Challenges to Test Results. 1. After receipt of the confirmed positive test result from the MRO, the City will notify the employee in writing of the test result and the consequences of such results. 2. An employee who receives a confirmed positive drug test result may request a challenge to the test results with the MRO or designee within five (5) days notification. The challenge must be in writing, signed and dated by the test donor, and filed with Risk Management, Employee Relations and the MRO. The test donor is responsible for proving that they complied with the timeliness requirements of this section. At the employee’s written request and sole expense, the split specimen will be tested at a Department of Health and Human Services (DHHS) certified laboratory of the employee’s choosing. Such challenge must include the chain of custody specimen identification number.
