Building and Construction Industry Security of Payment Act. 2009 (Tas); Building and Construction Industry (Security of Payment) Act 2009 (ACT); Building and Construction Industry Security of Payment Act 2009 (SA); and any legislation in any State or Territory of Australia addressing security of payment in the building and construction industry.
Building and Construction Industry Security of Payment Act. 6.1 For the purposes of the Building and Construction Industry Security of Payments Acts (or equivalent acts) existing or enforceable from time to time in each State or territory in Australia:
(a) Every date on which goods are supplied shall be deemed a reference date, and the Supplier shall be entitled to issue payment claims accordingly.
(b) It shall be sufficient service of a payment claim if it is posted to your postal address as nominated on the credit application or to any other postal address that you nominate to us from time to time.

Means: any document, drawing, information or communication (whether in written, oral or electronic form) issued or communicated to the Consultant by the Commonwealth, the MCC Contract Administrator, the Contractor, the Contractor’s Representative or anyone on the Commonwealth's or Contractor’s behalf, whether or not owned by the Commonwealth or Contractor: marked as "sensitive information", "for official use only" or "OFFICIAL: Sensitive"; identified at the time of issue or communication as "Sensitive Information"; marked with a national security classification or as "Classified Information"; identified at the time of issue or communication as "Classified Information"; or the Consultant knows or ought to know is subject to, or ought to be treated as sensitive or classified information in accordance with any Statutory Requirement (including the Information Security Requirements); and everything recording, containing, setting out or making reference to the document, drawing, information or communication (whether in written, oral or electronic form) referred to in paragraph (a) above, including documents, notes, records, memoranda, materials, software, disks and all other media, articles or things.
