The "Changes in Quantity" clause allows for adjustments to the amount of goods or services specified in a contract. Typically, this clause outlines the process by which either party can request an increase or decrease in the ordered quantity, often subject to certain limitations or notice requirements. For example, a buyer may need to notify the seller in writing if they wish to order more units than originally agreed, and pricing or delivery schedules may be adjusted accordingly. CHANGES IN QUANTITY. A. Except as provided in Section 7.07, the unit Bid price shown in the Bid Schedule shall be used to determine the payment owed Contractor for any changes in quantity.
B. The actual quantity placed, as determined by the Project Manager, shall be used to calculate the payment due to Contractor.
C. Prior to any Work being performed in excess of any of the Bid Schedule quantities, Contractor shall notify the Town, in writing, of every quantity that will exceed 105% of the quantity listed on the Bid Schedule.
D. Except as provided in Section 7.08, Contractor shall not be entitled to compensation for any increased expense, loss of expected reimbursement or loss of anticipated profits, directly or indirectly caused by any changes in quantity.
CHANGES IN QUANTITY. At any time during the term of this Agreement, the Buyer shall have the right either to increase or decrease the quantity nominated hereunder CONTRACT #▇▇-▇▇▇-▇▇▇ by up to 25% of the then current quantity. Buyer shall give notice of such change to Seller at least three months before the effective date of such change. Buyer may exercise this right repeatedly throughout the term of this Agreement, except that the quantity nominated may not be either increased or decreased more than 25% within any 90 day period and for any calendar year, the total quantity nominated by Buyer shall not be less than 600,000 tons and shall not be more than 2.5 million tons.
CHANGES IN QUANTITY. Where the Task Order identifies a price for changes in quantities of the Work in an otherwise lump sum Task Order, such as a unit price for increases or decreases in a certain type of Work, Section 5.02, “Estimated Quantities,” will apply, regardless of whether or not it is a major item.
