CEQA CATEGORICAL EXEMPTION. DISTRICT REQUESTED The District has designed the Project to avoid impacts to the extent feasible and potentially qualify for a CEQA Categorical Exemption, Class 2, Replacement or Reconstruction (CEQA Guidelines 15302). The Class 2 consists of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced, including but not limited to, (c) Replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity. Under this Task, Stantec will develop a Notice of Exemption (XXX) for the proposed Project and submit it to the District for review prior to submission to the California State Clearinghouse (SCH). Categorical Exemptions have some restrictions and it is our understanding the District’s legal counsel and staff reviewed the legal applicability of this approach for a replacement project and based on current information found it preferred. As such, Stantec will develop the CEQA Cat Ex form and facilitate submittal to the State Clearinghouse. If an IS/MND is required, we can perform these services under a separate scope. CEQA CATEGORICAL EXEMPTION. Prepare a Categorical Exemption (Cat Ex) for this project. The City will file the Notice of Exemption (XXX) with the County. Deliverable(s): ‐ Cat Ex (.docx format) 3. 65% Plans, Specifications, and Estimate (PS&E) Prepare 65% Plans, Specifications, and Estimate based upon the Final Project Scoping Memo. Curb ramps will be designed using Caltrans standard curb ramp “cases” and County of Sacramento Standard Plan 4‐54 for sidewalk ramp retrofits of existing sidewalks. The Plans will identify the conform locations and quantify the removal and replacement area to achieve the selected curb ramp “case”. Drainage improvements will be shown in plan view (no profiles) and made as close to in‐place as possible to avoid potential utility conflicts. Pavement rehabilitation sheets will be shown in plan view (no profiles) at a scale of 40‐, 60‐, or 80‐scale with an aerial background image. Speed humps will be removed and replaced at a height equal to or less than the existing height. Striping will match existing with the exception of improvements noted in the City’s Bicycle Master Plan, extending bike lanes and striping on Ambassador Dr from River Trails Cir to the end of Ambassador Dr, and intersections where stop bar and intersection striping do not match current standard plans. In addition, signage and striping improvements and curb, gutter, and sidewalk repairs on Chase Dr and Georgetown Dr recommended in the City’s Safe Routes to School Plan will be implemented with this project.   • Texas Education Code Chapter 22 Contractor Certification for Contractor Employees Introduction Texas Education Code Chapter 22 requires entities that contract with school districts to provide service s to obtain criminal history record information regarding covered employees. Contractors must certify to the district t hat they have complied. Covered employees with disqualifying criminal histories are prohibited from serving at a sch ool district. Definitions: Covered employees: Employees of a contractor or subcontractor who have or will have continuing dutie s related to the service to be performed at the District and have or will have direct contact with students. The District will be the final arbiter of what constitutes direct contact with students. Disqualifying criminal history: Any conviction or other criminal history information designated by the District, or one of the following offenses, if at the time of the o ffense, the victim was under 18 or enrolled in a public school: (a) a felony offense under Title 5, Texas Penal Code; (b) an offense for which a defendant is required to register as a sex offender under Chapter 62, Texas Code of Criminal Procedure; or (c) an equivalent offense under federal law or the laws of another state. I certify that: NONE (Section A) of the employees of Contractor and any subcontractors are covered employees, as defined abo ve. If this box is checked, I further certify that Contractor has taken precautions or imposed conditions to ensure tha t the employees of Contractor and any subcontractor will not become covered employees. Contractor will maintain t hese precautions or conditions throughout the time the contracted services are provided. OR SOME (Section B) or all of the employees of Contractor and any subcontractor are covered employees.
