Championship, Series and Class Sponsor Exclusivity. Team agrees that, in addition to the advertising and promotional rights granted in Sections 6 and 7, when participating in any Event or any advertising and promotion using my Attributes, and based on my participation in the Championship, unless otherwise expressly authorized in writing by MotoAmerica, no product, brand, logo, trademark or service identification of a company in the category of the official Championship sponsor of MotoAmerica or the official sponsor of any Series or Class, will be used or displayed anywhere by Team, its riders or team members, including, but not limited to, on the rider’s or crew members’ Championship uniforms, or Team’s Championship motorcycles, as well as the team’s equipment, and/or haulers. Team understands and agrees that MotoAmerica may, in its sole discretion, refuse to permit or limit the use or display of a product, brand, logo, trademark or service identification of a company in any such category, including, but not limited to, on the rider’s or crew members’ uniforms, or the motorcycle owner’s motorcycle, the team’s equipment, and/or haulers. Team understands and agrees that all determinations of whether a company or its products and services are in any such category shall be made by MotoAmerica in its good faith discretion and are final and non-litigable. MotoAmerica will provide detailed category descriptions when available.

  • SPECIALIZED JOB CLASSES Where there is a particular specialized job class in which the pay rate is below the local market value assessment of that job class, the parties may use existing means under the collective agreement to adjust compensation for that job class.

  • Class Sizes In the annual assignment of duties, the designated supervisor shall consult with the department in determining appropriate class sizes for individual courses. In making such a determination, the designated supervisor shall consider operational requirements, sound pedagogical principles, and the workload implication of teaching such courses (also see Letter of Understanding #3).

  • Class Size The School shall be in compliance with Florida Constitutional Class Size Requirements, as applicable to charter schools.

  • Corresponding Class of Reference Tranches With respect to (i) the Class M-1 Notes, the Class M-1 Reference Tranche, (ii) the Class M-2 Notes, the Class M-2 Reference Tranche, (iii) the Class M-3A Notes, the Class M-3A Reference Tranche, (iv) the Class M-3B Notes, the Class M-3B Reference Tranche and (v) the Class B Notes, the Class B Reference Tranche.

  • Provider Selection To the extent applicable to Provider in performance of the Agreement, Provider shall comply with 42 CFR 438.214, as may be amended from time to time, which includes, but is not limited to the selection and retention of providers, credentialing and recredentialing requirements and nondiscrimination. If Subcontractor and/or Health Plan delegate credentialing to Provider, Subcontractor and/or Health Plan will provide monitoring and oversight and Provider shall ensure that all licensed medical professionals are credentialed in accordance with Health Plan’s and the State Contract’s credentialing requirements.

  • Allocation of Senior Reduction Amount to the Reference Tranches On each Payment Date prior to the Termination Date, after allocation of the Tranche Write-down Amount or Tranche Write-up Amount, if any, for such Payment Date as described above, the Senior Reduction Amount will be allocated to reduce the Class Notional Amount of each Class of Reference Tranche in the following order of priority, in each case until its Class Notional Amount is reduced to zero:

  • Classes of Trust Fund Certificates The Trust Fund Certificates authorized by this Trust Agreement shall be divided into the Classes listed on the cover of the Prospectus Supplement (other than the Class 46-RL Certificate), which Classes shall have the Class designations, original Class Balances, Interest Rates and Final Distribution Dates specified in the Prospectus Supplement.

  • Classes The officers of the Company shall be a President, a Secretary, a Treasurer, and, if deemed necessary, expedient, or desirable by the Board of Managers, an Executive Vice President, one or more Senior Vice Presidents, one or more other Vice Presidents, one or more Assistant Treasurers, one or more Assistant Secretaries, and such other officers as may be elected or appointed in accordance with the provisions of this article. Additional officers and duties may be added by amendments to this article by the Members.

  • TEACHING HOURS AND CLASS LOAD A. Teacher hours of duty shall be: Seven (7) hours and forty-five (45) minutes per day

  • RIGHTS OF THE EMPLOYER The Employer reserves and retains, solely and exclusively, all management rights, powers, and authority, including the right of management to manage, control, and direct its work forces and operations except those as may be modified under this Agreement.
