CAUSES FOR PERSONNEL ACTION DUE TO PHYSICAL OR MENTAL DISABILITY. For non-disciplinary reasons, a permanent employee's employment may be terminated or a permanent employee may be reduced in rank because of physical or mental disability which disability precludes the employee from the proper performance of the essential duties of his or her job. Any such action shall be subject to the same provisions of this article as are applicable to actions taken pursuant to Section 18.5.

Any such action shall be subject to the same provisions of this article as are applicable to actions taken pursuant to Section 12.5, except that as set forth in Government Code section 31721, the County may not separate because of disability a member otherwise eligible to retire for disability but shall apply for disability retirement of any eligible member believed to be disabled, unless the member waives the right to retire for disability.
