BOARD RIGHTS AND RESPONSIBILITIES. A. The Association recognizes that the Board has responsibility and authority to manage and direct, in behalf of the public, all the operations and activities of the school district to the full extent authorized by law, by way of illustration, the right to: 1. Manage and control the school business and equipment and operation; 2. The assignment and direction of its personnel; 3. Direct the working forces, to hire, promote, suspend and discharge employees, transfer employees, assign work to employees, determine the size of the work force and to lay off employees; 4. Determine the services, supplies and equipment necessary to continue its operation and to determine the methods, schedules and standard of operation; 5. Adopt reasonable rules, regulations and policies; 6. Determine the number and location or relocation of its facilities including the establishment or relocation of new schools, buildings, departments, divisions or sub-divisions thereof and the relocation or closing of offices, departments, divisions or subdivisions, buildings or other facilities; 7. Determine the placement of operations, production, service, maintenance or distribution of work, and the source of materials and supplies; 8. Determine the financial policies, including all accounting procedures, and all matters relating to public relations; 9. Determine the size of management organization, its functions, authority, amount of supervision and table of organization; 10. Determine the policy affecting the hiring of teachers; 11. Maintain accreditation standards of the North Central Association of Colleges and Schools, and the Michigan Accreditation Program. B. The exercise of the powers, right, authority, duties and responsibilities by the Board, the adoption of policies, rules, regulations and practices in furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms of this Agreement and then only to the extent such specific and express terms hereof are in conformance with the Constitution and laws of the State of Michigan, and the Constitution and laws of the United States.

To implement a program of evaluation that will provide an objective assessment of each administrator’s performance; 6. To initiate and carry out the means of obtaining financial support for the School District; 7. Continue its rights, policies, and practices of assignment and direction of its personnel; 3. Direct the working forces, to hire, promote, suspend and discharge employees, transfer employees, assign work to employees, determine the size number of personnel and scheduling of all the work force and to lay off employeesforegoing, but not in conflict with the specific provisions of this Agreement; 48. Determine the services, supplies supplies, and equipment necessary to continue its operation operations and to determine the all methods and means of distributing, disseminating, and/or selling its services, methods, schedules and standard standards of operation, the means, methods, and processes of carrying on the work including automation or contracting thereof or changes therein, the institution of new and/or improvement methods or changes therein; 59. Adopt reasonable rules, regulations rules and policiesregulations; 6. Determine the number and location or relocation of its facilities including the establishment or relocation of new schools, buildings, departments, divisions or sub-divisions thereof and the relocation or closing of offices, departments, divisions or subdivisions, buildings or other facilities; 7. Determine the placement of operations, production, service, maintenance or distribution of work, and the source of materials and supplies; 810. Determine the financial policies, including all accounting procedures, and all matters relating to public relations; 911. Determine the size number of management organizationadministrative personnel, its their functions, authority, amount of supervision and table of organization, provided that the Board/Employer shall not abridge any right of employees as specifically provided for in this Agreement; 1012. Determine the policy affecting the hiring selection, testing, or training of teachersemployees providing that such selection shall be based upon lawful criteria; 1113. Maintain accreditation standards To establish in-service, workshops or conferences for administrators and to expect their attendance at these activities; 14. The Board/Employer may adopt rules and regulations not in conflict with the terms of this Agreement concerning the discipline of employees; 15. The Board/Employer shall continue the right to determine and re-determine job content consistent with the terms of this Agreement; 16. All parties recognize that the fiscal capacity of the North Central Association of Colleges School District is predicated solely upon taxes and Schools, and other public funds which could require the Michigan Accreditation ProgramBoard/Employer to extend or curtail any or all services presently provided. B. The exercise of the foregoing powers, rightrights, authority, duties and responsibilities by the Board, the adoption of policies, rules, regulations regulations, and practices in furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms of this Agreement and then only to the extent such specific and express terms hereof are in conformance with the Constitution and laws of the State of Michigan, and the Constitution and laws Laws of the United States. C. Nothing contained herein shall be considered to deny or restrict the Board of its rights, responsibilities, and authority under the Michigan General School Laws or any other national, state, county, district, or local laws or regulations. D. The listing of specific management rights in this Agreement is not intended to be nor shall it be, restrictive of, or a waiver of, any rights of management not listed and specifically surrendered herein, whether or not such rights have been exercised by the Board in the past.

Maintain accreditation standards of the North Central Association of Colleges and Schools, and the Michigan Accreditation Programemployees providing such selection shall be based upon lawful criteria.
