Common use of - Benefits During Workers' Compensation Absences Clause in Contracts

- Benefits During Workers' Compensation Absences. Employees who are unable to work due to a work-related illness or injury and who are placed on a workers' compensation leave of absence shall continue to receive medical, life and dental insurance benefits until they have either been released for work with temporary restrictions or have reached maximum medical improvement and/or permanent restrictions whichever occurs sooner. Further, they shall continue to accrue sick leave and vacation benefits during the leave as if they were actively employed and shall receive such accruals upon return to work. Employees shall be compensated for all work time lost on the day a work-related injury occurs where medical treatment is necessary. Moreover, such employees shall be compensated for up to one (1) hour of work time for each fitness-for-duty examination which occurs during the employee's absence. Such compensation shall not be paid, however, where the employee is drawing workers' compensation lost time benefits. For purposes of sick leave, vacation benefits, seniority and any other benefit or provision that depends on length of service, upon return to work employees shall be credited for time served on worker’s compensation or disability pension as the result of disability incurred on the job. For vacation benefits such time shall also be used to the purpose of determining the amount of vacation to which they are entitled each year thereafter.
