Caughfield Subdivision Area. The Parties acknowledge that portions of the Caughfield Subdivision Area are dually certificated (i.e., is within the boundaries of both the Leander CCN and the Georgetown CCN) and can be served by either Georgetown or Leander. The Parties agree that Georgetown may continue to provide retail water service to the portion of the Caughfield Subdivision Area within the boundaries of Georgetown’s CCN, and further agree to use their respective best efforts and cooperate with each other to obtain further approvals from governmental agencies or third parties as may be required to allow Georgetown to continue providing retail water service to the portion of the Caughfield Subdivision Area within the boundaries of Georgetown’s CCN. If such approval(s) are not obtained, Leander shall have the right to provide retail water service to the Caughfield Subdivision Area.

  • Excavation If any excavation shall be made upon land adjacent to or under the Building, or shall be authorized to be made, Tenant shall afford to the person causing or authorized to cause such excavation, license to enter the Premises for the purpose of performing such work as said person shall deem necessary or desirable to preserve and protect the Building from injury or damage and to support the same by proper foundations, without any claim for damages or liability against Landlord and without reducing or otherwise affecting Tenant’s obligations under this Lease.

  • Underground Utilities Any required ground digging or subsurface work shall be done in accordance with Chapter 556, Florida Statutes. The repairs of any damaged underground utilities as a result of the work being performed by CONTRACTOR shall be the responsibility of CONTRACTOR. The proper utility company shall be contacted immediately to expedite the repairs, if damage has occurred. CONTRACTOR will notify the COUNTY and provide a written explanation of the incident within two (2) days of the damage to any underground utilities.

  • UNDERGROUND LOCATIONS Prior to the Company commencing any work the Customer must advise the Company of the precise location of all underground services on the site and clearly xxxx the location. The underground mains and services the Customer must identify include, but are not limited to, telephone cables, fibre optic cables, electrical services, gas services, sewer services, pumping services, sewer connections, sewer sludge mains, water mains, irrigations pipes, oil pumping mains and any other services that may be on site. Whilst the Company will take all care to avoid damage to any underground services the Customer agrees to indemnify the Company in respect of all any liability claims, loss, damage, cost and fines as a result of damage to services not precisely located and notified pursuant to this clause.
