If any provision of this Agreement or the application of any such provision is held invalid, the 3 remainder of this Agreement shall not be affected thereby and such provision shall be renegotiated.
Section 16.4. 33 When a substitute bids on and receives a permanent position Journey Step or the step applicable to their 34 verified industry experience, whichever is greater, will apply. A substitute already at Journey Step 35 (Schedule A) in the same classification will remain at that rate until the requirements for the next 36 scheduled step increase are met.
Section 16.4. 522. CE may effectuate any and all such notices of non-private information via posting on CE’s web site. Associate shall review CE’s designated web site for notice of changes to CE’s HIPAA privacy policies and practices on the last day of each calendar quarter.
Section 16.4. 19 For purposes of calculating daily hours, time worked shall be rounded to the next one-quarter (¼) hour.
