Property Association Declarations: If multiple property owners are to use the stormwater BMPs, provide a copy of proposed Property Association Declarations. Documents Are to Be Provided to Supplement the Operation and Maintenance Agreement. Exhibit A: A description of the property on which the BMP is located and all easements from the site to the facility. This information is shown on a plat to be filed with the Register of Deeds. If multiple lots are being served by the BMP, identify the lots that are using the stormwater BMP for treatment of runoff. Security in the form of a bond, letter of credit, sinking fund or cash deposit may be required. The following statement: "Each Lot or Tract served by the Stormwater BMP is jointly or severally responsible for repairs and maintenance of the Stormwater BMP and any unpaid ad valorem taxes, public assessments for improvements and unsafe building and public nuisance abatement liens charged against the facility, including all interest charges together with attorney's fees, cost and expenses of collection. As it relates to these Technical Provisions, references to freeway, project, South Mountain Freeway, proposed action, proposed freeway, and Selected Alternative mean the Project, and references to contractor mean Developer. Developer shall comply with and perform all of the contractor and ADOT requirements, including the ADOT obligations, commitments, and responsibilities, identified in the following table, except to the extent of those requirements that are specifically identified in the third column, entitled “Description of ADOT Responsibilities,” which are not delegated to Developer.

  • Data Return and Destruction of Data (a) Protecting PII from unauthorized access and disclosure is of the utmost importance to the EA, and Contractor agrees that it is prohibited from retaining PII or continued access to PII or any copy, summary or extract of PII, on any storage medium (including, without limitation, in secure data centers and/or cloud-based facilities) whatsoever beyond the period of providing Services to the EA, unless such retention is either expressly authorized for a prescribed period by the Service Agreement or other written agreement between the Parties, or expressly requested by the EA for purposes of facilitating the transfer of PII to the EA or expressly required by law.
