Category Exclusivity. The Consultant agrees not to provide any services similar to the Services to any company that manufactures, markets, sells or distributes alternative protein products (including plant based protein, insect based protein and cultured or lab grown meat) or non-Australian red meat products during the term of a Statement of Work and for 3 months after expiry or termination of a Statement of Work for any reason.
Category Exclusivity. From the Opening Date through the end of the Term, and for so long as Sponsor is not in default of this Agreement, subject to Section 4.2 below and Section 13.15 below, neither Brooklyn Arena nor NJ Basketball shall: (a) display (or cause or authorize the display of) signage or other advertisements in the Arena or on the Arena premises, nor engage in sponsorship or promotional activities for or concerning beverage products in the Exclusive Category other than beverage products in the Exclusive Category of or concerning Sponsor; (b) grant any form of trademark visibility or promotional or advertising rights to any beverage products in the Exclusive Category other than beverage products in the Exclusive Category of or concerning Sponsor; (c) grant advertising or promotion rights - including use of the Brooklyn Party Marks - to any third party in a way that permits a third party to use such rights in association with beverage products in the Exclusive Category other than beverage products in the Exclusive Category of or concerning Sponsor; (d) permit any Nets player or other NJ Basketball employee to use the Brooklyn Party Marks to sponsor or endorse any beverage product in the Exclusive Category other than beverage products in the Exclusive Category of or concerning Sponsor; or (e) grant any third party the right to conduct promotions involving beverages in the Exclusive Category or related beverage products (by way of illustration but not limitation, coolers), including promotions that relate primarily to non-beverage products that involve a beverage product in the Exclusive Category other than beverage products in the Exclusive Category of or concerning Sponsor. In connection therewith, Sponsor acknowledges that the Entitlements granted hereby shall relate only to Sponsor’s products or services within the Exclusive Category and that Sponsor shall have no rights to Entitlements outside the Exclusive Category. In addition, Sponsor’s beverage products within the Exclusive Category shall be the only beverage products served or sold within the Arena or on the Arena premises (the “Exclusive Beverage Availability Right”).
Category Exclusivity. Sponsor shall be exclusive in relation to the gun safe category and designated the “Official Gun Safe Supplier of “Txxx Xxxxxxx Racing Nitro”.
Category Exclusivity. HE agrees that WJ shall be granted the sole and exclusive Private Label rights in the field of female fitness (the “Category”) for the agreed upon products for the duration of this Agreement.
Category Exclusivity. For the term of this Agreement, GeoCities shall not allow Excluded Companies or other merchants (except "GeoShop" merchants who do not have in excess of $[***] total annual revenue from the sale of sports, travel, and/or entertainment tickets) primarily in the business of marketing, distributing or selling tickets to travel, live entertainment or sporting events to participate in the Program by allowing affiliates in the Program to establish Links to such merchants' Websites for the purpose of effectuating the sale of tickets to live entertainment or sporting events. For the purposes of this Agreement, "Excluded Companies" shall include, but not be limited to, Ticketmaster, Inc., Ticketmaster Online Citysearch, Inc., USA Networks, Lycos, ETM, Advantix, Inc., TicketStop, LaserGate, Schubert, Nederlander, Paciolan, BASS, Protix, TicketsLive, Fantastix, CultureFinder, Capital Tickets, Dillards, TicketWeb, Bill Xxxxxx Presents, Center State, TicketWeb, and SFX.
Category Exclusivity. From time to time, SubTV shall define categories of advertisements and notify such categories, and any alterations and additions to them, to the Advertiser from time to time. As long as the Advertiser has entered into a Contract with SubTV for a Programme within a particular category then SubTV agrees it will not, during the continuance of that Contract, contract with other advertisers within that same category to provide a Programme at the same venue in respect of which SubTV has entered into a Contract with the Advertiser for.
Category Exclusivity. (a) Distribution Representative agrees that no sample, coupon or other material for a product directly competitive with Advertiser’s coupons or sample will be included in the bag containing their promotion.
Category Exclusivity. From the Effective Date through the end of the Term, subject to any exceptions to exclusivity agreed to by NAMING RIGHTS PARTNER and BPL, and as long as no NAMING RIGHTS PARTNER Default exists, the COUNTY hereby grants to NAMING RIGHTS PARTNER and NAMING RIGHTS PARTNER shall enjoy, exclusive branding and promotion rights in the Exclusive Category to the extent within the control of the COUNTY. In furtherance of this grant:
6.1.1. COUNTY shall not grant to any Exclusive Category Competitor any right or license to advertise or promote any products or services within the Exclusive Category anywhere in the Arena or on the Site (including, without limitation, on any structural improvements or erected improvements to the court or other service within the Arena or elsewhere in the Arena or on the Site) or display any Signage or other advertisements in the Arena or on the Site or any part thereof.
6.1.2. The COUNTY shall not display (or cause, authorize or permit the display of), subject to Section 6.2, any Signage or other advertisement or promotion in the Arena or anywhere else on the Site that promotes, identifies or refers to any products or services in the Exclusive Category (other than products or services in the Exclusive Category of or concerning NAMING RIGHTS PARTNER);
6.1.3. The COUNTY shall not grant any right or license to use the Arena Name, Arena Logo, or any of the Arena Marks (A) to any Person (other than NAMING RIGHTS PARTNER) in connection with any products or services in the Exclusive Category or (B) to any Exclusive Category Competitor for any purpose;
6.1.4. The COUNTY shall not engage in or authorize any Person to conduct any activation or promotional activity with respect to any products or services in the Exclusive Category, or grant any Exclusive Category Competitor to conduct any activation or promotional activity, at or in connection with the Arena or anywhere on the Site.
6.1.5. The Parties acknowledge that while the Arena itself shall be known exclusively by the Arena Name, certain areas within the Arena may be referred to or associated with other names and the COUNTY shall not be in breach of this Agreement if BPL permits additional Persons to sponsor and/or name one or more localized areas within the Arena.
