Casualty and Condemnation Amounts. Subject to SECTION 12.8(b), any amounts payable to the Administrative Agent as a result of a Casualty or Condemnation pursuant to Section 14.1 of the Master Lease shall be distributed as follows:
Casualty and Condemnation Amounts. Any amounts payable --------------------------------- to the Lessor as a result of a Casualty or Condemnation pursuant to Section 15.1 of the Lease (but excluding any amounts payable pursuant to Section 16.2 of the Lease) shall, if no Lease Event of Default exists, be paid over to Lessee for the rebuilding or restoration of that portion of the Property to which such Casualty or Condemnation applied, and any excess proceeds shall be paid to the Lessee. If a Lease Event of Default exists, then during the continuance of such Lease Event of Default, all such amounts shall be held by the Agent as Cash Collateral and upon exercise of the Lessor's remedies hereunder shall be distributed pursuant to Section 3.17. ------------

Casualty and Condemnation Amounts. Any amounts payable to the Indenture Trustee, Lessor or Facility Lender as a result of a Casualty or Condemnation pursuant to Section 15.1 of the Lease (but excluding any amounts payable pursuant to Section 16.2 of the Lease) shall, if no Lease Event of Default exists, be paid over to the Lessee to reimburse Lessee for any amounts expended by Lessee for the rebuilding or restoration of the Property to which such Casualty or Condemnation applied, and any excess proceeds shall be paid in accordance with the Lease. If a Lease Event of Default exists, then during the continuance of such Lease Event of Default, all such amounts shall be held by the Indenture Trustee in the Cash Collateral Account and upon exercise of the Indenture Trustee's remedies under the Operative Documents shall be distributed pursuant to Section 5.8.

Casualty and Condemnation Amounts. Subject to Section 12.6(b), any amounts payable to and received by the Lessor as a result of a Casualty or Condemnation pursuant to Section 15.1 of the Lease shall be distributed as follows: - all amounts payable to and received by the Lessee for the repair of damage caused by such Casualty or Condemnation in accordance with Section 15.1(a) of the Lease shall be distributed to the Lessee; and - all amounts that are to be applied to the purchase price of the Property in accordance with Article 16 of the Lease shall be distributed by the Lessor upon receipt thereof to the Rent Purchasers and the Lessor in the following order of priority: First, to the Rent Purchasers, pro rata, to pay the Lease Balance Debt; and Second, to the Lessor to pay the Lease Balance Equity. - ORDER OF APPLICATION. To the extent any payment made to any Rent Purchaser or the Lessor pursuant to Sections 12.2, 12.3, 12.4, 12.6 or 12.7 is insufficient to pay in full the Participant Balance of such Rent Purchaser or the Lessor, then each such payment shall first be applied to accrued Yield and then to principal on the Rent Purchaser Advances or the Lessor Contributions, as applicable. - THE LESSOR
