COMMITMENTS BY CANADA a) Canada agrees to pay a contribution to the Recipient of not more forty percent (40%) of the total Eligible Expenditures for assets owned by municipalities and non-for-profit organization in provinces but only up to a maximum of eleven million, nine hundred and sixteen thousand and seventy-four dollars ($11,916,074).
b) Canada will pay the contribution in accordance with the terms and conditions of this Agreement and the Fiscal Year breakdown in Schedule B2 (Project Components and Cashflow).
c) The Parties acknowledge that Canada’s role in the Project is limited to making a financial contribution to the Recipient for the Project and that Canada will have no involvement in the implementation of the Project or its operation. Canada is neither a decision-maker nor an administrator to the Project.
d) If Canada's total contribution towards the Project exceeds forty percent (40%) of the Project’s total Eligible Expenditures or if the Total Financial Assistance received or due in respect of the total Project costs exceeds one hundred per cent (100%) thereof, Canada may recover the excess from the Recipient or reduce its contribution by an amount equal to the excess.
COMMITMENTS BY CANADA a) Canada agrees to provide funding under PTIF to Alberta in a total amount not to exceed three hundred forty seven million one hundred ninety thousand dollars ($347,190,000) to be paid in accordance with Schedule A (Program Details).
b) Canada agrees to provide funding under CWWF to Alberta in a total amount not to exceed one hundred ninety six million seven hundred fourteen thousand one hundred twenty nine dollars ($196,714,129) to be paid in accordance with Schedule A (Program Details).
c) The Parties acknowledge that Canada’s role in a Project is limited to making a financial contribution to Alberta for that Project and that Canada will have no involvement in the implementation of that Project or its operation. Canada is neither a decision-maker nor an administrator to a Project.
COMMITMENTS BY CANADA. Canada agrees that it will:
a) honour any existing contribution agreement with British Columbia in respect of infrastructure, in accordance with its terms;
b) ensure that the funding described in this Agreement is in addition to federal funding available to British Columbia under the Municipal Rural Infrastructure Fund, the Border Infrastructure Fund and the Canada Strategic Infrastructure Fund;
COMMITMENTS BY CANADA a) Canada agrees to provide contribution funding to Ontario under the public transit stream of the Program in a total amount not to exceed $7,468,174,969 to be paid in accordance with Schedules A.1 (General Program Requirements) and A.2 (Public Transit).
b) Canada agrees to provide contribution funding to Ontario under the green infrastructure stream of the Program in a total amount not to exceed $2,245,764,810 to be paid in accordance with Schedules A.1 (General Program Requirements) and A.3 (Green Infrastructure).
c) Canada agrees to provide contribution funding to Ontario under the community, culture and recreation infrastructure stream of the Program in a total amount not to exceed $407,159,893 to be paid in accordance with Schedules A.1 (General Program Requirements) and A.4 (Community, Culture and Recreation Infrastructure).
d) Canada agrees to provide contribution funding to Ontario under the rural and northern communities infrastructure stream of the Program in a total amount not to exceed $250,067,117 to be paid in accordance with Schedules A.1 (General Program Requirements) and A.5 (Rural and Northern Communities Infrastructure).
e) Canada agrees to provide a portion of Canada’s total contribution funding identified in paragraphs a) through d) of this section to Ontario for Administrative Expenses to be paid in accordance with section 16 (Administrative Expenses).
f) The Parties acknowledge that Canada’s role in a Project is limited to making a financial contribution to Ontario for that Project and that Canada will have no involvement in the implementation of that Project or its operation. Canada is neither a decision-maker nor an administrator of a Project.
COMMITMENTS BY CANADA a) Canada agrees to provide contribution funding to New Brunswick under the public transit stream of the Program in a total amount not to exceed one hundred sixty five million two hundred two thousand six hundred sixty two dollars ($165,202,662) to be paid in accordance with Schedules A.1 (General Program Requirements) and A.2 (Public Transit).
b) Canada agrees to provide contribution funding to New Brunswick under the green infrastructure stream of the Program in a total amount not to exceed three hundred forty seven million one hundred fifty one thousand two hundred thirty two dollars ($347,151,232) to be paid in accordance with Schedules A.1 (General Program Requirements) and A.3 (Green Infrastructure).
c) Canada agrees to provide contribution funding to New Brunswick under the community, culture and recreation infrastructure stream of the Program in a total amount not to exceed forty six million two hundred thirty thousand thirty eight dollars ($46,230,038) to be paid in accordance with Schedules A.1 (General Program Requirements) and A.4 (Community, Culture and Recreation Infrastructure).
d) Canada agrees to provide contribution funding to New Brunswick under the rural and northern communities infrastructure stream of the Program in a total amount not to exceed one hundred fourteen million six hundred thirty three thousand six hundred thirty six dollars ($114,633,636) to be paid in accordance with Schedules A.1 (General Program Requirements) and A.5 (Rural and Northern Communities Infrastructure).
e) Canada agrees to provide a portion of Canada’s total contribution funding identified in paragraphs a) through d) of this section to New Brunswick for Administrative Expenses to be paid in accordance with section 16 (Administrative Expenses).
f) Canada agrees to consider requests from New Brunswick to transfer contribution funding under the public transit stream to the green infrastructure stream, specifically the climate change mitigation sub-stream, as described in section A.
3 a) (Green Infrastructure) after March 31st, 2021.
g) The Parties acknowledge that Canada’s role in a Project is limited to making a financial contribution to New Brunswick for that Project and that Canada will have no involvement in the implementation of that Project or its operation. Canada is neither a decision-maker nor an administrator of a Project.
COMMITMENTS BY CANADA a) Canada agrees to provide funding under CWWF to British Columbia in a total amount not to exceed two hundred twenty-five million sixty-seven thousand seven hundred twenty-one dollars ($225,067,721) to be paid in accordance with Schedule A (Program Details).
b) The Parties acknowledge that Canada’s role in a Project is limited to making a financial contribution to British Columbia for that Project and that Canada will have no involvement in the implementation of that Project or its operation. Canada is neither a decision-maker nor an administrator to a Project.
COMMITMENTS BY CANADA a) Canada agrees to provide funding under PTIF to Ontario in a total amount not to exceed $1,486,680,000 to be paid in accordance with Schedule A (Program Details).
b) The Parties acknowledge that Canada’s role in a Project is limited to making a financial contribution to Ontario for that Project and that Canada will have no involvement in the implementation of that Project or its operation. Canada is neither a decision-maker nor an administrator to a Project.
COMMITMENTS BY CANADA. Canada agrees to pay a contribution to the Recipient of not more than sixty percent (60%) of the total Eligible Expenditures for the Project but only up to a maximum of three million dollars ($3,000,000).
COMMITMENTS BY CANADA a) Canada agrees to pay a contribution to the Recipient of not more than 40 percent (40%) of the total Eligible Expenditures but only up to a maximum of nineteen million eight-hundred thousand dollars ($19,800,000).
b) Canada will pay the contribution in accordance with the terms and conditions of this Agreement and the Fiscal Year breakdown in Schedule B2 (Project Components and Cashflow).
c) The Parties acknowledge that Canada’s role in the Project is limited to making a financial contribution to the Recipient for the Project and that Canada will have no involvement in the implementation of the Project or its operation. Canada is neither a decision-maker nor an administrator to the Project.
d) If Canada's total contribution towards the Project exceeds forty percent (40%) of the Project’s total Eligible Expenditures or if the Total Financial Assistance received or due in respect of the total Project costs exceeds one hundred per cent (100%) thereof, Canada may recover the excess from the Recipient or reduce its contribution by an amount equal to the excess.
COMMITMENTS BY CANADA a) Canada agrees to provide funding to New Brunswick in a total amount not to exceed Thirty nine million three hundred sixty three thousand seven hundred and twenty three dollars ($39,363,723) to be paid in accordance with the estimated Fiscal Year breakdown in Schedule A (Allocation) for Eligible Expenditures.
b) The maximum federal funding for a Project, from all federal sources, will not exceed one third (33.33 %) of the total Eligible Expenditures for that Project. Notwithstanding the foregoing, the maximum federal funding from all sources to provincially-owned highways and major roads, and public transit Projects will not exceed one-half (50%) of the total Eligible Expenditures for a Project.
c) Notwithstanding subsection 3.1(b) (Commitments by Canada), the maximum federal funding to a Project, from all federal sources will not exceed one quarter (25%) of the total Eligible Expenditures for a Project that is delivered as a public-private partnership or implemented by an Ultimate Recipient that is from the for-profit private sector.
d) New Brunswick can allocate up to one percent (1%) of Canada's total funding for incremental administration costs incurred in the delivery of the SCF by New Brunswick.
e) Notwithstanding subsection 3.1(b) (Commitments by Canada), only funding received from the First Nations Infrastructure Fund will be included in the maximum federal funding for Projects advanced by an Ultimate Recipient identified in subsection (c) of the definition of “Ultimate Recipient”. All other sources of funds received by that Ultimate Recipient for that Project from Aboriginal Affairs and Northern Development Canada will not count toward the maximum federal funding.
f) The Parties agree that Canada’s role is limited to providing funding to Projects and that Canada will have no involvement in the implementation of any Project or its operation. Canada is neither a decision-maker nor an administrator of a Project.
g) If Canada concludes an Agreement with respect to the Small Communities Fund for similar purposes with any other province or territory of Canada, and that Agreement taken as a whole is materially different from this Agreement, New Brunswick may ask Canada to agree to amend this Agreement so that, taken as a whole, it affords similar treatment to New Brunswick as the other Agreement affords to the other province or territory.
