Additional Terms of Use. Participation in the Referral Partner Program may require acceptance of additional terms that supplement or modify this Agreement. Referral Partner shall be subject to any such additional terms of use as a condition of continued participation in the Referral Partner Program in accordance with any such additional terms of use in addition to this Agreement.

If Customer’s Multi-Path Ethernet Service includes a Path or data flow that exceeds 2 Gbps, Spectrum may limit such Path or data flow to 2 Gbps. For purposes of this Attachment, (i) “Path” shall mean a connection permitting data transmission between a MAC address and IP address and another MAC address and IP address, and (ii) “Multi-Path” shall mean Ethernet Services permitting data transmission between or among three (3) or more MAC addresses and IP addresses.

The Software and Service are intended and offered only for lawful use by individuals or organizations with the legal capacity and authority under applicable law to enter into a contract for such products or services. Comindware does not offer the Software or Service to minors or where prohibited by law. f. You are not relying on any oral or written representations or statements made by the Company with respect to the safety of participating in using the Bike(s), other than what is set forth in this Agreement.

Additional Terms of Use. By signing this Data Release and Users Agreement, I agree to the following terms of use for data released to me from the APES Database:
a. Data will be used by the person requesting a digital data extract solely for the purposes described in the Data Request and Proposal that has been approved by the Data Review Working Group and Data Provider of the APES Database.
b. Data provided by the APES Database will not be redistributed or sold to other individuals, institutions, or organizations under any circumstances.
c. Any alteration to digital data supplied by the APES database and intended for publication, dissemination or placement in the public domain, must be accompanied by a statement by the author(s), clearly describing the nature of any alterations effected on data extracted from the APES database. The author(s) is obligated to submit the altered dataset in its entirety to the DRWG for review and integration into the APES database.
d. Any party who has received a digital data extract from the APES database must submit a final draft of all documents which include these to the DRWG for review and comments prior to submission, publication, or dissemination.
e. The person requesting the data must comply to all parameters associated with an approved data request, specified in Section 3.
f. The person submitting an approved request must provide citations and electronic/paper copies of all reports, book sections, articles, conference papers, theses, dissertations, or other publications that employ data provided by the APES Database.
g. The person receiving the data acknowledges that that the Data Provider and associated parties, APES, and the relevant funding agencies bear no responsibility for interpretations or inferences based upon these data by the person receiving data from the APES Database.
Additional Terms of Use. 1. User agrees, represents, and warrants that User is a safe and competent bicycle operator, is physically able to safely ride a bicycle without a risk to the User's health, is knowledgeable about the operation of a bicycle, and is knowledgeable about the laws pertaining to bicycles operated within the applicable state and all cities and towns where the Service is offered and/or used. Like any physical activity, riding a Provider bicycle may cause minor or major injuries or discomfort and may worsen or complicate underlying medical conditions or diseases. By choosing to ride Provider bicycle, User assumes all responsibilities and risks for all such injuries or other medical conditions.
2. User agrees that bicycles are machines that may malfunction, even if the bicycle is properly maintained, and that such malfunction may cause injury.
3. User agrees that Provider does not provide or maintain places where to ride Provider bicycles, and that Provider and the Municipalities do not guarantee that there will always be a safe place to ride a Provider bicycle. Roads, bicycle lanes, and bicycle routes may become dangerous due to weather, traffic, or other hazards. User must not use a Provider bicycle for racing, riding off road, or any other use, besides safe operation on public or private roads or property and designated bicycle routes.
4. User agrees that Provider and the Municipalities are not a common carrier. Alternative means of public and private transportation are available to the general public and to User individually, including public buses and rail service, taxis, and pedestrian paths. Provider and the Municipalities provide Provider bicycles only as a convenience, and such rental availability is intended to be used only by those persons who are able and qualified to operate a Provider bicycle on their own and who have agreed to all terms and conditions of this Agreement.
5. User agrees that access to the Service is denied to any person less than 16 years of age, whether or not accompanied by a parent or guardian. Minors who are at least 16 years of age may use the Service, but only if the minor’s use of the Service is facilitated by and under the responsibility of the minor's parent or legal guardian.
