Changes in Quantities. The City reserves the right to make changes in the quantities of the Work, as may be considered necessary or desirable and such changes shall not be considered as waiving or invalidating any conditions or provisions of the Contract or Bonds. The Contractor shall perform the Work as altered, whether increased or decreased, and no allowances shall be made for anticipated profits. Payment to the Contractor for the changes in the quantities of work shall be made only for the actual quantities of work performed and material furnished at the unit prices set forth in the Contract, except as provided below. a. When the quantity of work to be done or of material to be furnished under any item of the Contract is more than 125 percent of the quantity stated in the Contract, then either party to the Contract, upon demand, shall be entitled to negotiate for revised consideration on the portion of work above 125 percent of the quantity stated in the Contract. b. When the quantity of work to be done or of material to be furnished under any item of the Contract is less than 75 percent of the quantity stated in the Contract, then either party to the Contract, upon demand, shall be entitled to negotiate for revised consideration on the Work performed. c. Any consideration after that as set forth above shall be paid for as is hereinafter provided under Section 19.7. The foregoing notwithstanding, the quantity of work to be done or of material to be furnished under any item of the Contract, or the total original Contract shall not be increased more than 25 percent or reduced by more than 25 percent without the written consent of the Contractor and City.

Changes in Quantities. 7.7.1 In the event that the Customer wishes to vary its Nominated Annual Quantity, Nominated Monthly Quantity or Usage Profile at a Delivery Point, then: 7.7.1.1 the Customer will notify GasNet before 1 July in any Year of the Quantities for delivery during the following Year; and 7.7.1.2 if, at any time during the Year the Customer requires a variation to the Nominated Annual Quantity, Nominated Monthly Quantity or Usage Profile, the Customer shall notify GasNet, as soon as reasonably practical, of the new Quantity or Quantities. Any additional system throughput will be negotiated and agreed by the Parties in writing in the form attached as Appendix Three.
Changes in Quantities. Contractor understands and agrees that the quantities required for this Project are approximate, and that the total number of units upon which payment shall be made shall be as set forth in the inventory. If Owner changes the quantity of any Assembly Unit or Assembly Units specified in this Contract by more than fifteen percent (15%), and the materials cost to Contractor is increased thereby to an extent which would not be adequately compensated by application of the unit prices in this Contract to the revised quantity of such unit or units, such change, to the extent of the quantities of such units in excess of such 15% shall be regarded as a change in the construction.
Changes in Quantities. If the Project Owner reduces the quantities of Work performed by Subcontractor after making any partial payment, or the final payment, then CS Energy may deduct from any subsequent payment to Subcontractor the amounts of such decreased payment. The final amount of money to be paid the Subcontractor shall be in accordance with the final estimate of quantities as determined by the Project Owner, including all subsequent adjustments therein. The Project Owner or CS Energy may elect to eliminate, in part or in whole, items of Work hereunder or may wish to reduce the Work scope hereunder, and, in such event, the Subcontractor shall not be due anticipated profits or overhead or any other type of damages resulting from such deletions.
Changes in Quantities. The Contractor shall perform all Work necessary to complete the Project as described in the Contract Documents based on the unit prices included in the Pricing Schedule (Sheet). The quantities included in the Pricing Schedule (Sheet) are estimated. The Contractor will be paid based on the actual field measurements and actual quantities. Any increase or decrease in quantities installed as compared to quantities listed in the Pricing Sheet shall be provided at the unit prices quoted in the Pricing Sheet. Any unanticipated changes to the Scope of Work required to complete the Project will be addressed by means of a Change Order.

  • Changes in Work A. Work Previously Submitted as Satisfactory. If the Engineer has submitted work in accordance with the terms of this contract but the State requests changes to the completed work or parts thereof which involve changes to the original scope of services or character of work under the contract, the Engineer shall make such revisions as requested and as directed by the State. This will be considered as additional work and paid for as specified under Article 4, Additional Work.

  • Changes in GAAP If at any time any change in GAAP would affect the computation of any financial ratio or requirement set forth in any Loan Document, and either the Borrower or the Required Lenders shall so request, the Administrative Agent, the Lenders and the Borrower shall negotiate in good faith to amend such ratio or requirement to preserve the original intent thereof in light of such change in GAAP (subject to the approval of the Required Lenders); provided that, until so amended, (i) such ratio or requirement shall continue to be computed in accordance with GAAP prior to such change therein and (ii) the Borrower shall provide to the Administrative Agent and the Lenders financial statements and other documents required under this Agreement or as reasonably requested hereunder setting forth a reconciliation between calculations of such ratio or requirement made before and after giving effect to such change in GAAP.

  • Changes in Fiscal Periods Permit the fiscal year of the Borrower to end on a day other than December 31 or change the Borrower’s method of determining fiscal quarters.

  • Changes in the Work The Department may order changes in the work, the Contract Amount being adjusted accordingly. Any monetary adjustment or any substantive change in the work shall be in the form of an amendment, signed by both parties and approved by the State Purchases Review Committee. Said amendment must be effective prior to execution of the work.
