Average Market Share Reporting. Commencing on February 29, 2024, no later than ten (10) days following each Market Share Test Date, the Company shall provide the Purchaser with a calculation of the Average Market Share (the “Average Market Share Report”). If any Operational State Authority ceases to report Gross Gaming Revenue, the parties hereto shall negotiate in good faith to agree on an alternative basis to calculate the Average Market Share for such jurisdiction so as to effect the original intent of this Section 2.02 as closely as possible.
