CC Container System. 11.1. Parties acknowledge that the CC Containers concerned in the Agreement are part of the CC Container System. The CC Containers are identified with the Identification Marks. 11.2. In accordance with the Agreement the Customer is entitled to the use of the amount of contracted CC Containers from the CC Container System. 11.3. Customer acknowledges that any and all CC Containers marked with the Identification Marks are and/or become a part of the CC Container System and can be used by Other Contracting Parties. 11.4. During the term of the Agreement CC reserves the right to exchange the CC Containers with components and fittings of improved design and make corresponding adjustments of the pricelist. 11.5. Parties agree that CC is at all times in the interest of the CC Container System entitled to reclaim all CC Containers from any Other Contracting Party in the event any and/or all agreement(s) with the Other Contracting Party are terminated. The Customer will assist and offer its full cooperation in reclaiming the CC Containers and provide with the required information and render assistance for that purpose. 12. Hand Out 12.1. CC Containers will become available for collection by the Customer at the collection depot(s) indicated by CC or if agreed otherwise delivered to the Customer. In the event delivery at the Customer is agreed, additional fees will be charged. 12.2. Any stated delivery date is an estimate. CC will use all reasonable endeavours to meet any stated delivery date. If no date for delivery is specified, delivery shall be made within a reasonable time. 13. Book-keeping 13.1. The Customer is obliged to keep accounting records and register and administrate the amount of CC Containers under any Agreement in an orderly manner in a book-keeping system. 13.2. CC is entitled to charge storage costs if and when the Customer maintains positive balance of CC Containers for more than two weeks at one of the CC depots. 13.3. The Customer shall be responsible at all times for keeping track of the CC Containers with which it has been entrusted and/or register the amount of the CC Containers in its booking/administration. If any CC Containers in the possession of the Customer are lost, CC has the right to charge the Customer with replacement of the CC Containers according to the current pricelist. 13.4. CC Container System. 11.1. Die Parteien erkennen an, dass die vom Vertrag betroffenen CC Container Teil des CC Container Systems sind. Die CC Container sind mit den Identifikationszeichen versehen. 11.2. Der Xxxxx ist gemäß den Bestimmungen des Vertrages berechtigt, die Anzahl der vertraglich vereinbarten CC Container aus dem CC Container System zu nutzen. 11.3. Der Xxxxx erkennt an, dass alle CC Container, die mit den Identifikationszeichen versehen sind, Teil des CC Container Systems sind und/oder werden und von anderen Vertragsparteien genutzt werden können. 11.4. Während der Laufzeit des Vertrages behält sich CC das Recht vor, die CC Container gegen verbesserte Teile und Zubehör auszutauschen und die Preisliste entsprechend anzupassen. 11.5. Die Parteien kommen überein, dass CC im Interesse des CC Container Systems jederzeit berechtigt ist, alle CC Container von jeder anderen Vertragspartei zurückzufordern, falls ein Vertrag und/oder alle Verträge mit der anderen Vertragspartei gekündigt werden. Aushändigung 12.1. CC Container können vom Kunden am/an den Collection Depot(s), die von CC genannt werden, abgeholt werden oder, falls anderweitig vereinbart, an den Kunden geliefert werden. Falls die Lieferung an den Kunden vereinbart wird, wird eine zusätzliche Gebühr erhoben. 12.2. Alle genannten Liefertermine sind geschätzt. CC wird sich angemessen bemühen, alle genannten Liefertermine einzuhalten. Falls kein Liefertermin festgelegt wurde, erfolgt die Lieferung innerhalb einer angemessenen Zeit. 13. Buchführung 13.1. Der Xxxxx ist verpflichtet, Aufzeichnungen zu führen und ordnungsgemäß in einem Buchführungssystem die Anzahl der CC Container unter jedem Vertrag einzutragen und zu verwalten. 13.2. CC ist berechtigt, Lagerkosten zu berechnen, wenn der Xxxxx für mehr als zwei Wochen einen Positivsaldo an CC Containern in einem CC Depot stehen hat. 13.3. Der Xxxxx ist jederzeit verantwortlich dafür, den Überblick über die CC Container zu behalten, die ihm anvertraut wurden und/oder die Anzahl der CC Container in seiner Buchführung/ Verwaltung einzutragen. Falls CC Container, die sich im Besitz des Kunden befinden, verloren gehen, hat CC das Recht, dem Kunden den Ersatz für die CC Container gemäß der dann gültigen Preisliste in Rechnung zu stellen. 13.4. En cas de retard, de défauts, de responsabilité du fait des produits ou d’autres circonstances découlant d’un Contrat, CC ne saurait être responsable de dommage indirect, accessoire ou consécutif, de nature quelconque, y compris notamment : perte de profit, perte d’économies, frais de réapprovisionnement, atteinte à la réputation, perte de clients, préjudice dû à une interruption commerciale ou à la défaillance d’un processus commercial ou d’une organisation administrative, ou dû à un délai manqué, mais également pour préjudice corporel. 7.2. Sauf en cas d’intention volontaire de CC ou de sa direction commerciale, l’obligation de CC est limitée au montant garanti et payé en vertu de l’assurance responsabilité de CC à hauteur maximale de DKK 15.000.000 (EUR 2.000.000) par an. 7.3. NYISO and Connecting Transmission Owner reserve the right to reasonably establish minimum acceptable settings for any installed Power System Stabilizers, subject to the design and operating limitations of the Large Generating Facility. If the Large Generating Facility’s Power System Stabilizers are removed from service or not capable of automatic operation, the Developer shall immediately notify the Connecting Transmission Owner and NYISO.   • Installation Services 3.1 The Bitstream 2a Service includes a Standard Install as set out below (in each case to the extent that the relevant provisioning works are not already complete for the relevant Service Order).1

  • Technology Upgrades Notwithstanding any other provision of this Agreement, Verizon shall have the right to deploy, upgrade, migrate and maintain its network at its discretion. These facilities include but are not limited to, a sufficient number of trunks to the point of interconnection with the tandem company, and sufficient interoffice and interexchange facilities and trunks between its own central offices to adequately handle traffic between all central offices within the service areas at a P.01 grade of service or better. The provisioning and engineering of such services and facilities will comply with generally accepted industry methods and practices, and will observe the rules and regulations of the lawfully established tariffs applicable to the services provided.

  • Interconnection Point The Service Provider is responsible for connecting to the LFC Network at the Interconnection Point. The LFC may only change an Interconnection Point if a change is necessary to protect the security or integrity of that Interconnection Point in order to maintain the continuity of supply of the Wholesale Services. In the event of any such change:

  • Two-Way Interconnection Trunks 2.4.1 Where the Parties have agreed to use Two-Way Interconnection Trunks for the exchange of traffic between Verizon and NUI, NUI shall order from Verizon, and Verizon shall provide, the Two-Way Interconnection Trunks and the Entrance Facility, on which such Trunks will ride, and transport and multiplexing, in accordance with the rates, terms and conditions set forth in this Agreement and Verizon’s applicable Tariffs.
