AVAILABILITY OF THE PLATFORM. 11.1. Springpod shall provide the Client with access to the platform on and subject to the terms of this agreement during the period set out in an order. 11.2. Springpod shall use commercially reasonable endeavours to make the platform available 24 hours a day, seven days a week, except for: 11.2.1. Planned maintenance; and 11.2.2. Unscheduled maintenance provided Springpod has used reasonable endeavours to give the Client at least three (3) hours notice in advance. 11.3. Notwithstanding the preceding Springpod: 11.3.1. Does not warrant that the Client’s use of the platform will be uninterrupted or error-free or that the service and/or the information the Client obtains through the platform will meet the Client’s requirements; and 11.3.2. Is not responsible for any delays, delivery failures, or any other loss or damage resulting from the transfer of data over communications networks and facilities, including the internet, and the Client acknowledges that the service may be subject to limitations, delays, and other problems inherent in the use of such communications facilities.

AVAILABILITY OF THE PLATFORM. 19.1 We will take all reasonable steps to ensure that the Platform is available for you to use at any time. However, for various reasons there may be times where the Platform may not be available, such as due to technical difficulties where we may not be able to receive your Orders or allow you to access the Platform. AVAILABILITY OF THE PLATFORM. 6.1 Platform availability shall be calculated according to the following formula: (Unscheduled monthly downtime (mins) / Total monthly minutes). 6.1.1 Unscheduled monthly downtime means any downtime caused by Inpulse Servers (excluding scheduled downtime) or any defect or error in the Services. 6.1.2 Total monthly minutes is a calculation of the number of minutes in the given month. For example, Total monthly minutes for January = 31 days = (31 x 24 hours) x 60 minutes = 44,640 minutes. 6.2 Inpulse shall use reasonable endeavours to achieve its target of 99.5% availability in each month during the t erm of this Agreement. In this calculation no account shall be taken of time lost to scheduled maintenance and/or factors outside the control of Quest (i.e., such downtime will be subtracted from the total monthly minutes). Factors outside the control of Quest include, but are not limited to: 6.2.1 faults associated with Your network equipment; 6.2.2 power outages or other force majeure events; 6.2.3 performance of or interference by any third party systems or third party controlled resources; 6.2.4 use of the Services for any purpose other than the Intended Purpose; or 6.2.5 faults caused by any breach of the Agreement by You.
AVAILABILITY OF THE PLATFORM. The availability of the platform and its services depends on the respective type of installation and the associated use. Since the ZEISS Quality Suite is not necessary for the operation of the software, availability is not guaranteed.
AVAILABILITY OF THE PLATFORM. Jornaya will make reasonable efforts to keep the Platform operational. However, it is not possible to operate our Platform with 100% uptime. Certain technical difficulties, routine site maintenance and upgrades, and other events may, from time to time, result in interruptions to, or outages of, our Platform.
AVAILABILITY OF THE PLATFORM. While we take all reasonable steps to limit any interruptions to your access to the Site, You acknowledge and agree that: (a) Your access to the Site may be prevented by issues outside of our control; (b) We do not promise continuous or error-free access to the Site; and (c) the functionality of the Site may change or be improved from time to time.
AVAILABILITY OF THE PLATFORM. 6.1. Whilst BuoyTrade will use commercially reasonable efforts to make the Platform available to you without any interruption, it does not guarantee that the Platform will be fault-free. If a fault occurs with the Platform, you should report it to xxxxx@xxxxxxxxx.xxx and BuoyTrade will attempt to correct the fault as soon as it reasonably can. 6.2. The Platform is dependent on other third-party service providers, including but not limited to website domain hosts and payment providers. BuoyTrade does not guarantee that the Website will be available at all times or uninterrupted. As such, BuoyTrade shall not be liable to you if for any reason the Platform is unavailable at any time or for any period.

You acknowledge and accept that there may be times where the Platform may not be available for various reasons outside our control, for example due to technical difficulties. In these circumstances we may not be able to receive your Orders and/or instructions to invest or allow you to access the Platform. Should this occur, we use our best endeavours to provide you with notice in advance or as soon as possible. You agree that My Virtual Vet, Inc. shall not be liable to you or to any third party for any direct or indirect consequence of any modification, suspension, discontinuance of, or interruption to our Platform.
